On January 9, 2013, the Commission decided to include in every agenda a status report on the North Campus applications in order to be able to set the next public hearing date on the applications to extend water service to the Upper Campus of UC Santa Cruz.

"Here are the latest updates regarding LAFCO & the Upper Campus water service extensions:

"1) On December 21, the Court of Appeal vacated its former decision that had invalidated the city/university's EIR. This was in response to the city/university's petition for a re-hearing. That means the EIR is now valid again, until and unless the court re-affirms their previous decision at the new hearing.

"2) At the January 9th LAFCO meeting, UCSC officially asked the Commission to put its Upper Campus applications back on the agenda. LAFCO will be considering this request at their next meeting (February). This means that the public hearing process re: Upper Campus could resume as soon as March or April.

"Both of these are inauspicious developments. The university is, of course, pushing hard to ram through the EIR, get their permits, and clear the path for future construction projects in Upper Campus--regardless of the environmental and social consequences of doing so.

"For more clarity, here is an excerpt from a January 8, 2013 letter to LAFCO from Kelly Drumm, Senior Counsel for the Regents of the University of California:

"On December 21, 2012, the Court of Appeal in Habitat and Watershed Caretakers v. City of Santa Cruz et al., granted the petition for rehearing filed by the City and University and vacated its published decision. As long as litigation is still pending, LAFCO is required as a matter of law to assume that the EIR complies with CEQA…Accordingly, the reason stated in LAFCO's January 2, 2013 staff report for not moving forward with the Project no longer exists."
