Los Angeles City Council To Discuss Medical Marijuana Moratorium (ICO) Today

The Los Angeles City Council will hold a hardship exemption hearing this morning for Cahuenga Caregivers Inc dba Bulldog Cafe. This is an important hearing in the hardship exemption process as Cahuenga Caregivers Inc was one of the original 187 medical marijuana collectives registered in Los Angeles under the Interim Control Ordinance (ICO, aka- the moratorium) in September 2007. Also, in a special session council will discuss the revised city ICO (moratorium) regulating the medical marijuana collectives. This revision attempts to strike the hardship exemption provision from the ICO and also will extend the ICO 6 months to March of 2010.

The Los Angeles City Council will hold a hardship exemption hearing this morning for Cahuenga Caregivers Inc dba Bulldog Cafe. This is an important hearing in the hardship exemption process as Cahuenga Caregivers Inc was one of the original 187 medical marijuana collectives registered in Los Angeles under the Interim Control Ordinance (ICO, aka- the moratorium) in September 2007.

The collectives landlord received one of the DEA letters and evicted the collective from their registered address and forced them to relocate.

Cahuenga Caregivers Inc is the first hardship hearing of the approximately 45 (out of the original 187) collectives that registered under the ICO but then were forced to relocate and file hardship exemption applications.

Also, in a special session council will discuss the revised city ICO (moratorium) regulating the medical marijuana collectives. This revision attempts to strike the hardship exemption provision from the ICO and also will extend the ICO 6 months to March of 2010.

In an email posted to a drug policy forum last night Don Duncan, California Director of Americans for Safe Access said "Advocates worry that the extension violates California Government Code 65858, which prohibits cities from using an Urgency Ordinance to establish a moratorium for more than two years. This may generate litigation when the initial two-year moratorium expires on September 14, 2009, and new collectives try to open."

The meeting begins at 10:00 AM today at City Hall, 200 N Spring Street in downtown Los Angeles.
