Below are the replies to the tenants who stand to lose a minimum of 35 square foot of space from their rental units by the thugs involved who are terrorizing the low-income renters at Effies House into allowing the Demolition Crews to come in and start demolishing their homes because of a screw up between the landlord, contractors, and Oakland City Inspectors....

In the form of a letter from the Law Offices of Charles Tillman Ramsey, this landlord thug showed up upon the scene in the from of a letter to the tenants at Effies House yesterday (Sat June 7).

Dear Tenant June 4, 2003

I write in your response to your May 20, 2003 letter referring to the May 14, 2003 Notice of Change in Terms of Tenancy. Measure EE has no application to the current situation. You are not being evicted and you will retain possession of your rental unit. Measure EE applies only to evictions.

Reply--Ramsey is a liar. Measure EE is specifically written to allow renters of Oakland covered by the new rent law to decline to accept Changes in Terms of Tenancy that materially change the terms of the contract.

PARTIAL EVICTIONS & ILLEGAL OCCUPATION

When a landlord rents space to you, and then later wants to claim that part of that space is being reclaimed back by the landlord without offering any sort of compensation to the renter, this is a serious breach of the contract & constitutes a material change in the contract. Measure EE covers the renters of Effies House & Attorney Ramsey a well known hitman for the landlords is trying to flex his muscles to silence any sort of dissent on behalf of the non-profit controling the property. The tenant who received the above mentioned letter from Ramsey refused to accept the Change in Terms of Tenancy reffered to in the letter, and was targeted for harassment & intimidation.

Notice To Tenants from Non-Profit Landlord--EBALDC/Ivy Hill.
Note:Ivy Hill is a front corporation for EBALDC run out of the offices of EBALDC.

Demolition & Construction Information

(Note: 3 Contractors with Crews are to be running in & out of the homes of the tenants for this project...Demo Crews, Electrical Crews, & Construction Crews)

Demolition & Construction begins Mon June 16, & will require approximately 6 weeks to complete.

Working Hours are 8 to 5 unless situations arise that may require additional daily time.

The work will cause dust, noise, banging, inconvenience etc. associated with the demolition and construction activities. Note: The tenants contracts make note of lead paint problems at the property...

Power will be turned off intermittently between 8-5pm during five days of work minimum. Be advised that the power outage/s may affect the whole building (21 rental units), and all tenants should be prepared to experience power outages. Ivy Hill/EBALDC claims that they will not be responsible for any damages to the tenants property, food spoilage, or damage to electrical appliances, computers, vcr's etc, due to the power outages or work being done by the contractors...

Lastly....It says;

Please be advised that the construction site is a hazardous area for your safety, tenants & quests are advised not to trespass on the construction site...

For What It's Worth...

The construction site "is" the home of each of effected renter at Effies House and cannot be avoided even if they tried...How does one avoid trespassing in their own home?

The madness of it all is that all of the above is the result of a botched outside exterior stairway project built improperly recently. The outside exterior stairway project had nothing to do with the interior apartments, other than the need to have a landing outside each of the tenants doors needing access to the stairs.

6 rental units needed access to the new outside stairway project that was built to only accomodate 4 rental units.

When the tenants complained they were told to shut up, and the landlord claimed that it was all perfectly legal to build the stairs in such a way.

That is until the Fire Marshalls Office showed up & shut the project down....

THE SOLUTION

The City of Oakland refused to sign off on the botched stairway project after the Fire Marshalls Office stopped the project. The landlord blamed the tenants for the mess, and claim that the city was going to look the other way until someone alerted the Fire Marshalls Office about the corruption going on with this project and exposed what was going on.

The solution: Rebuilding the stairs to accomodate the blocked units is the solution, but, was a non-starter for the pigs involved in this mess trying to cover their ass. They did not want to rebuild those stairs one more time...$$$$$$$$$$$$$

City Officials met with the landlord & the contractor, and decided to start demolishing the rental units to create new common areas that would allow access to the blocked units needing acces to the outside stairs.

Non of the tenants were invited to this meeting in which the collaborators decided to take it out of the tenants so as to get their ass out of the mess they created...

Now the tenants are expected to lay back and take it up the ass to accomodate the corrupt bastards demanding the right to partially demolish thier homes.

This Scheme Sounds Outrageous!

Let me get this straight.

The non-profit refuses to re-build stairs that were built wrong which Oakland Officials refuse to sign off on.

They then decide to disrupt the lives of real people in 21 rental units, and expose them to power outages, demolition crews, toxic dust & lead paint dust exposure, while at the same time they plan to steal rental space from people who are paying rent so that they may convert the same space to other uses?

That means that they rent out space that they later steal back, but, still charge the renters the same amount of money for the space that this non-profit housing organization would occupy for their own purposes?

Does that sound right to you?

Sounds like the scam of the century to me!

Is Mother Theresa involved with these crooks?

All too often these Mother Teresa types run around trying to convince everyone that they are exempt from the common laws that apply to most others.

As these poverty pimps carouse with the champagne crowd at their fundraisers, their glossies never seem to mention what happens to the little people being harassed into silence by high priced lawyers trying to cover up the mess they always get into.

During October of 2000, the residents of the Oak Park Apartments (56 units) in Oakland won a $1 Million Dollar settlement against their slumlord named David Choo.

Attorney Jay Koslofsky worked his magic for the tenants to win the settlement.

Choo lost the building & property, and the City of Oakland handed the property over to E.B.A.L.D.C. with a $2.2 million loan/settlement on a silver platter with all the Asian Immigrants loaded with money from the lawsuit against Choo. Nearly $20,000.00 per family or more.

The building was in a total mess with slum like conditions through out, and not the sort of place people would pay rent for due to the uninhabitable conditions leading to the lawsuit.

E.B.A.L.D.C. quickly targeted the immigrants who won the settlement money. E.B.A.L.D.C. could'nt ignore those immigrants with all of that money, and ended up frightening most of the families out of $20 K each.

The money was listed as donations to E.B.A.L.D.C., and in return the immigrant familes were taught how to keep their SSI Money coming in while staying there to reside in slum like conditions.

The story broke in the Oakland Tribune on Monday August, 13 2001 by Laura Counts. The story mentioned that most of the families donated their $20 K to E.B.A.L.D.C., but, she failed to cover how the renters were really frightened into giving up most of a million dollars to the non-profit.

There was not any mention how the folks at E.B.A.L.D.C. taught the immigrants how to scam on SSI after winning a million dollar suit, that E.B.A.L.D.C. wanted to get their hands on.

In stead of the immigrants becoming part owners of the property, they were swindled out of their money and left to live there in slum like conditions.

It takes a pro to work all the angles, and some of these non-profits never miss a trick.

Records reveal that Hess Electric has the contract to shut down the tenants power and relocate the breaker boxes and electrical lines running through all three floors at Effies House for the demolition crews..

Tenants face 5 days of power outages at a minimum during the course of 6 weeks demo/construction, but, some believe that that the power outages will last longer due to the fact that the LL wants to chase renters out of the building so they may double the rents.

The renters have not been offered shelter or compensation by the LL for the nightmare being brought into their homes.

Contact Hess Electric and tell them to refuse to be a part of the scheme to fuck over the renters at Effies House!!!!

List of Demands

1) Katie Davis must be removed or resign immediately from her position being used to abuse Oakland Tenants.

2) Oakland Tenants demand the immediate arrest & prosecution of Katie Davis for Tax Fraud. EBALDC controls properties with over 700 rental units, each of which is controled by the Property Manager/Katie Davis.

A total of 12 properties that are required under state law to have a designated rental unit set aside for each of the Resident Managers required to reside at each properties under state law.

Katie Davis set up the scam to dump all of the required Resident Managers from all the properties so that she could rent out each of the Resident Manager Units while declaring a loss to the IRS on the annual 990 Tax Forms by claiming that the Resident Managers get free rent at a loss of $600 per month or more to EBALDC.

A HUGE SCAM!

While declaring a loss to the IRS at each of the 12 Resident Manager Units, she actually had the units rented out, concealed the profits, and declined to lower the rents for the tenants who received a reduction in services related to the loss of the Resident Managers.

3) Katie Davis must apologize to all the tenants for the Notice she had given out threatening to give the keys of the properties to the Oakland Police Department so that they may wander around the halls of the buildings looking for people using Medicinal Marijuana.

4) Katie Davis must rescind the Notice to Evict all Tenants caught using candles or incense before she resigns her position at EBALDC.

Tenants who use candles or incense for religious reasons are being threatened with eviction by Katie Davis & Lynette Lee of EBALDC. A life without candle light dinners, birthday cakes with candles, no incense, or holiday settings with candles/incense is what these thugs have been trying to enforce on the innocent renters in their properties as they violate the Civil Rights of the oppressed.
