Subject: An Open Letter Washington State Senators Regarding On-Going Criminal Activity and Retaliation by JBLM DES Police Leadership

Dear Senator Cantwell and Senator Murray,

We are writing to request your assistance and oversight regarding serious misconduct, abuse of authority, and retaliation by supervisors within the Directorate of Emergency Services (DES) Police at Joint Base Lewis–McChord (JBLM), WA 98433.

These actions raise significant concerns about violations of federal law, Department of Defense (DoD) policy, Army regulations, and the civil rights of service members, military retirees, and civilians in the surrounding community.

Public records and firsthand accounts indicate a pattern of behavior in which DES Police supervisors have:
• Entered false or misleading information into official law enforcement reports
• Submitted sworn statements and testimony that appear knowingly false
• Filed fraudulent or retaliatory eGuardian/Suspicious Activity Reports
• Retaliated against individuals who reported misconduct
• Misused command authority to bar whistleblowers from the installation
• Withheld evidence from defendants in criminal cases, undermining due process

These actions represent systemic failures in oversight and compliance with mandatory federal standards. They may also constitute criminal violations under the Uniform Code of Military Justice (UCMJ) and federal whistleblower protection laws.

Relevant DoD and Army Regulations Implicated
• DoD Directive 7050.06 – Military Whistleblower Protection - Prohibits reprisals against service members for making protected communications. Retaliatory investigations, false reporting, or attempts to bar individuals from the installation may violate this directive.
• DoD Instruction 5505.03 – Initiation of Investigations by Military Criminal Investigative Organizations - Requires impartial, fact‑based investigations free from improper influence. Allegations of falsified reports or retaliatory investigations directly conflict with this instruction.
• DoD Instruction 5505.07 – Titling and Indexing of Subjects of Criminal Investigations - Mandates accuracy and prohibits titling individuals without credible information. Retaliatory or fabricated entries violate this requirement.
• DoD Instruction 2000.26 – Suspicious Activity Reporting (SAR) Program - Requires that SAR/eGuardian submissions be truthful, factual, and non‑retaliatory. Fraudulent SARs undermine federal information‑sharing systems.
• Army Regulation (AR) 190‑45 – Law Enforcement Reporting - Requires accuracy, integrity, and completeness in all law enforcement documentation. Knowingly entering false information or withholding evidence violates this regulation.
• AR 600‑20 – Army Command Policy - Prohibits reprisal, abuse of authority, and actions that undermine good order and discipline.
• AR 15‑6 – Procedures for Administrative Investigations - Requires impartiality and prohibits conflicts of interest in investigations.

Potential UCMJ Violations
• Article 92 – Failure to obey regulations
• Article 107 – False official statements
• Article 132 – Retaliation against a whistleblower
• Article 134 – Conduct prejudicial to good order and discipline

Why Congressional Oversight Is Necessary
The actions of the DES leadership suggest a breakdown in internal accountability mechanisms at JBLM. When military law enforcement personnel misuse their authority, retaliate against whistleblowers, or obstruct due process, the consequences extend beyond the installation—they undermine public trust in federal institutions and violate the rights of U.S. citizens.

Given the seriousness of these concerns, we respectfully request that you:
• Initiate a Congressional inquiry into DES Police practices at JBLM.
• Request a DoD Inspector General investigation into the on-going misconduct and retaliation.
• Ensure whistleblowers are protected under DoDD 7050.06 and federal law.
• Seek a review of all cases potentially affected by falsified reports, improper testimony, or withheld evidence.
• Request a briefing from Army leadership on corrective actions and oversight measures.
• Require the JBLM Commander to immediately rescind retaliatory debarments and ensure that victims of JBLM DES misconduct have unimpeded access to on-post investigative agencies, such as Army CID and the I Corps Inspector General.

Your office’s involvement is essential to ensuring transparency, accountability, and the protection of individuals who have been subjected to on-going abuses of authority.

Multiple and repeated requests have been sent to the JBLM Commander without any response or corrective action being taken in response to our concerns.
