11/6: Legal groups sue Trump administration over use of Israeli spyware on immigrant communities

Civil rights attorneys are seeking documents disclosing details on the extent of ICE’s use of invasive Israeli spyware to track, monitor, and target immigrants and activists
Civil rights attorneys are suing the Trump administration to force the release of records detailing whether federal immigration agencies are using sophisticated Israeli spyware to track, monitor, and target immigrants and activists across the country.
The lawsuit, filed on Oct. 30 in federal court by Just Futures Law and the Center for Constitutional Rights, demands that Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP) comply with Freedom of Information Act requests related to their contracts with tech companies Cellebrite and Paragon Solutions. Both companies have been linked to government surveillance of journalists, human rights defenders, and protesters around the world...

More than 56,000 students walked out across North Carolina last week to oppose sweeping immigration raids, and the protests have continued into this week as youth demonstrate against the growing presence of ICE and Border Patrol in their communities.
The walkouts were sparked after CBP and ICE agents descended on the state’s largest city last week, sweeping up nearly 400 people and driving as much as 20 percent of the student population into hiding while the raids continued.

Know your rights when travel for citizens, green card and visa holders

U.S. citizens and green card holders have the right to refuse to answer questions from the U.S. Customs and Border Protection (CBP) and cannot be denied entry. However, those officers can cause delays for you.

According to the American Civil Liberties Union (ACLU), you are not entitled to an attorney under the first and second inspection by CBP. But you can request one, and it’s a good idea to have an attorney in mind.

Temporary visa holders can be denied entry to the United States for refusing to answer questions at the border.

If you’re a green card holder and immigration officials detain you while reentering the U.S., remember that only an immigration judge can revoke your green card. You have the right to request a hearing, but expect delays due to a backlog in immigration courts. Legal residents should never sign Form I-407, “Record of Abandonment of Lawful Permanent Resident Status.” Robinson said, if you are asked to sign an I-407, say, “No, I want to see a judge.”

Immigration authorities may ask to inspect your phone or laptop and could attempt to log in if you use your face or fingerprint to unlock your device. Consider turning off that feature and using a password. The ACLU has more advice on how you can prepare your devices for travel.

Travel with as little data and as few devices as possible.

Encrypt devices with strong and unique passwords and shut them down when crossing the border.

Know your immigrant rights when stop by police, come to your home

Identify your emergency contacts and memorize their phone numbers.

Provide your child’s school or day care with an emergency contact to pick up your child.

Provide authorization in writing for your emergency contact to make medical and legal decisions for your child.

Tell your loved ones that if you are detained by ICE, they can try to use ICE’s online detainee locator to find you: https://locator.ice.gov/odls/#/search

Stay calm and don’t run, argue, resist, or fight the officer, even if you believe your rights are being violated or you are being treated unfairly.

Don’t lie about your status or provide false documents.

If you are pulled over in a traffic stop: Ask if the officer is from the police department or immigration. Immigration officers often identify themselves as “police,” but they are not police.

If you are a U.S. citizen or have lawful immigration status: Show your passport, legal permanent resident card, work permit, or other documentation of your status. If you are over the age of 18, you should carry your papers with you at all times.

If you are undocumented: You have the right to remain silent and do not have to discuss your immigration or citizenship status with the police, immigration agents, or other officials. Anything you tell an officer can later be used against you in immigration court.

If an officer knocks on your door: Do not open the door. Teach your children not to open the door. Officers must have a warrant signed by a judge to enter your home. ICE
