INAUGURAL JOINT STATEMENT

We, the Representatives from the Governments of Belize, Plurinational State of Bolivia, Republic of Colombia, Republic of Cuba, Republic of Honduras, Malaysia, Republic of Namibia, Republic of Senegal and Republic of South Africa in The Hague, Netherlands, on this 31st day of January 2025, inaugurate The Hague Group,
๐๐ช๐๐๐๐ by the purposes and principles enshrined in the Charter of the United Nations, and the responsibility of all nations to uphold the inalienable rights, including the right to self-determination, that it enshrines for all peoples,
๐๐ง๐๐๐ซ๐๐ฃ๐ the lives, livelihoods, communities, and cultural heritage lost due to Israel, the occupying powerโs genocidal actions in Gaza and the remainder of the Occupied Palestinian Territory against the Palestinian people,
๐๐๐๐ช๐จ๐๐ฃ๐ to remain passive in the face of such international crimes,
๐ฟ๐๐ฉ๐๐ง๐ข๐๐ฃ๐๐ to uphold our obligations to end the Israeli occupation of the State of Palestine and support the realisation of the inalienable right of the Palestinian People to self-determination, including the right to their independent State of Palestine,

the orders of the International Court of Justice in the case of South Africa v. Israel of 29 December 2023, which reflect a serious concern about the perpetration of crimes of genocide in Palestine, and noting the significant and diverse number of States that have joined as third States in the case, to demand the condemnation and immediate cessation of the ongoing genocide,.
the Advisory Opinion of the International Court of Justice of 19 July 2024 on the โLegal Consequences arising from the Policies and Practices of Israel in the Occupied Palestinian Territory, including East Jerusalemโ,
and the Advisory Opinion of the International Court of Justice of 9 July 2004 โโLegal Consequences of the Construction of a Wall in the Occupied Palestinian Territoryโโ
the United Nations General Assembly Resolution A/RES/Es-10/24, adopted on 18 September 2024 at the Tenth Emergency Special Session, which endorsed the ICJโs Advisory Opinion of July 2024, and the commitments of member states to comply with the obligations under international law as reflected in the advisory opinion,
the International Criminal Courtโs issuance on 21 November 2024 of warrants of arrest for indicating โreasonable grounds to believe that Mr Netanyahu and Mr Gallant each bear criminal responsibility as civilian superiors for the war crime of intentionally directing an attack against the civilian population...the war crime of starvation as a method of warfare...and the crimes against humanity of murder, persecution, and other inhumane actsโ.
the order of the International Court of Justice in Nicaragua v. Germany of 30 April 2024 โremind[ing] all States of their international obligations relating to the transfer of arms to parties to an armed conflict, in order to avoid the risk that such arms might be used to violateโ the Genocide Convention and the Geneva Conventions in relation to Israelโs conduct in Gaza and the remainder of the Occupied Palestinian Territory,
the United Nations Security Council Resolution 418 of 4 November 1977, and United Nations Security Council Resolution 591 of 28 November 1986, that โimposed a mandatory arms embargoโ against Apartheid South Africa.

We will take further effective measures to end Israeli occupation of the State of Palestine and remove obstacles to the realisation of the right of the Palestinian people to self-determination, including the right to their independent State of Palestine.
We invite all states to take all possible actions and policies to end Israelโs occupation of the State of Palestine.
We call on all nations to join us in The Hague Group in the solemn commitment to an international order based on the rule of law and international law, which, together with the principles of justice, is essential for peaceful coexistence and cooperation among States.

KUALA LUMPUR: Malaysia has reaffirmed its unwavering support for the Palestinian cause, calling for the full implementation of the Jan 15 ceasefire agreement as a vital step towards lasting peace.
Malaysia's Ambassador to the Netherlands, Datuk Roseli Abdul, expressed hope that the joint statement issued by the newly minted The Hague Group in the Netherlands on Friday would play a decisive role in ensuring justice and upholding the Palestinian people's right to statehood.
Speaking at the formal inauguration of The Hague Group following the joint statement delivered by its nine founding member states, he reaffirmed Malaysia's steadfast commitment to the Palestinian cause.
"After almost 500 days and nearly 50,000 deaths, Palestinians are finally witnessing a reprieve with the long-awaited Gaza ceasefire, though violence persists.
"The systematic destruction of Gaza has left irreparable scars, underscoring the urgent need for action to restore hope and rebuild Palestine.
"Therefore, Malaysia calls for the full implementation of the Jan 15 ceasefire agreement as a critical step towards sustainable peace," Roseli added.
Expounding on Malaysia's position, he stated that its stance on the Palestinian issue is firmly guided by humanitarian principles, the integrity of the United Nations (UN) Charter, and the sanctity of international law.
"Impunity must end, justice must prevail, and the rights, freedom, and dignity of the Palestinian people must be protected," he said.
Malaysia remains committed to supporting legal recourse at the International Court of Justice (ICJ) and urges the international community to uphold its obligations under international law, he added.
According to the ambassador, international law must not be misinterpreted or exploited to justify actions such as the Partition Plan, which imposed injustices by granting the occupier more land than the original inhabitants.
"Rectifying these injustices requires the recognition of Palestinian statehood and the safeguarding of the Palestinian people's right to self-determination.
"Israel's repeated violations of UN resolutions warrant scrutiny, as they contradict the principles of the UN Charter. The imbalance of power, marked by apartheid policies and militarisation, continues to deny Palestinians their right to self-determination," Roseli asserted.
The ambassador called on all parties to work towards solutions that reflect the aspirations of the Palestinian people and align with the collective voice of the UN General Assembly.
"The international community once united against apartheid in South Africa. Now, we must summon the same resolve for Palestine," he added.
Representatives from the governments of Belize, Bolivia, Colombia, Cuba, Honduras, Malaysia, Namibia, Senegal and South Africa convened in The Hague on Friday to formally inaugurate The Hague Group.

Nine countries announced Friday the formation of the "Hague Group" to defend Palestinian rights.
Representatives from South Africa, Malaysia, Namibia, Colombia, Bolivia, Chile, Senegal, Honduras and Belize gathered in The Hague in a meeting hosted by Progressive International, an international political organization, to coordinate legal, diplomatic and economic measures against Israelโs violations of international law.
Following the discussions, the nine countries announced the formation of the Hague Group which it said was "born of necessity."
The group said it is grieving the lives, livelihoods, communities and cultural heritage lost due to Israelโs genocidal actions in the Gaza Strip and the remainder of the Occupied Palestinian Territory against the Palestinian people.
It noted that it was refusing to "remain passive" in the face of such international crimes.
The group said it was "determined to uphold our obligations to end the Israeli occupation of the State of Palestine and support the realisation of the inalienable right of the Palestinian People to self-determination, including the right to their independent State of Palestine."
A statement declared the intention of the group to support the requests of the International Criminal Court and, in the case of state parties, comply with our obligations under the Rome Statute, with regard to the arrest warrants for Israeli officials and implement provisional measures of the ICJ.

It also pointed out its wish to prevent the provision or transfer of arms, munitions and related equipment to Israel, in all cases where there is a clear risk that such arms and related items might be used to commit or facilitate violations of humanitarian law, international human rights law, or the prohibition on genocide.
The statement expressed the groupโs intention to prevent the docking of vessels at any port, if applicable, within their territorial jurisdiction, in all cases where there is a clear risk of the vessel being used to carry military fuel and weaponry to Israel.
"We will take further effective measures to end Israeli occupation of the State of Palestine and remove obstacles to the realisation of the right of the Palestinian people to self-determination, including the right to their independent State of Palestine," added the statement.
In December 2023, South Africa instituted proceedings against Israel, claiming violations of the Genocide Convention in relation to Palestinians in Gaza. Several countries have since joined the case, including Nicaragua, Colombia, Cuba, Libya, Mexico, Palestine, Spain, and Tรผrkiye.
Israelโs genocidal war has killed more than 47,400 Palestinians, most of them women and children, and injured more than 111,000 since Oct. 7, 2023.
The Israeli onslaught on Gaza has left more than 11,000 people missing, with widespread destruction and a humanitarian crisis that has claimed the lives of many elderly people and children in one of the worst-ever global humanitarian disasters.
The International Criminal Court issued arrest warrants in November for Israeli Prime Minister Benjamin Netanyahu and his former Defense Minister Yoav Gallant for war crimes and crimes against humanity in Gaza.
