Alameda landlord Don Lindsey has a restricted brokers real estate license

Don Lindsey was a founding member of Alamedans for Fair Rents, an Alameda organization of landlords fiercely opposed to rent control. Considering that Lindsey presently has a restricted brokers real estate license as a result of his alleged unlawful activities, it is not surprising that he does not want renters to have any rights!

According to the California Bureau of Real Estate, Alameda landlord Don Lindsey presently has a restricted brokers real estate license.

Landlord Don Lindsey, who was known as one of the most powerful landlords in Alameda, and was called the “landlord-in-chief” by the members of the Alameda Renters Coalition, has been levied a number of fines recently, and had his brokers real estate license restricted by the California Bureau of Real Estate, for a number of alleged financial improprieties.

A complaint by Robin Tanner, a Supervising Special Investigator of the State of California, against Donald Walter Lindsey, Lindsey Properties, Inc, dba Gallagher & Lindsey Property Management LLC, has resulted in the brokers license of Don Lindsey being restricted.

Additionally, as part of a settlement agreement (stipulation), Don Lindsey may have been charged for three different audits, totaling $9,813 for one of the audits, $12,267 for a second audit, and $5,145 for a third audit. Lindsey had 60 days to pay off each of the three settlement agreements after receiving an invoice from the Commissioner, or he would have had his brokers license suspended.

As part of the settlement agreement, within 6 months of the effective date of this decision, Lindsey must take and pass the Professional Responsibility Examination by the Bureau of Real Estate, and pay the examination fee, or his license would be suspended. Lindsey also had to take an education course on trust fund accounting.

According to public records, Don Lindsey agreed to the above settlement agreements, as part of an effort to save his brokers license from being suspended.

Allegedly, the firm co-founded by Lindsey known as the Gallagher & Lindsey Property Management, failed to deposit $2,124 into a trust fund after collecting the money from three prospective tenants, as was required by law. Additionally, the Bureau of Real Estate did an audit of Lindsey Properties that revealed $72,465 was missing from an account that was supposed to have “property management fees” in it Lindsey was charging the renters, in addition to some other improper actions of Lindsey's firms.
