Alameda landlord Donald W. Lindsey may lose real estate license

Alameda landlord Donald W. Lindsey may lose real estate license

As recent as January 5, Alameda landlord, Donald W. Lindsey, of Lindsey Properties, Inc., dba Gallagher & Lindsey Property Management LLC, joined landlord lobbyist Gregg McConnell of 696 Blue Spruce Dr., in Danville, at the Alameda City Council meeting with around 37 other landlords to speak out against renter protections, including rent control and just cause eviction protections, for the renters of Alameda.

In opposition to Donald W. Lindsey, and the other landlords, were renters, activists from the Alameda Renters Coalition, including many High School students who appeared at the January 5, City Council meeting, to speak up in support of rent control, and just cause eviction protections.

While landlord Donald W. Lindsey stood at the podium to speak out against renter protections for the tenants of Alameda, as he tried to convince the council members and the audience that he was some kind of big shot landlord, Lindsey totally failed to mention that as recent as December 16, 2015, Supervising Special Investigator of the State of California, Robin Tanner, filed a complaint against him with the Bureau of Real Estate. Robin Tanner, accused him of numerous counts of wrong doing, and Lindsey may lose his real estate license as a result of the accusations being made against him.

The question that people should be asking? Should Donald W. Lindsey be standing up before the City Council of Alameda to demand that the renters should not have renter protections, including just cause eviction protections, and rent control, while he is at risk of losing his real stated license because he faces charges for collecting advance fees from prospective tenants, while failing to place the money into a bank account?

The landlords were mean spirited on January 5, at the Alameda City Council meeting, with some of them portraying the renters as criminals who do not need renter protections. Other landlords spoke out against any renters who resided out side of Alameda, if they dared to speak up on behalf of renter protections in Alameda.

Meanwhile, the same landlords gave Gregg McConnell from the City of Danville, a big hand of applause when McConnell appeared at the council meeting to speak out against any renter protections for the renters of Alameda. They also gave much applause when Don Lindsey spoke out against renter protections for the renters of Alameda, even though Lindsey faces charges that were filed against him with the Bureau of Real Estate.

The charges filed in the complaint against Donald W. Lindsey are based on an audit between December 4, 2014 and December 23, 2014, in regards to their records in connection with a number of activities.

Allegedly, Donald Lindsey (Lindsey Properties, Inc., dba Gallagher & Lindsey Property Management LLC) collected advance fees of $1,020.00 from the prospective tenants known as Erhan T., and Tevi S., including $675.00 from Michael and Kyndra L., and $429.00 from Peter E., and Chelsea R., and failed to deposit said advance fees into a trust account with a bank or other recognized depository. And Lindsey and company allegedly failed to provide a quarterly accounting of said advance fees to the same prospective tenants mentioned above.

Among the additional charges filed in the complaint against Donald w. Lindsey (Lindsey Properties, Inc., dba Gallagher & Lindsey Property Management LLC), is that they allegedly caused, suffered or permitted the balance of funds in Bank Account #1 to be reduced to amounts, which as of October 31, 2014, were approximately $72,465.52, less than the aggregate liability of LPI to all owners of such funds, without the prior written consent of the owners of such funds.

And that they allegedly failed to place the trust funds entrusted to the respondent into the hands of a principal on whose behalf the funds were received, into a neutral escrow depository, or into a trust fund account in the name of respondents as trustees at a bank or other financial institution for Bank Account #1.

Additionally, it is alleged that they failed to disclose their license identification numbers on their website http://www.gallagherandlindsey.com, and that they authorized Suzanne L. and Ayn G., who are unlicensed persons without fidelity bond coverage, to make withdrawals from a bank account.

The charges allegedly are serious enough grounds for the suspension or revocation of the licenses and license rights of Donald W. Lindsey, Lindsey Properties, Inc., dba Gallagher & Lindsey Property Management LLC, under several provisions of the Code and Regulations.
