Sheriff Mirkarimi Exposes Democratic Party’s 1999 & 2003 Election Fraud in Opening Brief

On May 7, 2012, Sheriff Mirkarimi filed an outstanding Opening Brief with the San Francisco Ethics Commission which provides among many other things, in Exhibit 1, documents verifying the San Francisco Democratic Party’s election fraud in the 1999 mayor’s race when Democrat Willie Brown perpetrated election fraud against the actual victor, Democrat Tom Ammiano, and the 2003 mayor’s race when Democrat Gavin Newsom, now the California Lieutenant Governor, perpetrated election fraud against the actual victor, then Green Party President of the Board of Supervisors, Matt Gonzalez, with the use of the San Francisco League of Urban Gardeners (SLUG), under the leadership of Dept of Public Workers Director, Mohammed Nuru.

The brief is 15 pages and most of the rest of the 110 pages are the exhibits. Exhibit 1 is the SLUG election fraud data and Exhibit 2 is the City Attorney Memo on Investigation of City Payment to Rippey-Tourk. Ms. Ruby Rippey-Tourk was the secretary of then Democratic mayor of San Francisco, Gavin Newsom, who raped her in the mayor’s office, a clear crime and violation of all sexual harassment laws as she was a city employee. She also was the wife of his best friend. The Ethics Commission did nothing about this. They also apparently did nothing about city payments to her and did nothing when she declined to be interviewed by the city attorney. As Sheriff Mirkarimi’s brief states on page 5:

“However, as here, in both the Nuru and Rippey-Tourk cases, the subjects under investigation declined to be interviewed by the City Attorney. They were not subpoenaed. They were not hounded by City Attorney investigators. Additional charges were not threatened. Rather, Mr. Nuru eventually received a promotion (by Mayor Lee, uncoincidentally) for his trouble and Ms. Tourk received a significant sum of city funds for hers. This double standard highlights the troubling, and transparently political, nature of this case.”

“What do we know to be true? The Sheriff—a known political opponent of the Mayor and District Attorney—was elected by the People of the City and County of San Francisco. Before assuming office, the Sheriff committed a misdemeanor. The Ninth Circuit has determined that said misdemeanor is not a crime of moral turpitude. After the Sheriff was sentenced for said misdemeanor, the District Attorney asserted justice had been served. The Mayor immediately suspended the Sheriff vis-a-vis flimsy, flawed and fallacious charges.”

“The City Attorney began investigating the Sheriff with a vehemence unmatched in recent memory and in complete disproportion to any other City Attorney investigation.”

At the top of page 5, Sheriff Mirkarimi’s brief describes the vicious treatment to him done by the City Attorney, Democrat Dennis Herrera, at the behest of election fraud Democratic mayor Ed Lee:

“Moreover, the City Attorney has threatened to add another charge against Sheriff Mirkarimi because the Sheriff has not assisted with the City Attorney’s dual-track, renegade investigation. The City Attorney has subpoenaed the Sheriff’s phone records, demanded he show up and give a recorded statement, seized and searched his work computer against his objections, and demanded documents, asserting no other authority than the Mayor’s prerogative.”

The brief refers to other cases which were NOT considered official misconduct and the publicly elected officials were NOT removed from office:

“In 1977, Sheriff Richard Hongisto willfully defied a lawful court order to evict tenants from a building [the International Hotel] and served a five-day jail sentence for criminal contempt.” (p. 3) (George Moscone was the mayor at that time).

“In 1995, Terence Hallinan was elected District Attorney of San Francisco. Despite Hallinan’s history of arrests and convictions for physical assaults during his youth, see Hallinan v. Committee of State Bar Examiners (1966) 65 Cal.2d 447,
the Mayors in office during Mr. Hallinan’s tenure as District Attorney did not seek to remove him for official misconduct." (p. 4) (Hallinan was represented by Ben Dreyfus of Garry, Dreyfus & McTernan. See http://law.justia.com/cases/california/cal2d/65/447.html).

Sheriff Mirkarimi complains, justly, on page 4:

“The Mayor and City Attorney want to have it both ways: On the one hand, they assert the Commission has jurisdiction over the allegations, while on the other hand, they assert that only the Superior Court has jurisdiction over the investigation of those same allegations. In effect, the Mayor asserts that the Commission can weigh the validity of the allegations, but not the integrity of the investigation. The Mayor and City attorney thus assert carte blanche authority to use the power of their offices to interrogate anyone on any basis, and search and seize any property on any basis. Meanwhile, Sheriff Mirkarimi has no similar means of discovery. The investigatory scheme asserted by the Mayor and City Attorney—whereby they have absolute discovery rights but the Sheriff has none—could not be more in violation of fundamental due process.”

Due process is guaranteed in the US Constitution in the Fifth and Fourteenth Amendments.

On page 15, Sheriff Mirkarimi demands:

The Commission should dismiss the Mayor’s charges because: (1) the charges are transparently political; (2) the charges are grossly inconsistent with past practices, (3) the charges have already been adjudicated; and (4) the Mayor fails to allege a violation of a law under the Commission’s jurisdiction.” The brief ends with the demand that “the Mayor’s charges against Sheriff Ross Mirkarimi MUST FAIL because the evidence will show that the conduct at issue does not rise to the level of official misconduct under the law.”

Be sure to read the dedication at the beginning to Dolores Evans, a poll worker, and 5 children, babies in diapers to age 8 or so, murdered in their Housing Authority home in a mysterious fire which the fire inspector said they could have escaped but someone stopped them, on December 13, 1997, just as Evans was about to testify as to the election fraud she witnessed in the June 3, 1997 election in the election fraud lawsuit filed December 3, 1997.

It raises the serious issue of cost of this whole circus to the taxpayers, as follows:

“At the outset, it must be noted that the Mayor has proposed 25 witnesses, eight of whom are purported experts. At this rate, the Mayor may have to put a bond on the ballot just to finance the prosecution of this misdemeanor case. Countless murders have received less attention and resources than what is being poured into the Mayor’s political attack on the Sheriff. It is shocking that the Mayor would use city funds to pay eight separate “experts” to address whether a low-level offense which is not even a crime of moral turpitude is official misconduct.”

“The Mayor’s proposed witness lists suggest the Mayor has every intention of dragging this case out as long as possible and essentially turning the whole ordeal into a circus.”

Expert witnesses can each charge $5,000 or more for a serious hearing or trial. Attorney’s time is worth $500 per hour and we taxpayers are paying for probably 4 city attorneys as we can assume that the elected City Attorney Herrera is involved in this case. We are also paying for the City Attorney’s investigators and all of the clerical staff at the City Attorney’s office who are working on this case. Yet, the City claims to have budget problems. More likely, it has priority problems. And it has election fraud problems which neither the City Attorney nor the Cuban gusano, anti-Communist Republican turned Democrat District Attorney Gascon have bothered to investigate or stop.

The 50 or so speakers were all except 3, in support of Sheriff Mirkarimi, and most were African-American. In a city were 6% of the population is African-American, it is said that 50% of the County jail inmates are African American, a sign of serious racism in this city. The speeches of the supporters of Sheriff Mirkarimi were eloquent and precise in addressing all the issues and are all worth listening to. They each speak for 2 minutes. There was also one speaker who is Iranian-American who highlighted the racism of Mayor Lee against Iranians in suspending the Sheriff without pay on the Persian New Year, March 20, 2012, a date easy to remember, as it coincides with the beginning of spring in the northern hemisphere. He correctly pointed out that such a vicious, illegal act would never have been done on the lunar new year to an Asian American. Sheriff Mirkarimi is the son of an Iranian Moslem father and a Russian Jewish mother. Sheriff Mirkarimi, as supervisor, opposed then police chief Gascon’s attempt to connect Iranian-Americans and all other Middle Eastern Americans to terrorism.

Then there is the case of City Dennis Herrera’s racism, stupidity, insanity or whatever you want to call it. Dennis Herrera ran for mayor in November 2011 and sent an expensive slick mailer to the voters with a Christmas tree on it, along with a bizarre message that he knows how to fight. A mayor is supposed to be a peacemaker so this combative message was totally inappropriate. The Christian Christmas tree has no place on any campaign piece for any secular office as it offends atheists, Jews, Moslems, and all other non-Christian religions and violates the Church-State separation mandate of the First Amendment which Herrera, as City Attorney and as an attorney admitted to the State Bar of California, has sworn to uphold.

These horrors being perpetrated by the San Francisco Democratic Party so as to continue to have an election fraud machine that will protect the real estate interests who want the foreclosures and evictions so as to maximize their profits, have been called an abomination by the San Francisco Bay Guardian. If the Democratic Party and its reactionary City Attorney, Dennis Herrera continue with this frame-up of Sheriff Mirkarimi, they will hasten the demise of the rotten twin of the Republican Party, the Democratic Party, both of which need to be cast into the dustbin of history. However, our lives are at stake and election fraud is fascism, which must be stopped. It will not be stopped by promoting expensive, futile campaigns such as the recall of election fraud Mayor Ed Lee. It can be stopped if the overwhelming majority of the 856,000 people of San Francisco call all 11 members of the Board of Supervisors and demand they vote to retain Sheriff Mirkarimi. All the Ethics Commission does is make a recommendation; it is the Board of Supervisors which can and must end this outrage which is a form of election fraud as Sheriff Mirkarimi was duly elected with 70,000 votes. A little lesson from history might help: The decision guaranteeing women a right to a safe and legal abortion, Roe v Wade, was made by the Supreme Court under viciously reactionary Republican President Nixon in 1973. The majority opinion was written by Justice Blackmun, a Nixon appointee, while a Democratic Kennedy appointee, Justice White, dissented. The lesson is that it is mass movements that make the difference.

As you can see from reading the 2 City Attorney Memos on SLUG's election fraud, both dated May 10, 2004, SLUG was part of the 49er Stadium Swindle Election Fraud Team too. See p. 16 of the first 5/10/04 memo. They were not alone. Accompanying them were Housing Authority, Walden House, Cecil Williams and Glide Church, Nation of Islam, Amos Brown and Third Baptist Church, the labor lieutenants of capitalism who endorsed the 49er Stadium Swindle, the San Francisco Police Department that covered up the election fraud, the San Francisco Chronicle, the Democratic and Republican Central Committees and the San Francisco Chamber of Commerce. Only Peace & Freedom Party and the Green Party opposed the 49er Stadium Swindle. It was opposed by 70% of San Francisco voters; this election fraud team changed the vote to 50.1% "yes" and they murdered a poll worker and 5 children to prevent the election fraud lawsuit from fully exposing their evil deeds. They did however, leave a trail of evidence cited in the election fraud website above.

Sadly, however factual Mirkarimi's opening brief is, it will fall on deaf ears and blind eyes when it comes to the Ethics Commission. Newsom lackey/appointee Director John St. Croix will steer this case to the B.O.S. with a recommendation for permanent removal from office.

The B.O.S., with 4 spineless "progressives" up for re-election in November, will vote overwhelmingly to remove their former "colleague" from office in order to save their own hide at the ballot box.

The best legal and political advice to Mirkarimi at this time: Push a R.I.C.O. action at the federal level and nail the machine there.

This self-proclaimed "rebel" is utterly reactionary. He proposes yet another expensive lawsuit while Sheriff Mirkarimi HAS NO MONEY TO FEED HIS FAMILY, MUCH LESS PAY LAWYERS. This latest stupid drivel replaces his last expensive stupidity: Paying for a recall of the election frauding mayor. THIS IS CALLED NOT DOING YOUR HOMEWORK. First, let us repeat the lesson of history this phony rebel failed to comprehend:

This writer easily remembers Roe v Wade, the civil rights and peace movements of the 1960s and 1970s and much more. We faced the police state horror of the anti-Communist witchhunts and strident anti-Communism until we lost the socialist world in 1991, and in doing so, mighty US imperialism finally got the defeat it was looking for on April 30, 1975, the happiest day in my generation's life. People had to change their name to find a job as they were "accused" of being members of the Communist Party, a legal organization. The FBI hounded people everywhere on the job and at their homes. We stopped nuclear weapons and nuclear power plants proliferation in the US (with more work needed to be done, of course), started or restarted the women's and gay liberation movements so that today abortion and birth control are legal, we have no fault divorce instead of the ugly divorce trials, abolished legal segregation, gay relations are legal by a Supreme Court decision, gay marriage is legal in some states and Washington, D.C., black people are in advertising on TV and elsewhere and much more. The civil rights movement is a good example. In the South, people faced vicious police dogs and high powered fire hoses spraying water on them, as well as inhumane conditions in jail, and death. The 1963 March on Washington where Martin Luther King gave his famous I Have A Dream speech was surrounded by sharpshooters, with guns pointed at the 100,000 demonstrators. Equal rights for blacks was considered ludicrous then by most people. Previous generations to mine remember seeing blacks refused service at restaurants IN SAN FRANCISCO after the fight against fascism, WW2. Blacks were routinely discriminated against not only in housing, education and jobs, but also in such snooty organizations as the lawyer's organizations know as Bar Associations. WE LEARNED FROM THESE STRUGGLES THAT THE BIGGEST BULLY IS THE BIGGEST COWARD AND ALL YOU HAVE TO DO IS STAND UP TO THE BULLY. That was the lesson of the Rosenberg-Sobell case, 3 people framed by DEMOCRAT TRUMAN in 1950 on the phony charge of conspiracy to commit atomic espionage. As Julius Rosenberg stated, IT WAS AN EFFORT DURING THE ANTI-COMMUNIST KOREAN WAR, THE SAME AS THE ANTI-COMMUNIST VIETNAM WAR, TO MAKE JEW, COMMUNIST AND TRAITOR SYNONYMOUS. For refusing to cooperate with a lie, Julius and Ethel Rosenberg were murdered by the US government on June 19, 1953, and in defending their innocence saved their children's lives and all the rest of our lives as they literally broke the back of the Cold War. NOBODY IS ASKING YOU TO DO THIS; JUST MAKE THE PHONE CALLS TO THE BOARD OF SUPERVISORS TODAY.

RIGHT HERE IN SAN FRANCISCO, in 1960, when the anti-communist witchhunters House Committee on Un-American Activities (HUAC) showed up at City Hall, the Saturday after the weekday when protestors demanding to be let into this congressional hearing as was their right were sprayed with water from high pressure fire hoses INSIDE CITY HALL and literally thrown down the marble stairs of the City Hall Rotunda, leaving bloodstains there for years, we surrounded City Hall with a DOUBLE PICKETLINE SOLIDLY AROUND THE 4 BLOCKS OF CITY HALL, one line going clockwise and one counter-clockwise. Among us kids, this was a great time to play "choo-choo" as we were so close we could easily put our hand on the next person's shoulder. This was, of course, a labor picketline, thanks to the longshore workers, ILWU, and other unions, as well as the survivors of the anti-Communist witchhunts. HUAC NEVER RETURNED TO SAN FRANCISCO. That was the power of mass struggle.

We did all of this with MASS MOVEMENTS. There are 3 supervisors who voted NO on Fascist Weiner's anti-building preservation proposal last week: John Avalos, Davis Campos and Eric Mar. Whatever election is pending for them, THEY ARE RUNNING AS INCUMBENTS. They can certainly be reached. Christine Olague, now representing District 5, Mirkarimi's very progressive district, will have to be told to straighten out and support Mirkarimi or she will face serious opposition. IT IS IRRELEVANT WHAT THEIR CURRENT ELECTION STATUS IS. THEY ARE ALL SUBJECT TO MASS PRESSURE. We have gotten Republicans to stop attacking Social Security in the US Congress because their constituents screamed bloody murder. If we can do that, we can certainly get 3 members of the San Francisco Board of Supervisors to RETAIN ROSS MIRKARIMI AND RESTORE HIS PAY AND BACK PAY IMMEDIATELY.

As to the Ethics Commision, they are all lawyers or something similar. Four of the 5 are lawyers, the fifth is in a similar occupation. See

Their careers depend on keeping a low profile as all this Ethics Commission does is make a recommendation. THEY DO NOT NEED A LONG, SALACIOUS CRIMINAL TRIAL SCENE, which is what the Democratic City Attorney, Dennis Herrera, is promoting, all courtesy our tax dollars.

Currently, on the Board of Supervisors' website is a long description of Ross Mirkarimi's career, a good sign that the Board of Supervisors is not happy about removing a duly elected official over a domestic dispute. After all, marriage is endless arguments and almost all of them could be removed from office over domestic disputes if this election frauding suspension is allowed to stand. Ross Mirkarimi (pronounced Meehr-kah-reem-e), was elected San Francisco District 5 Supervisor in 2004, and reelected in 2008.

•Reentry for Ex-Offenders: Formation of the Safe Communities Reentry Council to help reintegrate the formerly incarcerated -- recognizing the reentry process as a critical opportunity to break the cycle of crime and violence and reduce California’s worst-in-the-nation recidivism rate.
•Police Foot Patrols: Required the San Francisco Police Department to institutionalize community policing practices such as foot patrols.
•Workforce Reform: Overhaul of the City's workforce training and placement programs to expand the scope of the First Source Hiring Program and establish private sector incentives to employ residents from disadvantaged communities and those who served time in prison or county jail.
•Tenant Protection: Successful ballot measure (Prop H, 2007) to increase relocation assistance payments to tenants who are evicted through no fault of their own, including increased payments for seniors, children, and the disabled.
•Chain Store Restrictions: Neighborhood-backed legislation to restrict chain stores while protecting small business and neighborhood integrity.
Ross was born in Chicago to an Iranian father and mother of Russian descent.

Ross spent most of his youth in Rhode Island, obtained his undergraduate degree from St. Louis University (Political Science and Russian Literature), and earned Master’s degrees from Golden Gate University (Economics) and the University of San Francisco (Environmental Science/Management). He is also a graduate of the San Francisco Police Academy, where he was class president.

Prior to being elected Supervisor, Ross served as an investigator with the San Francisco District Attorney's Office for almost nine years, specializing in economic and environmental crimes.

Community organizing and activism have always been a significant part of Ross's life, as student body president of St. Louis University, president of the Missouri Public Interest Research Group (MOPIRG), and co-founder of the California Green Party.

Calling each member of the B.O.S. and lobbying for their support on behalf of their targeted "colleague" Mirkarimi is a waste of time. Do your own math and homework, readers: 2012 is an election year. Each and every very campaign manager is advising their client to "Dump Ross" if they want to stand any chance of being re-elected in November.

What "Keeping Score" also doesn't tell you is that the B.O.S. deck is politically-stacked against poor ol' Ross: 5 so-called "progressives", 4 of whom are up for *re-election (*Avalos, *Campos, Kim, *Mar, *Olague) will flip their allegiance and join hands with 6 pro business,right-of-center reactionaries (D. Chiu, C. Chu, M. Cohen, S. Elsbernd, M. Farrell, S. Weiner) and vote to permanently oust the duly-elected Sheriff. That's just politics. It's called SURVIVAL.

If Mirkarimi can't generate enough of a groundswell of support, both politically and financially, to initiate a "Recall Ed Lee" drive, file a R.I.C.O. lawsuit against various corrupt local S.F. officials, or even persuade the S.F. Civil Grand Jury to independently investigate the matter, then he stands little-to-no chance of getting this lynch mob off his back.
