“Oops, sorry for the election fraud!”

Last week, Pacifica executive director Arlene Engelhardt sent out a mass email that apologized for Pacifica’s attempt to throw out the ballots of three staff members, which would have cost SaveKPFA supporter Lewis Sawyer his seat on KPFA’s local board. A judge’s injunction reversed Pacifica’s actions in December.

Pacifica had decided whose ballots to throw out only after the ballots had already been tallied. “It was a clear violation of state law for us to deprive members of their right to vote without notice, let alone due process,” wrote Engelhardt. “It is still more egregious to breach the secrecy of the ballot to do so.”

As part of a settlement, the KPFA staff members who took Pacifica to court traded away their right to pursue legal fees for a promise from Pacifica that it will guarantee the secrecy of the ballot in future elections.

The decision to take away the ballots was a horrible mistake made by the National Election Supervisor, NES. The NES, according to the Bylaws, functions outside of Pacifica management. Arlene Engelhardt was not involved in that decision. Three staff members improperly used air time to influence the election and the NES canceled their votes as a penalty without giving them a due process hearing. Totally improper. An appropriate penalty would have been to redo the staff election since one seat was decided by one vote. This was not election fraud, but a bungling attempt to correct a wrong with another wrong.

Here is an example of conscious election fraud.

During the 2007 election the CL/KPFA Management Group allies ran all 22 candidate oral statements, carts, on the air one after the other, with Concerned Listener (CL) candidate Sherry Gendelman’s ALWAYS FIRST! The quote below is from Casey Peters’ National Election Supervisor (NES) report for the 2007 election. Lemlem Rijio and Sasha Lilley were members of the CL/KPFA Management Group.


“An unexpected problem arose at KPFA where candidate carts were bundled in large groups playing for several minutes at a time. This was done rather than the traditional broadcast of carts individually, dispersed among other sorts of programming. Some candidates contended that the bundles always started with management’s favored candidate and that listeners tuned out after the first couple of carts were aired. I spoke with KPFA’s Interim General Manager Lemlem Rijio and Interim Program Director Sasha Lilley, and both agreed to de-bundle the carts and to broadcast them individually as other stations do. However, in practice they refused to conform to a direct order from the National Election Supervisor. The bundling continued, putting some candidates at a distinct disadvantage. The one candidate whose cart aired first in the bundle garnered the most first place votes by far in the KPFA Listener Sponsor vote count.”


Imagine how much name recognition Sherry Gendelman received versus the candidate that was 5th, 10th or 22nd? Who but a die hard very few would be paying attention past the first few statements. The prior practice was to run three together and rotate their position to keep it fair.

There are many more examples from past elections were SaveKPFA/CL KPFA staff allies tilted the election in their favor by various manipulations and misuse of authority. Where was "JUst Watching" when this and the others were taking place?
