San Diego County Toyota Of Poway Injured Workers Petition For Justice

Tim Hack and other injured workers from Toyota of Poway are demanding justice. They were contaminated by mold at the dealership and the effort by the owners and insurance crooks Covel to cover-up this criminal workers compensation fraud. They are calling on the San Diego District Attorney Bonnie Dumanis to prosecute. The dealer owners Vincent Castro and Troy Duhon have also filed restraining orders against injured worker Tim Hack.

Injured Toyota Poway Tim Hack Speaks At California Fraud Assessment Commission FAC On 11/16/2010

I Stand before you today as one of the many injured workers in the State of California That have been denied Basic health care for injuries that have occurred on the job. I stand before you to tell you loud and clear the system is broken for the very people it is designed to protect. I never set out to become a voice for the injured worker in California, I guess the cause needed my voice.

The workers comp Insurance companies continue to ask for more more more and give less less less. The declining number of Doctors in the workers comp system are beholden to the insurance companies and the treatment guidelines handed down from ACOEM, a medical group that gets its marching orders from the affiliates of the Chamber of Commerce. The Company Doctor is not far off from the Company store.

The past two years for my self, family and coworkers as well as their families have been a living hell. We did not ask to be placed in a building that from September 2006 until January 2009 had no heat or air conditioning and had several prior mold remediations as the prior owners finally just shut it down rather then fix it. Myself as well as coworkers spent the first three months with space heaters and no fresh air supply, until a customer finally fixed the gas leak in the building. We were unaware that fumes and numerous types of molds such as Stachybotrys we inhaled and ingested daily would effect our physical health and cognitive function long after we were no longer even in the building. We were unaware that the Toxic soup we spent hours in would adhere to our clothes, and be brought home to the ones we love the most. They all clearly spell out the true hazards of our working environment that no one informed us was a hazard.


We were told by our employer just open the door, if you want to see real mold you should go to New Orleans, if the building was the problem, everyone would be sick. We were unaware that as early as November 2008 a fellow employee was having Nerological reactions to the dealerships mold and being driven to her Doctors appointments by dealership employees.

The Owners of Toyota of Poway and their workers comp insurer, Corvel, gambled with employee health. While we lost much including our future ability to make a living to support our families; the reward for the dealership has been three million dollars of taxpayor money for a new building. The reward for corvel has been record profits as the system they have help to set up produces nothing but profits. When I spoke out about this at a public meeting in Poway, as is my right as an American citizen, I was quiclky issued a restraining order for asking Vincent Castro what he planed to do for his injured workers? I ask that all District attorneys take a close look at this practice of silencing injured workers and their proponents.


The fact that Corvel in my case has not offered any medical treatment to the injured workers of toyota of poway is a clear example of cost shifting in the state of california to the taxpayers. Should employees be told they can not receive any medication for their pain or infections until a report was done on their building. Should employees have to seek out and pay for their own medical treatments, even after Corvel sends an Industrial Hygienist to the building and reports back that high levels of molds were found in the building. Should it take nine months of suffering by an employee, before a Workers compensation QME Doctor properly evaluates and diagnoses an employee with 90% blockage in sinus cavities as a result of industrial exposure??

What do you call it when the owners Attorney hires a company that sponsors and works hand in hand with the workers compensation insurance companies to cast doubt. What do you call it when their inspector only reports on areas of the 2500 square foot building known not to be problematic and not inspect areas of the building which were scheduled for remediation One must ask how was it scheduled for repair if it had never been inspected; and then that report is used to inform employees that the building is in normal condition??? The report is then quoted by the Workers Compensation Doctors as well, I call that fraud and reckless disregard for employee health and safety.

What do you call it when you are fired for not taking FUNDS from The Family Medical Leave Act program for injuries that happened on the job. I call that Fraud!!! What kind of message is sent to other employees when their manager is fired for blowing the whistle and exposing the truth. I call that Fraud, Retaliation and instilling fear of retribution for anyone who would dare speak out of the systemic insurer fraud in the CA workers comp system in the future.

The workers Of Toyota of Poway did not stand a chance if not for my voice and the help of others in exposing the Systematic concealment of the harmful working conditions we were exposed to.

For example, in a study performed within 21 offices from four buildings, the odds ratio for respiratory symptoms was 1.87, indicating moderately less than an 87% increase in symptoms where mold levels in chair dust were elevated [38]. Another study performed in a twenty-story water-damaged office building, reported an odds ratio of 1.7 for lower respiratory symptoms, indicating moderately less than a 70% increase in symptoms, when comparing subjects with the highest versus lowest concentrations of mold in floor dust [39]. In both cases the increases in symptoms were statistically significant. In the majority of the studies, the risk of at least one health effect increased more than 100%, indicating more than a doubling of risk. There were no statistically significant inverse findings of improved health with dampness or mold. The health outcomes found to increase with dampness and mold, (e.g. lower respiratory symptoms typical of asthma, mucous membrane symptoms, headache, and fatigue) are the same as those found to be associated with dampness and mold in housing.

healthful workplace for their employees. OSHA's
role is to assure the safety and health of America's
workers by setting and enforcing standards; providing
training, outreach and education; establishing
partnerships; and encouraging continual improvement

Extensive moisture damage and mold throughout the building. Moisture and mold damage is
too extensive not to consider full remodeling with full replacement of all ceiling tiles. All
debris and storage should be removed and discarded. Due to the possibility of concealed
mold and the likelihood of dispersed mold spores, it is recommended that all drywall be
removed and wall studs cleaned as needed. Concrete block walls should be cleaned.
Concrete slab should be completely exposed, carpeting & tile removed & discarded. The
concrete slab should be scrubbed cleaned and thoroughly dried (until acceptable moisture
content is reached). All plumbing pipes should be checked for corrosion & leaks and
repaired as needed. Bathrooms need to be completely gutted. The HVAC system(s) should
be sanitized. The roof should be thoroughly removed and replaced and made adequately
sloped for drainage.

San Diego District Attorney Bonnie Dumanis is still refusing to prosecute the owners of Toyota of Poway Vincent Castro and Troy Duhon and insurance company Corvel for workers compensation fraud. They are trying to shift the healthcare costs to the State and Federal government but apparently DA Dumanis answers to the insurance industry and car dealers rather than injured workers.
