BAVC Charged With Willful Violation of Sunshine Ordinance-Refuses To Provide Documents
The San Francisco Sunshine Ordinance Task Force Complinance and Amendments Committee has ruled
that the private non-profit operator Bay Area Video Coalition is in willful violation of the Sunshine
Ordinance for rufusing to turn over documents between itself and the city of San Francisco about it's
operations. Apparently BAVC does not believe that it has to comply with public information laws
although they get hundreds of thousands of dollars from the City and County of San Francisco

on August 10, 2010 unanimously voted to turn over the Sunshine Ordinance willful violation by the
Bay Area Video Coalition BAVC to the San Francisco Ethics Commission for action on their continuing
violation of the Sunshine Ordinance. The Sunshine Ordinance Rules require from BAVC and all contractors
with the City and County Of San Francisco that do more than $200,000 of business with the City and County
of San Francisco to provide documents and correspondence directly to the public if requested. This ruling of
a willful violation of the Sunshine Ordinance potentially puts the contract by BAVC to run San Francisco two
community access channels in jeopardy. They also previously gave false testimony to the San Francisco Rules
Committee concerning a complaint against them for refusing to turn over documents. They apparently do not
believe they do not have to comply with regulations requiring public information rights although they are getting
hundreds of thousands of dollars from the City and County of San Francisco.

SUNSHINE COMPLIANCE POLICY
Bay Area Video Coalition ("BAVC") is a community based nonprofit organization contracted by the City and County of San Francisco to manage San Francisco's public access television stations (the "SF Commons Grant"). Pursuant to the terms of the SF Commons Grant and the provisions of San Francisco Administrative Code Section 12L.4 and 12L.5, BAVC makes certain information available to the public and invites the public to attend and participate in public meetings of the BAVC Board of Directors.
This Sunshine Compliance Policy sets forth the categories of information BAVC makes available to the public and how members of the public may request that information. The policy also explains public meetings of the BAVC Board of Directors, as well as how members of the public may access and participate in those public meetings.
BAVC BOARD PUBLIC MEETINGS
The BAVC Board of Directors (the "BAVC Board") holds periodic and scheduled meetings in connection with its responsibility to oversee all BAVC operations. The BAVC Board conducts meetings in person, over the telephone and online. Twice a year, the BAVC Board invites the public to attend and participate in meetings related to SF Commons. These BAVC Board meetings are designated as "Public Meetings." For Public Meetings held in person, members of the public are invited to attend in person at the announced meeting location. For Public Meetings held via telephone or online, members of the public may access the meeting in real time by dialing into the designated conference call service or accessing the online meeting service provider.
Notice of Public Meeting BAVC provides advance notice of the date, time, manner and location for each Public Meeting to the Clerk of the Board of Supervisors and the San Francisco Main Library Government Information Center. This information is also available here on the BAVC website. Currently scheduled upcoming Public Meetings are:
Tuesday, August 17, 6:00 - 7:00pm (closed to public 7:00 - 8:30pm for Executive Session)
Monday, November 29, 6:00 - 7:00pm (closed to public 7:00 - 8:30pm for Executive Session)
OPPORTUNITY FOR PUBLIC COMMENTS.
All Public Meetings allocate at least (30) thirty minutes for public comment. Public comments should be limited to topics related to SF Commons operations and services. The BAVC Board has complete discretion to manage the time allocated for public comment (including any decision to schedule speakers by topic or extend the time available for public comments). Members of the public are usually invited to address the BAVC Board in the order in which they sign up to do so. Generally, persons who submit valid Requests to Comment in advance of a Public Meeting are invited to speak first, followed by persons who sign up to speak at or immediately prior to the meeting.
REQUEST TO COMMENT
To assist the BAVC Board in preparing for each meeting and to provide opportunity for the greatest number of persons to speak, BAVC strongly encourages prospective speakers to submit a Request to Comment in advance of the Public Meeting they wish to attend. Generally, San Francisco residents who submitted a proper Request to Comment will be invited to address the BAVC Board before other members of the public in attendance that did not submit a Request to Comment. To be considered, Requests to Comment must (i) be received no less than fourteen (14) days before the Public Meeting, (ii) include a brief statement of the subject matter the speaker wishes to address, and (iii) comply with the Sunshine Correspondence Guidelines below.
Written Statements. The BAVC Board invites members of the public to submit written statements to communicate their interests, concerns or comments about SF Commons operations and services. The BAVC Board receives written statements from the public at any time and on a rolling basis. To ensure that your statement is included in the material considered by the BAVC Board in connection with a particular Public Meeting, please submit your statement prior to the conclusion of that meeting.
No Recording. The BAVC Board does not allow the public to record any of its meetings, and the recording or rebroadcasting a Public Meeting is strictly prohibited.
PUBLIC ACCESS TO RECORDS
BAVC makes certain financial information concerning the organization available to San Francisco residents upon request (the "BAVC Sunshine Packet").
Contents of the BAVC Sunshine Packet. The BAVC Sunshine Packet includes the following categories of information: (i) the most recent SF Commons budget, if any, provided to San Francisco in connection with the SF Commons Grant; (ii) BAVC's most recently filed California and Federal tax returns, except to the extent such returns may be privileged; (iii) the result of any financial audit of BAVC performed by the City and related to the SF Commons Grant; and (iv) the result of any BAVC performance evaluations performed by the City and related to the SF Commons Grant. The BAVC Sunshine Packet is limited to the information in BAVC's possession and to documents dating back no more than two years or the effective date of the SF Commons Grant, whichever is more recent. Also, to protect the financial privacy of BAVC members and donors, documents that reveal the identity of a BAVC donor or the amount or nature of an individual donation will be redacted or removed from the BAVC Sunshine Packet.
Reviewing the BAVC Sunshine Packet. San Francisco residents are invited to review the BAVC Sunshine Packet in person free of charge. To do so, please follow the Sunshine Correspondence Guidelines below to schedule a time to visit us in our offices. San Francisco residents may also request a copy of the BAVC Sunshine Packet be sent to them by US Mail. To request a copy, please submit your request by following the Sunshine Correspondence Guidelines. Note that copies of the BAVC Sunshine Packet are provided at a cost of $0.10 per page, with postage paid by the recipient.

It really doesn't matter if BAVC violates the "Sunshine Ordinance" or
downsizes and privatizes SF Public Access TV.
The Newsom-appointed Ethics Commission will do nothing to BAVC
to hold them accountable for Sunshine violations. This strategy is
a Dead-End.
The equally-corruptible Board of Supes will do nothing, also. To add
insult-to-injury, they will continue to fund this phony non-profit (BAVC), as evidenced from the recent appropriation of an additional $375K from the Comcast settlement. No strings attached.
Find another strategy to defeat BAVC. Going to City Hall and
complaining is going nowhere, fast.
