Afraid of Workers’ Choice of SEIU-UHW, NUHW Walks Away from 2 More Elections-Now 11 Losses

With workers clear about staying in SEIU-UHW, NUHW walks away from 2 more election campaigns, bringing their losses to 11. 2,000 workers are staying united in SEIU-UHW as group started by Sal Rosselli and former SEIU-UHW officials faces string of setbacks
More than 200 caregivers at Hayward Convalescent in Hayward and Lifehouse in San Jose won their election campaign yesterday over the organization started by former SEIU-UHW President Sal Rosselli and other former union officials.

The victories for members of the Service Employees International Union–United Healthcare Workers West (SEIU-UHW) bring to eleven the number of facilities where workers have chosen SEIU-UHW over NUHW in the past two weeks. Since Rosselli and the others were removed from union office 15 months ago, 65,460 SEIU-UHW members have chosen to stay in SEIU-UHW – more than 95% of the members who have been given the choice.

The caregivers at both nursing homes were unambiguous in stating that they were voting to keep their union, SEIU-UHW. To avoid an overwhelming defeat, Rosselli’s organization, the National Union of Healthcare Workers (NUHW), withdrew its petition yesterday with the National Labor Relations Board (NLRB) and called off the elections just days before the vote. The elections were scheduled for Mon., April 23.

“I am extremely happy we won! Because of our former union officials, now NUHW officials, we don't have a contract, haven’t had raises in nearly three years, and have suffered so many takeaways. Today is one huge victory. We are staying strong and staying united in our union, SEIU-UHW,” said Marisa Dumlao, Laundry at Lifehouse

With this threat to their organization and contracts eliminated, these workers are now returning their focus to patient care and the workplace issues that affect it.

Beyond these losses, NUHW has been facing unprecedented setbacks on multiple fronts in recent weeks. Earlier this month a Federal jury held the union and many of its officers and staff liable for $1.5M in damages for their conduct as they were removed from SEIU-UHW and formed their new union. NUHW’s recently filed annual financial disclosure indicates that they were $1.5M in debt even before the judgment. Also this month NUHW has given up rather than face defeat at St. Francis Medical Center, part of the Daughters of Charity Health Systems, in Lynwood (920 workers), Tiller Oakridge Care Center in Oakridge (100 workers), San Marco Nursing and Rehabilitation Center in Concord (90 workers), and Avalon Chowchilla nursing home in Avalon (50 workers). Workers at a small nursing home in San Francisco, Convalescent Center Mission Street, and Prison Health Services in Dublin and Oakland appear to have chosen NUHW by a small margin in elections held there this week, however SEIU-UHW will be filing formal objections to the election results due to management and Board misconduct.

“I am very happy and excited that we won. Now, the most important thing is that with SEIU-UHW we are going strong into our contract fight,” said Victor Velazquez, a certified nurses assistant at Hayward Convalescent.

Caregivers at 28 other facilities with elections scheduled will be voting in the coming weeks, although it is highly likely that NUHW will continue to pull out of many of these elections rather than suffer humiliating defeats.

NUHW is still desperately trying to stop elections at Sutter Delta Medical Center in Antioch, Sutter Solano Medical Center in Vallejo, Sutter Eden Medical Center in Castro Valley, O’Connor Hospital in San Jose, St. Louise Regional Hospital in Gilroy, and Centinela Hospital in Inglewood. In many cases NUHW is now challenging the composition of the bargaining units, even though they are the same bargaining units for which they themselves petitioned for the election.

It is too bad that members are really blinded and scared of SEIU and management. That is the real reason why members are voting for SEIU. SEIU pulls many tactics like threatening the employees that they will lose their job if they do not take what management wants out of these new contracts. What these respresentatives should be doing, is let the real members be heard, and stop making these backroom deals with management. SEIU is letting management break the current contracts and letting them get away with it.
Yes, these facilities have voted for SEIU but it's because they have not heard the real truth on what is really going on.

AM I EMBARRASS ABOUT THE FALSE CLAIMS THE GOVERNMENT ALLEGED IT SUBMITTED TO MEDICARE AND OTHER FEDERAL HEALTH PROGRAMS, NO. HAVE I DONE THE BEST FOR HCA PATIENT CARE, YES. AM I PERFECT, NO. ONLY GOD KNOW'S I'VE DONE MY BEST AND I'VE EARNED MY RESPECT FOR 15 YEARS. I WOULD LIKE NOT TO PUT DOWN OUR WORKING PLACE BUT TO HELP EVERY ONE INCLUDING HCA. HCA NEEDS OUR VOTE AND OUR HELP. Where is Nelda and Aida. I guess they learned on their own that hospital employee's kept reading the same flier day after day and gave fliers to only employee's they knew. No one said it was going to be easy. All I know is that Managers at Rio Grande Regional Hospital still keep their heads down at me. Well I know that it will be a success and that we will survive. Every one keeps saying things about the Union but they still don't know that the Union is us. Dietary workers and House keepers are now coming to me for advise. I guess that they are now not afraid. After all we have not got a reasonable pay raise for a while. We have not even had a Hospital party, for a party for our family. I guess only the hospital only think about their Managers, not their employees. Well my friends, one thing we need to know. Let's finish what we started. I'm proud of all my friends that are willing to sacrifice for others to have what we want. Good luck to Aida and Nelda. You are still my friend. Trust me. I member what you told me.
If members are not sure on whom to vote for, maybe they need to read like I did. Or if you have any great information for our hospital I think they would thank you. I've seen managers look at me with anger. I know they know that if we win, which we will, that part of the money that they earn will be shared with us. Some managers and supervisors are showing fear to employee's but I'm not scared. I know my rights and will show them no more fear.
The first thing we read on our first meeting was that managers or supervisors were not to make any comments or face reactions on all employees what so ever. Well I have been one of the most, if I may say, the one that is going all the way with seiu for the reason that we have done all we can to stay working at HCA no matter if we were paying 4.00 dollars of gas this past few years. We went through the economy like HCA did. We got for the past two years ar 2.50 raise and according to one of the housekeepers they got .10 cents increase. Well we at Rio Grande Regional, I thought it was only me but we have notice that even managers are making remarks when they see us with SEIU buttons. I never thought that for 15 years that I've been working there, that a house keeper manager would denie me a simple HI, or Hello. Very strange that they even say things to our face in front of employees or even in front of other managers. Today I said hello to a house keeper manager while I was walking and she didn't reply so I stopped and said to her like "Hellooooo" and she new that I was serious about her being in front of me about 3 feet and she didn't answer to me. Well tomorrow I will make sure that any manager that I see will respect my hello. As it is no one say's hello these days. Well I just want to be the same to where all managers were nice. Why are they mad, well I guess you know why. What all managers should respect our vote like they said they would. They need to act like educated managers.

Seems like Mario is the only one with an opinion here. He said he's well-read on this subject, but has he only read union-sanctioned propaganda, or has he read ALL the pro's and con's? It makes a difference. I am not here to voice an opinion, one way or another, but to merely make an observation. I hope he is not implying that without a union, people will not do their jobs propperly and make sure the instruments they use for surgery are both sterile and acounted for. RGRH has a good reputation for providing quality healthcare to our community---I'd hate to see that change just because the union didn't take over our facility. I love my hospitl, my colleagues, and my community, and that will not change, union or no union.

If everything SEIU has to offer is so great, why all the restrictions on us? Why the restrictions on our directors and other management? What happened to freedom of speech? Also, why the attempts at intimidation and harassment of those of us who are not happy to have the union interference? SEIU has spent a bundle of money and many hours here, making lots of empty promises, buying food, and pressuring people too polite to tell them to "Take a hike!". They're using dollars from other peoples dues just to get MORE money--and as soon as they have those dues coming in, they'll move on. It's a weak argument to say that just because people oppose union interference they are
"uninformed". In fact, the more research we do, the more apparent it becomes that SEIU cares nothing about the worker, but only for the money & politcal power that money gives them. Read, search the internet, call your friends who are in unionized hospitals...you may be surprised at what you hear.
SEIU is NOT welcome at Rio Grande Regional Hospital. The only thing they have accomplished is spend thousands of current member dues by wasting time trying to brain wash employees. If you believe every word blindly, you are very ignorant. Take the example of teachers and students in a classroom. When a teacher is teaching a subject, she has publications to reference her information from. All the students have access to these publications so they can study further what she is teaching. These publications she teaches are not her own words, but that of a skilled, proficient author. You, the student, need to do your own research from credible resources such as analysts, credible news reporters, and credible articles. You apparently have a computer at home because of the quantity of blogs you have posted. Sit down and research what SEIU has done on http://www.cbs13.com, http://www.thewashingtonpost.com, and http://www.wsj.com (Wall Street Journal). Research their current finances and how badly they use members money. Read up on how members benefits are not guaranteed more than 65% yet all the SEIU workers and bosses benefits are guaranteed 102%. Watch how SEIU "bullies" perform violent acts on opposing parties and how police reports confirm the criminal acts committed by this union. Study how unions are the cause of our current national economic crisis starting with the multi-billion bailout for GM Corporation at the cost of taxpayer dollars. Analyze how unions are also to blame for the thousands of Americans who are currently unemployed because it is too expensive to pay "unionized workers" so jobs are going overseas. Lastly, study how cold-hearted SEIU workers are by trying to get the government to give jobs to illegal immigrants while SEIU is laying off hundreds of employees and could care less if they can't find a job anywhere else. I am not afraid of my bosses and I am no where near intimidated by you; but I have a profound respect for our administrators to have put up with unappreciative employees like you. Where were your SEIU "friends" this past week to give you a hospital gift or goodies during the week? If you really are against our current administrators and their management skills, you would not have gone to receive all the "goodies" this past week that they provided. If you have no pride working for RGRH, you NEED to go somewhere else. I don't see how higher pay relates to better patient care. If you are dissatisfied with your current job, you need to stop trying to take the easy route and go back to school to get a higher education and better career. That is what I am doing and hundreds of other employees as well. So why don't you and the other "followers" who are crying about "poor pay and poor benefits" leave RGRH and get a job elsewhere?! Stop being Anti-American because SEIU does the total opposite of contributing to our current economy.

I am a Registered Nurse at RGRH and I am very much happy about our outcome in regards to the union. I don't understand why people are saying that we want the union because we are greedy and are only interested in the money, etc, etc, etc...I am a nurse here and have been for the past two years, and unless you have worked the bedside on a busy med/surg/oncology floor, you would have a problem with the union coming in. Our major issue here is the patient load. I work the night shift where we have a ratio of 7-8 patients to 1 nurse. These past couple of months on the floor were ridiculous as far as staffing. Nurses here were left with a full load and only ONE nursing assistant, if any at all, most of the time. How do you expect us to give good patient care when we have that many patients and NO help. Like I said, there were nights when we had NO nursing assistants on staff. The big issue here is safety. I was recently certified to administer chemotherapy, and in training, the instructor mentioned that a patient receiving a chemo infusion should count as two patients due to the possible complications/expected side effects, and just the procedure to hang or administer chemo is very time consuming. Our unit here does not honor that, and we will get a full load when we have patients receiving chemo. We have spoken up many times about this issue and every single time it just gets brushed off like it's not a valid issue. We REALLY needed the union, and unless you worked here and experienced this first hand as we have, you would NOT understand.

I don't know why you are blogging here if these posts are in regards to SEIU. I cannot comment on the nursing labor union because it does not apply to us. You cannot comment on the SEIU union because it does not apply to you nor have you done your research on it. I was very happy with the original vote results of majority voting NO SEIU unionization. Due to the fact that SEIU is notorious for requesting re-elections when they lose, we have to have another revote because they want to try and win this time around. Apparently SEIU and the employees who are Pro-SEIU need to review the definitions of PERSUADE, INTIMIDATE, and CHEAT. A simple question does not fall into either of these definitions. If you believe the nursing union is a right choice for the nurses, then I congratulate you. I advise you not to promote unionization for non-nursing staff when you are not knowledgeable with non-nursing jobs and SEIU.
