Medicinal sentence in Chico, CA
64 yr old man sentenced to 180 days in jail for violation of probation, due to physician-recommended use of medicianal cannabis.

Chico, CA March 5, 2010 – My husband, Edmund Barnett was sentenced to 180 days in Butte County Jail for violation of probation. Ed’s guilty sentence was the result of his use of physician-recommended medicinal cannabis. His original arrest, stemming from a 2008 episode involving alcohol-induced domestic violence, resulted in probation terms, which related solely to the cessation of alcohol.
With 50+ years of drinking in his system, Ed wasn’t ready to quit just because the law told him he had to. Anyway, let’s just say he displeased his probation officer on more than one occasion. Luckily, I managed to strategically place him into both detox and rehab programs just ahead of the orange jumpsuit, until his final attempt at recovery in early November 2009. I am thrilled to say, that he hasn’t had a drop of alcohol since then!
Fast forward to today, March 23, 2010. Ed’s “criminality” is directly associated to his addiction to alcohol and prescription meds. Edmund Barnett needed recovery, which he sought (70 days residential). Upon his return, he complied with every probation request: appts., domestic violence class, court dates, absence of alcohol, and the $$$ to every different department. His probation officer, Lori Teague, hated Ed’s 64 years of “in your face” attitude towards her, and the Honorable Sandra McLean was just sick of seeing him in her courtroom (I think she thought he was too old to misbehave). So, Probation put him before the bench because Ed exercised his patient right to use the best medicine for his needs, and the judge let them get away with it.
