Fed Judge Blocks California from Reducing Wages of In-Home Supporters of Seniors/Disabled

California Gov. Arnold Schwarzenegger and the California General Assembly approved wage reductions for In-Home Supportive Services (IHSS) employees in February as part of an overall budget reduction proposal.
But on July 14 a federal judge ruled that the state must pay IHSS workers their existing wages and not reduce their pay. While there are many other options to fixing the budget on the revenue side, including taxing oil companies the way the other states tax them, legislators are trying to rescue the California budget by reducing services for some of the state's most vulnerable, including seniors, blind and otherwise disabled adults and children.

On Monday, July 14 a federal judge ruled that the state must pay IHSS workers their existing wages and not reduce their pay by the $2.00 an hour legislators approved. The governor and the legislature had conspired to bring down home health worker wages to between $9.50 and $10.10 per hour, and to cut 60 cents in benefits.

The IHSS Program helps pay for services provided so that people can remain safely in their own homes. Recipients of IHSS care must be over 65 years of age, or disabled, or blind. Disabled children are also eligible for IHSS. IHSS is considered an alternative to out-of-home care, such as nursing homes or board and care facilities, and actually saves the state money in the long run.

Most people who get IHSS services also have Medi-Cal and some of those people must pay a certain amount each month toward their medical expenses in a share of cost scheme, similar to a private insurance plan’s out-of-pocket deductible.

IHSS is not out of the woods yet. Schwarzenegger continues to target services for the needy and In-Home Supportive Services is still on the chopping block; the governor has proposed eliminating in-home supportive services for all but the most severely disabled. He has also accused IHSS as being "rife with fraud", failing to see the irony of his unsubstantiated accusation. With his ruling class attitude the Governor fails to acknowledge the vast dollar amounts that corporate fraud costs the taxpayer.

On July 15th the California Teachers Association joined advocates for seniors and people with disabilities in front of the State Building in San Francisco, where the governor maintains an office, to protest proposed cuts to budgets for human services. The demonstration, organized by the San Francisco Labor Council, was covered by national media and brought attention to the serious nature of proposed cuts and how they would affect populations including children, the elderly, and people with disabilities. Demonstrators heckled a masked "Arnie" impersonator with an oversized cigar and carried placards reading, "Don't let our state's future go up in smoke."

From what I've heard, IHSS recipients, in order to get competent workers, sometimes allow those workers to work fewer hours than they sign for, figuring -- rationally -- that it's better to have a good, trustworthy worker for 20 hours than an incompetent, unreliable one for 30 hours.

Also, some recipients must feel -- reasonably -- that it's unfair to expect someone to do hard, useful work for around 11 dollars an hour while so many people get many times that for far easier work that is socially useless or harmful.

Arnold Schawarzenegger wants to take from people that really need these services. He said, NO MORE TAXES, yet when I got my renewal for my car tags guess what it went up over $40 just this year alone now what do you call that?? I also am a disabled person who receives SSI and he also has taken away our raise for cost of living that we received the first part of the year and that lasted 4 months, then he says no more cost of living increases for people on SSA or SSI, then to top it off he takes more money back from us now I am getting less then I was 3 years ago. I know these are hard times for everyone but, believe me I rather not be disabled and be able to work and move around without pain and work 2 or 3 jobs if I could then to barely make it on what I get now. I know people on unemployment that are now getting an extra $100 a month and I am sure that would make some one smile. The real waste and frauds here are the way the governement spends and waste the money. So they take away from the most helpless and needy. People are struggling everyday just to keep food on their table and now he wants to even take medical away from them. Seniors need glasses and dental what is going to happen when they can't see or eat?? No HELP for them to stay in there homes. Arnold you need to look inside of your heart if you have one. And what about the poor children who need medical and help at these trying times does he expect them to go hungry and sick. Yet look at how the big shots make their money, spend supposely their money,WOW what about there retirements. Guess I just neede to vent here. God help us all..................................

The author conveys a highly biased perspective that discredits the publication. If opinions are expressed, I suggest a coherent opinion of opposite conclusion also be represented.

The scrutiny of budget reductions is mindless; yet the quantitative comparative analysis of alternative proposals begets far greater value to readership and enhances the publication's credibility.

Please reconsider your strategy in limiting your presentation of only one side.

We need to discuss alternatives regarding how to fight the ruling class and its agents, not whether to fight them. If you have any doubts regarding the need to fight them, you're probably at the wrong web site.

Until we have the forces necessary to overthrow the ruling class, we at least have to organize enough resistance to make it impossible for the rich to live in comfort and safety, and for their "economy" to function, while poor people go hungry or die from lack of care.

Go back to acting Arnold....at least you had some talent there....as Governor, you sorely lack....in compassion and understanding of what it is like to be disabled or be a parent of a disabled child. I do....my son is severely disabled and I am a single parent - which means all income falls on my shoulders. Am I expected to allow you to take money out of our pockets which are so shallow anyway? I work part-time, take care of my son (for the past 18 years) and struggle to keep food on the table and a roof over our heads....but that isn't enough for you...you want to reduce our IHSS income. How do you expect us to survive? But then I guess that's where you draw the line about caring for the people of California. Please stop attacking IHSS and other funding for the disabled...out lives are already very difficult - must you kick us when we are already down???

I beg you to find the compassion....if only you could walk in my shoes, than you would see how inhumane your actions are to us.
Can you solve this ? 93 year old disabled receives $1,200./mo SS. Needs are 24/7. paralyzed on one side from a stroke. Impaired by Dementia and cognitive thinking as well. She is in a wheel chair, does not qualify for aged & disabled..??? .at each re-evaluation hours of need are taken away, thus cutting IHSS pay to the Caregiver. Cannot get IHSS unless she qualifies for Medi-Cal. Seems to me that as the condition worsens more time for the Caregiver is needed. Share of cost is determined at $551.00 a month that she has to pay out of an empty pocket. Her rent is $1,000. in Santa Clara. Caregiver has to live there with her. There are utilities and rent and groceries. Finally she is able to get Food assistance of $108. 1,200. less $551.00, less at least $150. more for groceries and whatever utilities & phone come too. None of it adds up to assistance for her. She does not have $551. to pay the Caregiver what can be done? She goes into a Care Home where it will cost approx $6,000/mo. Mr. Schwarzenegger how many of these cases have you studied, if you have it doesn't seem to phase your way of thinking. Write it all down on paper see if you come out with the same figures I have.
