Review of Sotomayor's Record Belies GOP Charges of Biased Judicial Practice

Wednesday, July 15, 2009 :An exhaustive review of all 1,994 constitutional cases decided by the Second Circuit during the decade of Judge Sotomayor's service found that Sotomayor is solidly in the mainstream of her colleagues. The Brennan Center For Justice report found Sotamayor voted with the majority of the court in 98.2% of constitutional cases. We speak with the report's author, attorney Monica Youn, and Democracy Now!'s Juan Gonzalez, who's in D.C. covering the hearings.
We turn now to look at the actual judicial record of Judge Sonia Sotomayor. The Brennan Center For Justice has just completed an exhaustive review of every constitutional case decided by the Second Circuit during the decade of Judge Sotomayor’s service–a total of 1194 cases in all.

The report found that Sotomayor is solidly in the mainstream of the Second Circuit. The report found she voted with the majority of the court in 98.2% of constitutional cases. When she has voted to overrule a lower court or agency, her decisions have been unanimous over 93% of the time.

Wednesday, July 15, 2009 :The confirmation hearings for President Barack Obama's Supreme Court nominee Judge Sonya Sotamayor continue on Capitol Hill. On Tuesday, Democratic Senators praised Sotamayor's 17 years on the federal bench while Republicans repeatedly grilled her about statements she has made during a series of speeches over the years. We play excerpts of the hearings.

On Capitol Hill, the confirmation hearings for President Barack Obama’s Supreme Court nominee Sonia Sotomayor are entering a third day. If confirmed, Sotomayor will become the nation’s first Hispanic Supreme Court justice.

On Tuesday the questioning of Sotomayor began. Democratic Senators praised her 17 years on the federal bench while Republican repeatedly grilled her about statements she has made during a series of speeches over the years.

Near the beginning of the hearing, Judiciary Chair Patrick Leahy, a Democrat, asked Sotomayor to explain her 2001 comment that a “wise Latina” might arrive at a better legal decision than a white man.

Senator Jeff Sessions, the ranking Republican on the Senate Judiciary Committee, also questioned Sotomayor about some of her previous statements about the role of judges.

Republican Senator Lindsey Graham of South Carolina challenged Sonia Sotomayor about her demeanor on the bench.

And Democratic Senator Herb Kohl of Wisconsin briefly asked Sonia Sotomayor about abortion, but she was never asked explicitly if she is in favor of abortion rights.
