The Bay Area Air Quality Management District SHAFTS the Bayview Hunters Point once again.

The Bay Area Air Quality Management District (BAAQMD) continues to SHAFT the Bayview Hunters Point - more so with the adverse impacts linked to Parcel A at Hunters Point. A Rogue Developer Lennar bombarded our children and elders with toxic dust and Asbestos structures. Since 2004 the impacts have caused severe health problems. The BAAQMD issued over 400 Notice of Violations to Lennar. The paradox is that Lennar still continues to bombard the community surrounding Parcel A - without the Regulatory Agencies citing the Rogue Developer - Lennar and taking the RIGHT action.
The Bay Area Air Quality Management District (BAAQMD) is the primary Regulatory Agency that is supposed to monitor Lennar who has been conducting large scale grading on Parcel A at Hunters Point.

Lennar has chosen with INTENT not to follow protocol. Lennar comes into any community and spreads money around. The many sell outs that took money today and not getting any because the well has dried out. But, the sell outs and many of them BLACKS that took money have BLOOD on their hands.

Some years ago when the grading first began without any dust and Asbestos monitoring equipment the Rogue Developer Lennar blasted a wide area with toxic dust and Asbestos structures for sure over the 16,000 structures per cubic meter - the cap laid down in Article 31 of the San Francisco Health Department - and part of the Dust Mitigation Plan.

This operation went on for months on end and the Regulatory Agencies and the especially the Bay Area Air Quality Management District was asleep at the helm and failed to protect the people of San Francisco, the many workers, and especially the people that live around Parcel A.

Lennar is mandated by law to abide by the Disposition and Development Plan - a legal document. When these meetings were conducted my partner Andrew Bozeman and I - participated in these meetings. My experience at the Presidio of San Francisco linked to mitigation and abatement projects - allowed me to ask some pertinent questions linked to dust and Asbestos issues. These suggestion were incorporated into the Dust Mitigation Plan. It is one think to talk the talk but quiet another to walk the walk. The Bay Area Air Quality Management District loves to talk the talk. But, all this will end soon - our patience has run out and the BAAQMD better enforce the law.

We will sue the scumbags because as much as we have tried to be good to these folks - they seem to do as they please.

We all were assured that the Dust Mitigation Plan would take care of everything. However, when the day came for large scale grading - nothing what so ever was in place. In fact Lennar acted in such a blatant manner that few were there to monitor their actions. I did. And as I mentioned before I knew a long time ago that the dust and Asbestos monitors were not working.

Lennar was bold enough to fire three Blacks working for Lennar that were told to shut up and not be concerned about the adverse impacts and suffering of the community from the toxic dust and Asbestos structures. These three employees sued Lennar and the suit was settled out of court by Lennar.

First and foremost the Rogue Developer Lennar - bribed some "thug" to clear cut over 400 mature trees on Parcel A. By law Lennar was to have got a permit but no permit was got and this crime has been brought to Mayor Gavin Newsom attention. Muhammad Nuru from the Department of Public Works knows about it - but as I stated no permit was got and Lennar went ahead and clear cut one of kind mature trees planted by the United States Navy.

Once the trees were cleared low and behold Lennar found foot prints of homes that were covered by the brush. Further investigation led to sewer pipes that were contaminated by radiological elements. The Environmental Protection Agency and the other Regulatory Agencies had signed on to the Record of Decision (ROD) - the most critical document to transfer any parcel. This supposedly clean Parcel A was now - D I R T Y.

Lennar was forced to use a company to come in and clean up the radiological elements without anyone knowing. I know who the company is but as I am pointing this fact to show you at that time the Mayor's Office of Economic Development and Workforce, the San Francisco Redevelopment Agency under the corrupt Director Marcia Rosen, Mayor Gavin Newsom, and many others - were in bed with Lennar.

There was a 37 foot rock stark middle on Parcle A - a rock so hard that some machines with over fifteen foot tires had to be brought in to chip at the rock. Ideally dynamite would have done the job - but if this Serpentine Rock was blasted Asbestos Structures would impact a large area and it was dangerous to the nearby homes. So Lennar chose not to bring attention to this fact and to some of us that Lennar knew were monitoring the project. I have posted hundreds of photographs and have thousands more in microfiche and other digital formats for future use.

The type of rock that I mentioned that is hard is Serpentine but this particular vein is Ultramaphic and is very dense. This rock is foundonly at Hunters Point, at Potrero Hill and at the Presidio of San Francisco. The maps from the United States Geological Survey best describe the areas where Ultramaphic Serpentine Rock is found in San Francisco.

Years after Lennar started their operation and years after some of us complained to the San Francisco Health Department, the Bay Area Air Quality Management District (BAAQMD), the Environmental Protection Agency stalled and did nothing. The BAAQMD the primary Regulatory Agency that was supposed to monitor the dust and the air - issue Lennar Notices of Violations but Lennar continued to bombard the community with toxic dust and other very dangerous particulates without any fines and shut downs. This nonsense went on for months on end. But, all this will be revealed soon and some heads will fall.

Stop Lennar Action Movement (SLAM) had to attend the BAAQMD meetings and speak out. We did this so many times that the Directors of the BAAQMD felt that we would NOT give up and were adamant that we NOT be present at their meetings. They forced the Jack Broadbent from the BAAQMD who heads the BAAQMD to do something.

As I stated Notice of Violations were issued at at one time they totaled 380 plus. Multiplying the maximum fine the total amounted to $38 million. Yet when Lennar was fined by the BAAQMD because of the efforts of Stop Lennar Action Movement (SLAM) the Bay Area Air Quality Management District fined Lennar a measly $515,000.

This fine was paid by Lennar in September of 2008 one month after they were cited. We have information from many sources that a deal was cut behind close doors. A deal so secretive that even the BAAQMD, Board of Directors and among them San Francisco Board of Supervisors - Chris Daly who sits on the BAAQMD Board was NOT aware.

The BAAQMD Director Jack Broadbent assured us that he would help the Bayview community. We requested that the community affected be tested with this fine that was collected because of our hard work. We requested for some quality outreach to the community linked to that adverse impacts of toxic dust and Asbestos Structures. Finally if air-purifiers the quality ones used in hospitals could be procured and given to those families surrounding Parcel to help them with their breathing.

All this was requested and Jack Broadbent met with some members of SLAM and gave them assurances. Since October of 2008 Jack Broadbent has chosen with INTENT not to do anything much to help those constituents of Bayview Hunters Point that have been most adversely affected.

Recently I went to attend the BAAQMD Board of Directors meeting they meet on the First and Third Wednesday of the month. The second meeting in June was canceled and no notice posted on the BAAQMD web site. I attended the first meeting on the BAAQMD Board of Directors in July and addressed the Directors. I stated to them most of the pertinent points I have here - linked to the promises made by the Director of the BAAQMD - Jack Broadbent.

Jack Broadbent has however hired a consultant not from the community but from Oakland and a Black woman who brags that the BAAQMD has over half a million and she is there to help the community on behalf of the BAAQMD.

I asked the woman what did she know about Hunters Point and she told me precious little. So I explained to her that at Hunters Point - Depleted Uranium was tested first tested. Asked her if she had read the Final Historical Radiological Assessment Report linked to the Shipyard - she had not. I asked her a number of question and the woman seem NOT to have an inkling of the history of our community and less about the pollutants.

Now, Jack Broadbent often talks about Transparency and Accountability but is this case he failed to inform Stop Lennr Action Movement (SLAM) about this inept, ill informed consultant, on such an important issue where the health of our children, our elders, and the community at large is on the line.

It is amazing how some Whites will sit on an issue when it comes to people of color.

One has just to review the actions taken at El Dorado and the school there that had some Asbestos issues. The community there was White and the Environmental Protection Agency and the Air Quality District bent backwards to the help the White El Dorado community.

We the community from the Bayview Hunters Point in San Francisco exercised our rights and forced the Bay Area Air Quality Board of Directors to mandate the Director of the BAAQMD to do something. Jack Broadbent decided to fine Lennar a measly $515,000. Now after nine full months NOTHING has been done to benefit the community. All we hear is talk and no action.

We however have found out a consultant who is NOT educated on issues has had a meeting with BMagic a group of Community Based Organizations that have NOT been on the front line addressing the pollution issues linked to Parcel A at Hunters Point part of Hunters Point Naval Shipyard. This Black woman consultant has gone the YMCA to garner support to no avail. What is happening Jack Broadbent? What is happening Kelly Wee Director of Compliance and Enforcement at the BAAQMD who always goes on the defensive and has been in bed with Lennar ever since the Lennar Project started at Parcel A.

I have got e-mails from the BAAQMD from employees working for the BAAQMD situated at 939 Ellis Street in San Francisco. These employees in cognito have expressed to me that Kelly Wee is corrupt and what is more arrogant. Well, I have been very kind to Kelly Wee so far but not any more.

Now, it is time the Bay Area Air Quality Management District do their job as best they can. If not they should shut down their operations. For the longest time ever they have not given the constituents of San Francisco a realistic picture of the Air Quality in the Bayview Hunters Point.
Here are some project they should address:

1. The over 300 tons of Methane Gas that spews in the air. One ton of Methane Gas equals
twenty two tons of Carbon Dioxide. All this in the Bayview Hunters Point. So much for
calling San Francisco - GREEN.

2. The Methane Gas released by the Phelps Raw Sewage Treatment Plant right in the middle
of the Bayview neighborhood and within a stone's throw from the South East Facility where
students learn and children are accommodated at a Kindergarten.

3. The toxic pollutants from the many industries some one thousand plus that emit paint
toxins into the air all situated in the Bayview area - zip code 94124. Other toxins from
varnishes and so on.

4. The power plant by Dog Patch by 3rd Street that spews dangerous particulates, lead,
mercury and a host of other toxins into the air.

5. The millions of vehicles plying on Third Street and thousands of trucks that venture on
roads in the Bayview neighborhood carrying toxic dirt from the Hunters Point Naval
Shipyard and other places without the Bay Area Air Quality Management District doing
any monitoring - even when we have notified them.

6. The Raw Sewage Treatment Plant at Phelps Street in the Bayview in the middle of a
residential neighborhood emits foul so disgusting that people vomit. The BAAQMD can
do something about this - but has chosen NOT to do anything. The pungent smell hovers
around a mile and is disgusting to say the least. Often shoppers that are new and come
to the Evans Shopping Center - wonder why something is not done about this foul smell?
Well what have you got to say - Bay Area Air Quality Management District? May be a law
suit is in order to teach you and others a lesson?

7. The Bay Area Air Quality Management District has failed the constituents of the Bayview
Hunters Point linked to the adverse impacts on Parcel A. We want our community tested.
None of us want this BLOOD MONEY for ourselves but we want our community tested. We
do not want to talk without meaningful action. We have experienced this at the many
private meetings that SLAM has had at the BAAQMD building at 939 Ellis Street.
The BAAQMD keeps shafting the constituents of Bayview Hunters Point. Shame on the Bay
Area Air Quality Management District.
