Federal District Court Hearing. Everardo Torres was shot to death in 2002 by Madera police officer Marcy Noriega. Torres had been arrested, handcuffed and put in the backseat of a police patrol car. Noriega opened the back door, pulled her firearm and shot Torres through the heart. She claims she thought she was using her Taser. In April 2005, Judge Anthony Ishii rejected the family’s claim that Torres’s civil rights were violated and he issued a summary judgment in favor of Noriega and the City of Madera. The 9th Circuit Court of Appeals overturned Ishii’s ruling, and the case returns to his courtroom on May 11. Federal District Court, 2500 Tulare St. Community support for Torres’s family would be appreciated.
