Police in Oaxaca remove community members blocking access to mine
Yesterday morning more than 1,500 federal and state police raided the encampment of community members from San Jose del Progreso and surrounding towns in Oaxaca who were blockading access to the Canadian-owned Fortuna Silver Mine.
They are opposed to the environmental destruction this mine will cause, as well as the fact that it was foisted upon their communities without their input, another example of a multinational corporation extracting mineral wealth from poor indigenous communities with complete disregard for human, environmental or social rights.
The communities had been blockading the mine since at least mid-March and faced continuous government harassment. At least 20 people were arrested and many were injured during the raid.
Below is a statement from a Canadian human rights group and a call to action from several groups on the ground in Oaxaca, with a sample letter and email addresses to send it to.

We have learned that the governments of Felipe Calderón and Ulises Ruiz Ortiz have unleashed a violent repression against the indigenous communities of San José del Progreso and Magdalena Ocotlán, for their defense of the environment and their natural resources. They are opposing the establishment of the FORTUNA SILVER MINES and CUZCATLÁN, which in addition to being highly contaminating and destructive of the environment, we have been informed have begun their work without permits and papers established by laws (regarding mining).
It worries us that the Mexican government represses its people and violates human rights to benefit companies which in no way follow national laws.
For these reasons, we demand:
* The immediate stop to repression and violation of human rights of the indigenous people of The Valleys of Ocotlán for the "crime" of defending the environment and their natural resources, which should be a priority for all the governments of the world.
* The immediate and unconditional release of persons unjustly detained, since we know the skill of the Mexican government in fabricating crimes to repress social activists.
* The fulfillment of the petition of the towns that call for the departure of the mining companies of Valle de Ocotlán, because of contaminating the water and the environment.

THE GOVERNMENTS OF FELIPE CALDERON AND ULISES RUIZ REPRESS THE PEOPLES OF OAXACA WHO DEFEND THE ENVIRONMENT AND THEIR NATURAL RESOURCES
Today, Wednesday, May 6, 2009 around 8:30 in the morning, with excessive force, using tear gas, shooting various firearms, police dogs, savagely beating the compañeros and invading homes, more than 2,500 policemen of the FEDERAL, AFI, JUDICIAL, FIRE DEPARTMENT attacked those who were peacefully guarding access to the mine. Also beaten were media people who were present and whose access was blocked. From the early hours a helicopter was circling overhead at fifteen or twenty meters up, terrorizing the population.
Twenty compañeros have been detained: Ignacio Vásquez Gómez, Hilario Vásquez, Joaquín López, Víctor Sánchez Martínez, Juan García, Elías López, Bernardo Vásquez Gómez, Silvino Vásquez Mérida, Alfonso Ruiz, Alfonso Rodrigo López, Luis Ruiz Martínez, Víctor Ruiz Martínez, Juan Carlos López, Agripina Vásquez Sánchez, Bernardo Vásquez Sánchez, Víctor Ortiz Hernández, Apolinar García, Carmela González, Ubaldo González,all of them from San José del Progreso and Alejandro Aquino Cosme from Magdalena Ocotlán.
Between 12:00 and12:30 o'clock the police circles were reinforced from all the units to break into (homes) house by house in the town of Magdalena Ocotlán and they even arrested whoever walked in the street, a situation which resulted in more than 20 detained.
During this operation the police maintained a cordon around the community of San José del Progreso, as well as around the communities of Magdalena Ocotlán and Santa Lucia, El Maguey Largo. They are reorganizing to free San José del Progreso, Ocotlán from the police circle, as well as carry out actions to free the detained.
The attempts at dialogue have been nil with the Secrtary of the Environment (Secretaria del Medio Ambiente, SEMARNAT) and the Secretary of the Economy (SECRETARIA DE ECONOMIA), PROFEPA, National Water Commission (COMISION NACIONAL DEL AGUA), and with the Secretary of Government (SECRETARIA DE GOBERNACION), institutions which are the ones that issue permits of agreement to an environmental impact study which the mine CUZCATLAN offers, and which should be made known to the original owners of the lands.
But there have been many deceits, lies by the company CUZCATLAN, since one sees today the federal and state government are giving total backing to the mining investments without considering the opinion of the peoples, who will be affected by the consequences of poisoning the water, soil, and atmosphere, by the noise, the destruction of the cement of the houses as a consequence of the dynamite explosions which the mining company carried out during nights. None of the actions we have pacifically carried out has been able to sensitize the authorities so that the petition of the peoples be heard. That is demonstrated by the backing that Felipe Calderón on April 21 issued on national networks and in newspapers, regarding the mining investments in México, which shows that the spurious government of Felipe Calderón has put himself on his knees before the foreign investors.
Faced with this siutation we demand:
* Halt to the brutal repression and violation of human rights which the national and state government are committing
* Immediate freedom for the political prisoners of the communities of the Valle de Ocotlán and of the state of Oaxaca.
* Immediate and unconditional departure of the mines which poisons the water and destroy the environment .
* That the National Commission for Human Rights (Comisión Nacional de Derechos Humanos, CNDH), guarantee the physical and psychological integrity of the detained and that it pronounce itself against the violation of human rights committed in the dislodgement
* Out of Oaxaca for the criminal Ulises Ruiz Ortiz.
We ask the organizations and national and international persons to speak out against the repression and violation of human rights which are being committed against the indigenous people who defend the environment and their natural resources, by sending letters of repudiation to the governments of México and the state of Oaxaca, to the Mexican embassies in your respective countries, and where you have conditions to do so, demonstrating in repudiation of these actions by the spurious governments of Felipe Calderón and Ulises Ruiz Ortiz.

LOS GOBIERNOS DE FELIPE CALDERON Y ULISES RUIZ, REPRIMEN A LOS PUEBLOS DE OAXACA QUE DEFIENDEN EL MEDIO AMBIENTE Y SUS RECURSOS NATURALES
El día de hoy miércoles 6 de mayo del 2009, alrededor de las 8:30 de la mañana, con lujo de violencia; utilizando gases lacrimógenos, con disparos de diversas armas de fuego, perros policías, golpeando salvajemente a los compañeros y canteando sus domicilios, a quienes pacíficamente estaban resguardando el acceso de la mina, entraron más de 2500 efectivos de la policía FEDERAL, AFI, JUDICIAL, DEL CUERPO DE BOMBEROS; también fueron golpeados los medios de comunicación que se encontraban presentes y se les bloqueo el acceso, desde temprano estaba sobrevolando un helicóptero, como a 15 o 20 metros de altura, atemorizando a la población.
De manera general han detenido a 20 compañeros: Ignacio Vásquez Gómez, Hilario Vásquez, Joaquín López, Víctor Sánchez Martínez, Juan García, Elías López, Bernardo Vásquez Gómez, Silvino Vásquez Mérida, Alfonso Ruiz, Alfonso Rodrigo López, Luis Ruiz Martínez, Víctor Ruiz Martínez, Juan Carlos López, Agripina Vásquez Sánchez, Bernardo Vásquez Sánchez, Víctor Ortiz Hernández, Apolinar García, Carmela González, Ubaldo González, todos ellos de San José del Progreso y Alejandro Aquino Cosme de Magdalena Ocotlán.
Entre las 12:00 y las 12:30 hrs., han reforzado los cercos policiacos de todas las corporaciones para catear casa por casa al municipio de Magdalena Ocotlán e incluso detienen a quien anda en la calle, situación por la cual ya son más de 20 detenidos.
Con todo ese operativo, Mantienen el cerco policiaco sobre la comunidad de San José del progreso, en tanto las comunidades de Magdalena Ocotlán y Santa Lucia, El Maguey Largo, se están reorganizando, para liberar el cerco policiaco sobre San José del Progreso, Ocotlán, así como realizar acciones para la liberación de los detenidos.
Los intentos de dialogo, han sido nulos con la Secretaria del Medio Ambiente (SEMARNAT) y la SECRETARIA DE ECONOMIA, PROFEPA, COMISION NACIONAL DEL AGUA, Y CON LA SECRETARIA DE GOBERNACION, instituciones que son las que dan los permisos de acuerdo a un estudio de impacto ambiental que la minera CUZCATLAN presenta, y que debe darse a conocer a los dueños originales de las tierras.
Pero han podido mas los engaños, las mentiras de la empresa CUZCATLAN, pues como se ve el día de hoy el gobierno federal y estatal están dando todo el respaldo a las inversiones mineras, sin considerar la opinión de los pueblos, que van a ser afectados por las consecuencias de envenenamiento de agua, suelos, atmosfera, por el ruido, la destrucción de los cimientos de las casas, a consecuencia de las explosiones que con dinamita por las noches ha realiza la empresa minera; ninguna de las acciones que pacíficamente hemos realizado ha podido sensibilizar a las autoridades para que la petición de los pueblos sean escuchadas, así lo demuestra el respaldo que Felipe Calderón el 21 de abril, da a conocer en cadena nacional y en periódicos, a las inversiones mineras en México, lo que demuestra que el gobierno espurio de Felipe calderón se ha puesto de rodillas ante las empresas extranjeras.
Ante esta situación exigimos:
• Alto a la brutal represión y violación de los derechos humanos que está cometiendo el gobierno nacional y estatal.
• Libertad inmediata de los presos políticos de las comunidades del Valle de Ocotlán y del estado de Oaxaca.
• Salida inmediata e incondicional de las mineras que envenenan el agua y destruyen el medio ambiente.
• Que la Comisión Nacional de Derechos Humanos (CNDH), garantice la seguridad física y psicológica de los detenidos y que se pronuncie en contra de la violación de los derechos humanos cometidos en el desalojo.
• Fuera de Oaxaca el criminal Ulises Ruiz Ortiz.
Les pedimos a las organizaciones y personalidades nacionales e internacionales que se pronuncien en contra de la represión y violación a los derechos humanos que se está cometiendo en México contra los indígenas que defienden el medio ambiente y sus recursos naturales, enviando cartas de repudio al gobierno de México y del estado de Oaxaca, a las embajadas mexicanas en sus respectivos países, y donde tengan condiciones, hacer manifestaciones de repudio a estas acciones de los gobiernos espurios de Felipe Calderón y Ulises Ruiz Ortiz.

LOS GOBIERNOS DE FELIPE CALDERON Y ULISES RUIZ, REPRIMEN A LOS PUEBLOS DE OAXACA QUE DEFIENDEN EL MEDIO AMBIENTE Y SUS RECURSOS NATURALES
El día de hoy miércoles 6 de mayo del 2009, alrededor de las 8:30 de la mañana, con lujo de violencia; utilizando gases lacrimógenos, con disparos de diversas armas de fuego, perros policías, golpeando salvajemente a los compañeros y canteando sus domicilios, a quienes pacíficamente estaban resguardando el acceso de la mina, entraron más de 2500 efectivos de la policía FEDERAL, AFI, JUDICIAL, DEL CUERPO DE BOMBEROS; también fueron golpeados los medios de comunicación que se encontraban presentes y se les bloqueo el acceso, desde temprano estaba sobrevolando un helicóptero, como a 15 o 20 metros de altura, atemorizando a la población.
De manera general han detenido a 20 compañeros: Ignacio Vásquez Gómez, Hilario Vásquez, Joaquín López, Víctor Sánchez Martínez, Juan García, Elías López, Bernardo Vásquez Gómez, Silvino Vásquez Mérida, Alfonso Ruiz, Alfonso Rodrigo López, Luis Ruiz Martínez, Víctor Ruiz Martínez, Juan Carlos López, Agripina Vásquez Sánchez, Bernardo Vásquez Sánchez, Víctor Ortiz Hernández, Apolinar García, Carmela González, Ubaldo González, todos ellos de San José del Progreso y Alejandro Aquino Cosme de Magdalena Ocotlán.
Entre las 12:00 y las 12:30 hrs., han reforzado los cercos policiacos de todas las corporaciones para catear casa por casa al municipio de Magdalena Ocotlán e incluso detienen a quien anda en la calle, situación por la cual ya son más de 20 detenidos.
Con todo ese operativo, Mantienen el cerco policiaco sobre la comunidad de San José del progreso, en tanto las comunidades de Magdalena Ocotlán y Santa Lucia, El Maguey Largo, se están reorganizando, para liberar el cerco policiaco sobre San José del Progreso, Ocotlán, así como realizar acciones para la liberación de los detenidos.
Los intentos de dialogo, han sido nulos con la Secretaria del Medio Ambiente (SEMARNAT) y la SECRETARIA DE ECONOMIA, PROFEPA, COMISION NACIONAL DEL AGUA, Y CON LA SECRETARIA DE GOBERNACION, instituciones que son las que dan los permisos de acuerdo a un estudio de impacto ambiental que la minera CUZCATLAN presenta, y que debe darse a conocer a los dueños originales de las tierras.
Pero han podido mas los engaños, las mentiras de la empresa CUZCATLAN, pues como se ve el día de hoy el gobierno federal y estatal están dando todo el respaldo a las inversiones mineras, sin considerar la opinión de los pueblos, que van a ser afectados por las consecuencias de envenenamiento de agua, suelos, atmosfera, por el ruido, la destrucción de los cimientos de las casas, a consecuencia de las explosiones que con dinamita por las noches ha realiza la empresa minera; ninguna de las acciones que pacíficamente hemos realizado ha podido sensibilizar a las autoridades para que la petición de los pueblos sean escuchadas, así lo demuestra el respaldo que Felipe Calderón el 21 de abril, da a conocer en cadena nacional y en periódicos, a las inversiones mineras en México, lo que demuestra que el gobierno espurio de Felipe calderón se ha puesto de rodillas ante las empresas extranjeras.
Ante esta situación exigimos:
• Alto a la brutal represión y violación de los derechos humanos que está cometiendo el gobierno nacional y estatal.
• Libertad inmediata de los presos políticos de las comunidades del Valle de Ocotlán y del estado de Oaxaca.
• Salida inmediata e incondicional de las mineras que envenenan el agua y destruyen el medio ambiente.
• Que la Comisión Nacional de Derechos Humanos (CNDH), garantice la seguridad física y psicológica de los detenidos y que se pronuncie en contra de la violación de los derechos humanos cometidos en el desalojo.
• Fuera de Oaxaca el criminal Ulises Ruiz Ortiz.
Les pedimos a las organizaciones y personalidades nacionales e internacionales que se pronuncien en contra de la represión y violación a los derechos humanos que se está cometiendo en México contra los indígenas que defienden el medio ambiente y sus recursos naturales, enviando cartas de repudio al gobierno de México y del estado de Oaxaca, a las embajadas mexicanas en sus respectivos países, y donde tengan condiciones, hacer manifestaciones de repudio a estas acciones de los gobiernos espurios de Felipe Calderón y Ulises Ruiz Ortiz.

la policía ingresó a Magdalena Ocotlán, Oaxaca donde allanaron domicilios y golpearon brutalmente a los pobladores en sus propios domicilios, dando como resltado al menos 29 detenidos muchos de ellos sacados de sus casas.

Cientos de camionetas y camiones de policía, con policías fuertemente armados fueron movilizados para "recuperar" la mina cuando en la mina no habia más que gente que sin armas exige que la mina ya no contamine su agua los enferme y mate a sus animales que son muchas veces lo unico que tienen para sobrevivir en este Oaxaca de injusticia y contrarstes, por un lado un pueblo que sólo exige que ya no se le afecte y por el otro la respuesta del estado exagerada, desproporcionada, ventajosa como ha sido.

OAXACAN COLLECTIVE FOR THE DEFENCE OF TERRITORIES
The Oaxacan collective for the defense of territories, indignant in the face of the current events in which the zapoteco brothers of ‘San José del Progreso, Magdalena Ocotlán’ and surrounding communities were brutally attacked and detained whilst in resistance defending their territory and natural resources legitimately and pacifically, we think it is necessary to do the following:
PRONOUNCEMENT
1. We strongly condemn the use of repression and institutional violence as a solution mechanism to social conflicts, as it generates irreparable damage to the communities, which have continued to pay through shedding of blood, tortures and arrests, in order to achieve the auto-determination of its communities and in particular for the defense of its territories.
Today more than ever, in front of the international instruments of law, which guard the ancestral property of the territories of the communities, one can not take away nor ignore their legitimate property rights through the use of force and physical violence and through breaking and entering into properties.
It is not possible, nor can we permit that the State and the transnational businesses continue with their colonialist attitude of blood and fire against our communities.
2. We pronounce ourselves against the modifications and changes of Mexican legislation which for more than a decade has opened the path for transnational companies to brutally tread on communities, where extracted mining is of the cruelest examples.
3. Therefore we back the fight that the landowners from San José del Progreso are implementing in a pacific and legitimate fashion against the silver and gold mining exploration and exploitation project set out by the Compañía Minera Cuzcatlán, a subsidiary company of the Canadian company Fortuna Silver Mines ltd.
4. Those of us who live with the threat of mega-projects like those which the brothers of San José del Progreso are now having to face, understand that it is not possible to accept another attitude in the face of the imposition of these projects which, hiding behind the mask of development, aim to become more powerful through the richness of our communities. In the specific case of San José del Progreso, the project will cover more than 40,000 hectares of the Valle de Ocotlán area and according to the business’ own data, they hope to obtain around 50,000,000 ounces solely in silver, which is the equivalent to more than 12 thousand million Mexican pesos.
5. We hold the President of the Republic, the State Governor of Oaxaca, as well as the Preventative Federal Police, the Preventative Police of the state of Oaxaca and the State Agency for Investigation (which used to be the ministerial police) of the general attorney’s office for justice in Oaxaca amongst others police bodies to blame for all the violations against human rights that the have committed in the operative which took place today when entering the community of San José del Progreso at around 09.00 in the morning; at the same time, we hold them responsible for the physical and emotional state of more than 25 prisoners.
6. Responsabilizamos al Presidente de la República, al Gobernador del Estado de Oaxaca, así como a la Policía Federal Preventiva, la Policía Preventiva del Estado de Oaxaca y la Agencia Estatal de Investigación (antes policía ministerial) de la Procuraduría General de Justicia de Oaxaca entre otros cuerpos policíacos, de todas las violaciones a los derechos humanos que han cometido en el operativo llevado a cabo el día de hoy al ingresar cerca de las 09:00 de la mañana a la comunidad de San José del Progreso; asimismo, los responsabilizamos de la integridad física y emocional de los más de 25 detenidos.
For this reason, we demand:
* The immediate liberty of those who are detained in the police operative, as they have not committed any crime.
* Investigation and punishment to areas of the police which attacked and abused their use of force in the operative which took place today in the community of San José del progreso.
* That peace and tranquility is guaranteed by the communities in the region of ‘del valle de Ocotlán’ which were affected by the mining.
* That the governments solve their problems related to mining though a dialogue and the respect of human rights and the right of indigenous communities.
* The immediate suspension of the exploration concessions given to Fortuna Silver Mines ltd, as well as the other concessions of this type on the communities in the area of Santa Catarina Minas, San Jerónimo Taviche, San Pedro Taviche, La Garzona, Praxedis de Guerrero y San Jacinto Ocotlán, as well as through Oaxaca.

Responsabilizamos al Presidente de la República, al Gobernador del Estado de Oaxaca, así como a la Policía Federal Preventiva, la Policía Preventiva del Estado de Oaxaca y la Agencia Estatal de Investigación (antes policía ministerial) de la Procuraduría General de Justicia de Oaxaca entre otros cuerpos policíacos, de todas las violaciones a los derechos humanos que han cometido en el operativo llevado a cabo el día de hoy al ingresar cerca de las 09:00 de la mañana a la comunidad de San José del Progreso; asimismo, los responsabilizamos de la integridad física y emocional de los más de 25 detenidos.
For this reason, we demand:
* The immediate liberty of those who are detained in the police operative, as they have not committed any crime.
* Investigation and punishment to areas of the police which attacked and abused their use of force in the operative which took place today in the community of San José del progreso.
* That peace and tranquility is guaranteed by the communities in the region of ‘del valle de Ocotlán’ which were affected by the mining.
* That the governments solve their problems related to mining though a dialogue and the respect of human rights and the right of indigenous communities.
* The immediate suspension of the exploration concessions given to Fortuna Silver Mines ltd, as well as the other concessions of this type on the communities in the area of Santa Catarina Minas, San Jerónimo Taviche, San Pedro Taviche, La Garzona, Praxedis de Guerrero y San Jacinto Ocotlán, as well as through Oaxaca.
