Inter-American Court Finds Haiti Is Vilating Human Rights of Former PM Yvon Neptune
The Inter-American Court of Human Rights (IACHR) sharply criticized Haiti’s current and former governments for their treatment of former Prime Minister Yvon Neptune in its first-ever case involving Haiti. Port-au-Prince, Haiti, July 10, 2008—The Inter-American Court of Human Rights (IACHR) sharply criticized Haiti’s current and former governments for their treatment of former Prime Minister Yvon Neptune in its first-ever case involving Haiti. It found Haiti responsible for violating 11 different provisions of the American Convention on Human Rights and ordered the government to pay Mr. Neptune $95,000 in damages and costs.
The Inter-American Court’s 60-page judgment, made public June 6, denounced nearly every aspect of the State’s treatment of Mr. Neptune. It found that the Interim Government of Haiti (2004-2006) illegally imprisoned the former Prime Minister in inhumane conditions for two years. The Court found that Haiti’s current constitutional government continues to violate Mr. Neptune’s human rights by inexplicably failing to serve an April, 2007 appeals court decision that would help end Mr. Neptune’s legal struggles. By refusing to serve the order, the Court said Haiti is keeping Mr. Neptune in a state of “absolute judicial insecurity” and perpetuating “an unjustifiable delay in access to justice.”
“It is regrettable that the Inter-American Court’s first case on Haiti finds that a democratic government is violating human rights,” says Haitian attorney Mario Joseph of the Bureau des Avocats Internationaux, who appeared as an expert before the Court. “I hope the Préval administration uses this decision as an opportunity to end Mr. Neptune’s persecution, free the remaining political prisoners detained since the Interim Government, and improve prison conditions.”
Mr. Neptune was one of hundreds of political opponents imprisoned by the Interim Government of Haiti, which assumed power after the 2004 coup d’état against President Jean-Bertrand Aristide. Mr. Neptune spent 25 months in jail, almost half of it in the squalid and overcrowded National Penitentiary, on the orders of a judge who never had jurisdiction over his case, according to Haitian and international courts. Several of his co-defendants also have cases remaining against them; one is still in jail, four years after his arrest, with no trial in sight.
“Haiti’s government certainly faces many challenges today,” says Brian Concannon Jr., Mr. Neptune’s lawyer before the IACHR. “But officials serve appeals court orders every day-- the government could easily do that tomorrow. The government could make a good-faith gesture by apologizing to a Prime Minister who has suffered four years of political persecution, and promising to end the persecution now.”
“This decision shows the interim government's complete disregard of elementary due process, by carefully explaining how the government failed to live up to 11 different human rights standards” said Naomi Roht-Arriaza, Professor of Human Rights Law at the University of California Hastings College of Law (Professor Roht-Arriaza and Hastings students helped prepare Mr. Neptune’s case). “The Inter-American Court demonstrates that Mr. Neptune never should have been arrested in the first place. At every step of the way, the justice system was distorted to keep a political opponent quiet.”
The Court ordered Haiti to resolve Mr. Neptune’s legal status as soon as possible, and to pay him a total of $95,000 in costs and damages. The Inter-American Court of Human Rights, headquartered in San José, Costa Rica, judges claims of human rights abuse by the 22 countries in the Americas, including Haiti, that have submitted to its binding jurisdiction. By the presente, we, the workers victims of the CD Apparel in Haiti want to attract the attention of the public opinion nationnal and international that the company Hanesbrands inc. (Hbi) is liveliness of itself in a manner disnonest defend when she declare that the work which is done in Haiti through internet by the workers is a companion of denigrement and of slander. By there, Hanes wants to hide the truth and destroy the light on the bad situation of the workers of the CD Apparel that itself caused for the decision to close in a manner brutal and illegal the CDApparel (HG) was taken by the persons in charge of Hanes May 4 2007 since this day more one than 500 workers are on the paved having Heavy responsibilities a lot money for bank and children to send to the school. They want to be damaged as all the others plants. We want sharply that the defenders of the human rights and the representants of the union organizations as well as the bosses of Hanes send their delegations in Haiti to CD Apparel s.a, Industrial Park (SONAPI) #31 in order to meet the workers for their information and to do the light on the question because carries it workers remained opened to all negotiation...

The haitian social legislation in his item gives legal provision to the workers to seize the goods, furnish and buildings while awaiting that the parties find a compromise that their permit of resolve the conflict. The code of conduct and the social legislation american done obligations to the company Hanes to compensate the workers of CD APPAREL as this some is the case for: Puerto Rico, Mexico, Canada, U.S.A and the last one in dates the Dominican republic. Industrial Workers of the World, a rank-and-file union representing
workers in a number of nations and a variety of industries, I became
aware of the ongoing struggle of 500 factory workers from cd apparel in sonapi who lost their
jobs as a result of actions taken by your company adding to their bad situation after the heartquake destroyed the poor Haiti on Jan 12, 2011. In this case you are
unaware of the circumstances, these workers were employed by a company
called CD Apparel which was under direct contract with Hanes Brands,
Inc. In May of 2007 Hanes Brands withdrew its contract from CD
Apparel, without any kind of notice as demand the code of conduct and the international socio-legislation on work forcing its closure very brutally, and moving that contract to another
plant in Haiti.
While these workers are standing to claim full compensation for price of 4 years of excellents jobs made for the profit of the leaders of hanes and theone of cd apparel's contractor but nothing for these poor workers living in a dark misery very special!
Of more i need the kind support of all international organisation to demand from hanes/inc " Damages and Repairs for these poor employees and thier high cost of living must be taken into
consideration, they have not been compensated in the by any employer for whom
that workers employed under contract by your company in other parts of
the world have been compensated, when in a similar situations.
It is my belief that this amounts to discrimination against the people
of Haiti who deserve far better treatment.
Haiti is a nation gripped
by rampant hunger and unimaginable poverty.
Rather than corporations

their responsibility to use some of those profits to make life better

We write to you as representatives of workers from the CD Apparel factory in Port-Au Prince, Haiti at Sonapi industrial park building # 31. As you know, on May 4, 2007 the Leaders of Hanesbrands ended their contract with CD Apparel S.A without sufficient warning throwing into jeopardy the livelihoods of over 500 workers and their families. The abusing cancellation and illegal closure of CD Apparel’s Plant by the responsibles of Hanes violates Haitian labour law which requires an employer to give workers twelves months for damages without forgetting Seventy two months that the workers victims are standing up on foot to demand from Hanesbrands responsibles “ Compensation and repair for them” cause, after the brutal closure of CD Apparel on may 4, 2007 the workers can not work into any other factory and can not support their families in their socio-economic situation very very difficult in Haiti as everyone of you knows. On back pay or reminder let us tell you that the victims of CD APPAREL in HAITI at Sonapi are also owed their severances pay and benefits for seventy two months remain unpaid from May 2007 to date. We request that the leaders of Hanesbrand work with the representatives of CD Apparel’s workers to reach an agreement that will pay them their severance and benefit pay include their compensation according to the code of conduct and the international legislation for work demanding Hanes’s responsibles to do it for any Plant in any country as they done it for D.R, PUERTO-RICO, CANADA, MEXICO AND U.S.A, once cancelled their Plant. Note that the CD Apparel’s workers: from May 4, 2007 to date are considered as current employees for Hanes via the contractor and owner of this Plant ,everyday they are standing to CD Apparel’s gate at Sonapi Bldg # 31 to demand their due.
For close to four years, over 500 workers produced T-shirts for Hanesbrands. During this period, we were commended for the high quality of our work and production levels. As a corporation whose Code of Conduct promotes workers rights, we are dismayed by your corporation’s lack of response to workers in Haiti and its violation of its own principles. Without our high quality work, Hanesbrands would not have remained as profitable as it did for 4 years.It’s for that CD Apparel’s Plant has been in the Caribbean the number one for Hanes about production and quality.
Given the very bad socio- economic reality of the Workers in Haiti after the devastating earthquake adding to several hurricanes, the illegal closure of CD Apparel, the defiance of Haitian law and the violation of worker rights reflect a direct violation of your Code of Conduct and international labour rights. We request a meeting with you to discuss the severance owed to CD Apparel’s workers and a resolution of the illegal closing. Let us submit to your attention the Packing List of the materials that the director committee of Cd Apparel has sealed legally by the justice but saboted at Sonapi by lawer Evel Fanfan who has been mandated clandestinely from the boss of this Plant to realize this sabotage without the committee, guarantor of the seal and without the 500 Victims where Frantz Pilorge refuse to compensate fully the victims letting us know that Hanesbrands Pick up the containers of materials at Sonapi by violence hidely with support of the Haitian government.
