Juan's case is resolved/El caso de Juan ha sido resuelto, No Borders Camp Update, March 13

Juan Esteban Ruiz was arrested during the No Borders Camp at the U.S./Mexican border on November 11, 2007, while playing the drum, in other words, using his rights to free speech, peaceful assembly, and redress of grievances specified by the first amendment to the U.S. Constitution. He was charged with two counts of assaulting a federal officer. The charge was reduced to "interfering" with a federal officer. The case is now closed, as detailed below.

Juan Esteban Ruiz was arrested during the No Borders Camp at the U.S./Mexican border on November 11, 2007, while playing the drum, in other words, using his rights to free speech, peaceful assembly, and redress of grievances specified by the first amendment to the U.S. Constitution. He was charged with two counts of assaulting a federal officer. The charge was reduced to "interfering" with a federal officer. The case is now closed, as detailed below.

Federal case completed

On Feb. 19, 2008, Juan appeared in Federal Court in San Diego on charges stemming from his participation in a protest at the U.S.-Mexican border on Nov. 11, 2007. We are happy to report that his case was resolved without endangering his immigration status. Juan agreed that he had been present at the protest, playing his drum, and had been too close to the Border Patrol officers. The judge commended Juan for his volunteer work and social activism and said that he wished more young people were as engaged as Juan. The letters of support from Juan's teachers, family, friends, fellow activists and community members, were very helpful in showing the judge and prosecution about Juan's open and caring character. Juan is back in Madison, Wisconsin. He needs to complete 100 hours of community service - never a problem for him! - and will be on probation for 2 years. After that, we hope that Juan will attain his U.S. citizenship. He is truly "one of ours" and deserves the protection of citizenship. We don't anticipate any further legal costs for this case, though he will need help for naturalization in the next few years. We thank everyone for their support. Truly, he would not have been able to do this on his own. Gracias a todos.

Juan Esteban Ruiz fue arrestado durante el Campamento Contra las Fronteras en la frontera entre los EE.U.U. y México el 11 de noviembre de 2007, mientras tocó el tambor, en otras palabras, ejercer sus derechos a la libertad de expresión, asamblea pacifica, y la reparación de daños especificado por la primera enmienda de la constitución de los Estados Unidos. El fue acusado de dos cargos de asaltar un agente federal. Este cargo fue reducido a "interferir" con un agente federal. Su caso ya esta cerrado, como esta detallado abajo.

Caso federal terminado

El 19 de febrero de 2008, Juan se presentó en el tribunal federal de San Diego para cargos relacionados a su participación en la manifestación en la frontera de los E.E.U.U. y México el 11 de noviembre, 2007. Estamos felices reportar que su caso fue resuelto sin poner en peligro su estado inmigratorio. Juan se acordó que estuvo presente en la manifestación, que tocó su tambor y que estaba demasiado cerca a los agentes de la Migra. El juez elogió a Juan por su trabajo voluntario y su activismo social y dijo que deseó que más jóvenes sean tan comprometidos como Juan. Las cartas de apoyo de los maestros, familia y amigos de Juan y de sus camaradas activistas y miembros de la comunidad eran muy útiles para mostrar el carácter abierto y cariñoso de Juan al juez y la prosecución. Juan ya ha vuelto a Madison, Wisconsin. ¡Tiene que cumplir con 100 horas de servicio comunitario - nunca un problema para él! - y estará en probación por 2 años. Despues de eso, esperamos que Juan obtendrá su ciudadanía estadounidense. El verdaderamente es "uno de nosot@s" y merece la protección de ciudadanía. No anticipamos que habrá más gastos legales para este caso, aunque el necesitará ayuda para su naturalización en los años que vienen. Agradecemos a todos por su apoyo. Verdaderamente, él no pudiera hacer todo esto sólo. Gracias a todos.
