The govt is seeking a five year mandatory minimum sentence for
cultivation of only a little more than 100 plants. This is an
unusually stiff sentence (it is highly unusual for the federal
government to prosecute cultivation cases involving fewer than 500
plants; however, the Eastern District of California has seen an
upsurge in petty prosecutions for medical marijuana under the
leadership of US Attorney McGregor Scott.

defendants are in delicate health and have three teen age children
and two grandchildren living at home with them. They were the first
medical marijuana defendants to be arrested under the Bush
administration, just weeks after 9/11. As is usual in federal
trials, they were not allowed to invoke medical marijuana or Prop 215
in their defense.
