Juan's charges reduced! Cargos contra Juan reducidos! No Borders Camp Update, December 19

Good news from the court hearing today in San Diego. The government has dropped all felony charges against Juan Ruiz, the musician who is seen in the videos dancing before he is violently thrown to the ground and beaten by several Border Patrol agents . Instead, they are charging him with a class C misdemeanor of impeding a federal officer. Juan pleaded "not guilty" to this charge. The next hearing date is January 22, 2008 for motions related to this case. The trial, if it should be needed, is scheduled for Feb. 4, 2008. Most likely, the judge will allow Juan to return to Wisconsin in the interim.

It is likely that the support shown to Juan by folks who signed the petition and wrote letters, etc, was instrumental in helping the prosecution to see Juan as the good kid that he is. We really appreciate everyone's support and thank them.

While this is certainly better than the initial charges, it may still be a problem for Juan's immigration status and ability to obtain US citizenship. We will be consulting with immigration attorneys, as has his attorney in San Diego, and proceeding cautiously.

Next steps: 1) help Juan get home to Wisconsin, 2) legal help with immigration, 3) prepare defense for this case 4) fundraising for transportation and legal costs. Donations are still needed!

Buenas noticias de la vista hoy en San Diego. El gobierno ha retirado todos los cargos de delito grave contra Juan Ruiz, el musico que se ve en los videos bailando hasta que esta asaltado y golpeado por un grupo de agentes de la Migra . En cambio, cargarán a él con un delito menor de clase C por impedir a un agente federal. Juan se declaró "no culpable" a este cargo. La próxima vista es el 22 de enero de 2008 para mociones relacionadas al caso. El juicio, si es necesario, es programado para el 4 de febrero de 2008. Es probable que el juez permitirá a Juan a volver a Wisconsin hasta el juicio.

Es probable que el apoyo a Juan mostrado por la gente quien firmó la petición y escribió cartas, etc. fue decisiva para ayudar a la prosecución ver que Juan es el buen chico que es. Verdaderamente apreciamos el apoyo de todos y les agradecimos.

Aunque este resultado es sin duda mejor que los otros cargos, todavía podría ser un problema para su situación de inmigración y habilidad a obtener ciudadanía estadounidense. Consultaremos con los abogados de inmigración, como ha hecho su abogado en San Diego, y proceder con cuidado.
