The dubious evaluation by the Agency for Toxics and Substance Disease Registry on Parcel A
The Agency for Toxics and Substance Disease Registry (ATSDR) is a Federal Agency that mostly takes orders and follows them. This Federal Agency does not conduct independent tests and as such reviews current and old data. In this case dubious data provide by Lennar BVHP LLC. But, the ATSDR this time went further when it had the California Department of Public Health - prepare the report and in doing so - two agencies one Federal and the other State - failed to do the right thing by the community living in and around Parcel A at Bayview Hunters Point.
Much has been made by Lennar BVHP LLC and other sell outs that are on Lennar BVHP LLC pay roll - about the report by California Department of Public Health and the Agency for Toxics Substance and Disease Registry (ATSDR), linked to Parcel A and Bayview Hunters Point.
For over two years both these agencies one Federal and the other State did not visit the community living in and around Parcel A - in the Bayview Hunters Point area.
Then when the community demanded an independent testing of those community members adversely impacted - the San Francisco Health Department met with Lennar BVHP LLC to find a way out.
They decide to invite the ATSDR and the California Department of Public Health to do their dirty work. It will not work. Parcel A has issues and will always have issues and very serious issues at that. Parcel A also has to deal with Cumulative Pollution from a Superfund Site surrounding it.
The dubious plan to conduct an investigation was to send a Federal Agency that has NO track record of doing the right thing and very dubious in nature. Check out their track record by visiting the Environmental Protection Agency site: http://www.epa.gov
So, out came Captain Susan Muza from the ATSDR, first to our Town Hall meeting and then she met some of us - and we took our time to explain our situation and gave her the facts of the matter at hand.
After listening to us she told a group of about 15 people that she was under political pressure and that she had to deal with MONSTERS.
She also made it clear to us that her Agency could not conduct independent tests and that all she could do is review the data that is available to her agency and in this case given to her by Lennar BVHP LLC.
Lennar BVHP LLC as you know did not have dust monitoring equipment and no Asbestos Monitoring Equipment for over four months.
Lennar BVHP LLC had hundreds of exceedences all documented - but the SF Health Department did not fine them.
I reported this to the State agency for Occupational Safety and Health Administration and was given a reply three months later. One of the sub-contractors were fined a measly $125. The letter was signed by one Cora Gherga.
Captain Susan Muza had the California Department of Public Health to evaluate and do the report on Parcel A - even though most people think the ATSDR did the report.
The California Department for Public Health was also present at the meeting with the community - just one person from the Department with Captain Susan Muza - present.
The report does mention in parts the harm done to the community. The report does admit the migration of toxic dust from Parcel A to the area where the community was adversely impacted.
The report fails to make note of heavy metals that we have found through recent tests that have very high levels of Lead, Mercury, Arsenic, Chromium, Barium and so on - playing havoc on the health of the constituents living in and around Parcel A and beyond.
Primarily these very heavy metals have adversely impacted our children, elders, and those that already have their health compromised. It has also affected the general population in a 3 mile radius.
The report tries to play down the issue of Asbestos from the crushed Ultramaphic Serpentine Rock that is denser and not the common Serpentine Rock found all over California.
The 16,000 structures per cubic meter cap set for this large project and the long hours of exposure both to the workers who wore no protective gear and the community at large that were NOT noticed - will decided in the courts.
Any decent, qualified toxicologist who reviews the data that is factual will agree with the constituents and the community at large. Hundreds of people with nose bleeds, breathing problems, sore and burning throats, loss of sleep, and so on rushed to hospitals - need testing.
Once this is done - we can rest our case. But, the crooks know they have to face liability and are afraid to do the right thing. Our children and elders must be tested - now.
Captain Susan Muza fully comprehends the nature of the issues but has chosen to listen to corrupt politicians rather then do the right thing. I have written to her about this fact.
There is the Environmental Protection Agency that can step in and conduct the required tests and over rule the Mickey Mouse report from the ATSDR and the California Department of Public Health.
In the interim the San Francisco Unified School District has voted through the Board of Education in favor of first halting the project and then testing the children. The vote was unanimous.
I am posting the report initiated by the ATSDR for you all to read and make your own conclusions.
The world is watching this situation which is complicated because Lennar BVHP LLC has chosen to lie, with intent harm our children and elders, buy folks to make them do their bidding, and in the process - failed.
