Manny Gonzales the kid everyone forgot in the CA prison system
Seventeen year old Manuel Gonzales was convicted of attempted premeditated murder with a handgun April 11, 2005 in Van Nuys CA. Manuel was sentenced to serve 27years in a CA prison without any possibility of early parole. The 23year old victim in this case was shot at three times and nicked on top of his shoulder requiring a two hour hospital visit (no stitches ) and was released with pain medication.

Forty days later this victim changed his mind and Manuel Gonzales was arrested instead.The prosecutor at Manuel's trial was informed by the presiding judge before the trial began, that she and her witnesses who would be testifying in court were not to ever mention anything relating to gangs or attempting to connect this case to a gang related incident. Unfortunately for Manuel Gonzales the prosecutor never followed the judges orders and Manuel was convicted by a compromised jury in little over one hour of deliberations.
The public defender who represented Manuel at his trial asked the judge more than once to declare a mistrial as soon as it became apparent that his client (Manuel) could no longer receive a fair trial guaranteed him by our constitution. The judge in this trial had to remind the jury that there was no gang related evidence in the case and she had comments stricken from the court records that kept attempting to mislead the jury into believing that this trial was somehow connected to gang activity.
We all know that CA taxpayers finance trials and it would be very tragic for all of us if any of our judges feel forced to allow trial cases to continue with tainted juries due to cost restraints put on them by a lack of state funding.A new trial for Manuel Gonzales would have cost CA taxpayers $6,000 and would have given this 17year old kid his day in court. The sad irony here is that there is over $1,000,000 available to incarcerate Manuel Gonzales for the next 27 years in the CA prisons, while at the same time judges are being forced to pinch pennies and possibly deny new trials when warranted.

Currently this case is on appeal and needs financial backing for a real lawyer to submit a proper appeal so Manuel could have a new trial.I know with the evidence that was presented in this court case, had Manuel been able to afford a real attorney at his initial trial, he would definitely be a free man today.

Follow the money! After all these public trials of the rich and famous getting away with murder, it should come as no suprise that the poor folks children are doing hard time

To all those better able to assist Manuel Gonzales in seeking justice here in the LA courts my prayers are with you.The courts did not give
me a attorney that wanted to represent me either.I guess us poor guys
should never go to trial,we should just take a plea bargain.I wanted to defend myself,but was told by friends and family that it would cost too

lawyer to represent them.This basic need has always been overlooked
by our government leaders and it really needs to be talked about in our
next election debates.

Why would our state Government spend 5 times more money putting our youth in prison who have never gotten fair trials to only wait at taxpayer expense for our State Supreme Court to issue them a new trial in two years. New trials are very cheap compared to the cost of housing each inmate in our prison system. Had this judge called a mistrial in Manuels case, the state of CA would have saved $ 100,000 and not forced this kid into prison (for three years)to begin with. Why is this state not ordering up new trials and attempting to administer justice to our poor? How does this state rationalize sending a minor to prison for 27 years when the supposed victim was never really

I encourage us all to take a real good look at what happened to this minor Manuel.He enters our LA court system with A Public Defender and appears in front of a judge who attempts to protect this young mans right to a fair trial.The judge rules that the case is not gang relate and instructs the DA to not attempt to use any gang related testimony etc. This DA knows she does not have to listen to this judge because the judges never order new trials when DA's use gang information
in order to influence naive juries to convict defendants.This is common practice here in LA and

Hispanic's are an equal part of our American society and I resent this type of mistreatment of Manuel Gonzales. This case needs a full investigation by independent outsiders.President Hugo Chavez might be just the right ticket here!!!
It is true that many a public defender has failed their poor clients and simply blamed other reasons as to why their client was sent to prison. I agree that everyone in this country has just accepted the fact that if your rich you get good lawyers and if your poor you get others.I do not

After reading stories last week from Venezuela about Our Secretary of defense ( Mr. Gates ) telling President Hugo Chavez to only spend his countries monies in his country, I quickly came to the conclusion that America 's mistreatment of our poor will be documented to the rest of the world if Mr Chavez assists Manny. Poor American's only deserve Public Defenders and jail time, while the rich and famous go free!!

What a tragic situation we all find ourselves with here in this beautiful city of ours. Justice in our local courts needs to be closely looked at.The Justice Dept. needs to be brought in on this one.If indeed we have hundreds of falsly convicted due to improper conduct by our DA's being allowed to mislead juries with hearsay ( over presiding judges oders not to attempt to use gang attatchment comments at trial) that is used to get convictions out of local juries, then everyone who went into prison due to this injustice should be ordered a new trial.

They are back at it ! Creating student protests for President Hugo Chavez of Venezuela seems to be something our CIA is getting rather good at. i guess President Chavez needs to be sent a little message that he should only take care of his own people and not get involved assisting American poor in our prisons with their legal appeals. The Citgo Freedom Foundation would become an American Non Profit organization that could help all poor Americans that have been incarcerated due to lousy legal representation in our courts. This business of public defenders needs to be corrected so all Americans have an equal chance in our STATE and FEDERAL COURTS.If it takes President Chavez to bring home this fact,then so be it. I find it appalling that this type of hate injustice could of happened in the Van Nuys court to Manny Gonzales. We all have to accept the Mexican community and their off spring. This injustice has to be reversed and stopped from ever happening to any other Mexican American kid in our local courts.this presiding judge was out to lunch on this one. thank god we live in a democracy where this type of injustice can be resolved.Manny Gonzales represents this Mexican American community here in LA and we all need to priotect evryones right to fair trials here.

This horrific abuse of Manny Gonzales attempting to receive his right to a fair trial is also coupled with a 27 year mandatory sentence (without any possible early release) ending with this 21 year old being forced from inside prison to come up with his own appeal to submit to the CA Central District Federal Court in Riverside California. Where is the investigative reporting on the lack of resources for poor prison inmates ? Being in prison without any possible attorney to help with an appeal seems very third world instead of what we expect from our govenment. Our poor being kept behind prison walls need to be treated fairly and never should have to deal with this obvious neglect that our US Congress has inflicted on them. Everyone in a American prison that needs to appeal their case to a Federal Court is on their own financially. If you have the finances yourself to pay appeal lawyers to represent you in this situation your in the minority. Most of our prison population can't afford the legal fees associated with these type of appeals (average $30,000 ) and are forced from their prisons to either write their own paperwork or attempt to find a attorney to volunteer their time to help them out. There is no realistic way to explain why our Federal Courts and judges have allowed our poor defendants in our prisons nationwide to be without appeal attorneys when they want their convictins in criminal cases to be retried. If the reasoning for this obvious neglect by our US Congress is blamed on the lack of Federal finances, then what might be the problem with President Hugo Chavez of Venezuela or other world leaders having more of an interest in assisting Americas poor in our prisons who really have no one else to help them ? Wow. You folks seem to have been very active on the site, but it's not really contributing to his liberation. The lack of faith in Manny himself that comes from "(he) has only a GED and obviously is not up to the task of being his own best lawyer" is really pretty gross. A GED doesn't mean you don't know how to read or can't study law... I'd suggest that his supporters contact the National Lawyers Guild to find a lawyer for him.

I have read about this Manny Gonzales case on various sights on the web and have looked at close to 100 various accounts by other readers of what happened to Manny Gonzales and I'm shocked that this also could be happening to thousands of other Americans nationwide? Since America has always given foreign aid to other countries to assist their development, it should come as no surprise if other leaders of foreign countries start to contribute to Americas poor in our US prisons as a offering of goodwill also. I have read about this Manny Gonzales appeal case and marvel at the revelation that thousands of poor Americans like MR Gonzales are being held in prisons across our country because their own shabby written legal appeals were turned down by Federal Judges. Why are we all under the impression that everyone in America has the right to be properly represented by a lawyer. I guess appeal lawyers for the federal courts are excluded for some reason ? I'm not amazed that this tragic situation exists with thousands of US poor prison inmates concerning them not being afforded their proper legal representation for their Federal Court Appeals.We all just have to assume that this countries future step will be torture. American taxpayers would save tons of $$ with this future policy.Just think after you torture these poor Americans and get the truth out of them, we all will really know who the true innocent victims are ?? I will even go so far as to venture to guess that all those 250 prison inmates who languished in our prison for 25 years would agree. I did forget to mention that these former poor prison inmates who were freed did not have their government assist them with leagal assistance for filing their appeals to the Federal Courts. We all now know that torture has been going on outside the US in our name, but very few of us have ever heard that our own poor citizens have been kept in prisons across America for endless years due to not being afforded appeal attorneys with our Federal Courts. I also am in agreement if we can't get this injustice to change, then we all might be in for a very big surpise with our own liberties in the future.All those innocent Americans accused, tried and convicted of rape languished in our prisons for decades befor DNA evidence was able to prove their innocence. If these same men had they been given federal appeal lawyers in our federal courts they might have had a chance of having their cases retried and been found innocent. Nancy, heads the US Congress and the lucky residents of the SF area are all aware that Nancy does know how to champion justice. This cost of making sure every poor American prison inmate has the ability afforded them for appeal attorneys for their federal appeals is one that is not only possible,but one that really points out the realities of living in a free society as ours.We are all very capable of calling Nancy's office to make this change for our poor in prison,or we can just pretend to live in a democracy that we could be proud of without this injustice being corrected.

I'm in total agreement with Manny Gonzales or any of the other of thousands of US prison inmates who are being denied proper legal representation to our federal courts to reach out to the international humanitarian leaders worldwide such as President Hugo Chavez so they can submit proper appeals that might win them retrials with their criminal cases.

I read that the cost of incarcerating Manny Gonzales for his 27 year sentence will be over $1,ooo,ooo fo4r the CA taxpayers.From what I read the so called victim in that case was not injured ! How can our state rationalize this expence ? I think most all Americans including the ones capable of affording their own federal appeal attorneys would agree that the denial by our US Congress of legal representation for poor prison inmates to have their federal appeal cases worked on by attorneys is unjust and needs to be changed. I have been reading various accounts of the US media attempting to correct our out of balance judicial system.If we continue to have an active media like this, our judicial system might very well be in for the proper changes without our US Congress being forced to correct these injustices

I would not bet on the Congress affording all poor prison inmates legal appeal lawyers for their federal retrial appeals. President Hugo Chavez might just be the best hope theses tens of thousands of poor prison inmates have in getting proper legal representation for their federal appeal reviews. Within the last two weeks president Chavez released from his countries prisons all the people who were involved in his attempted overthrow two years ago in Venezuela. This just act by president Hugo Chavez might just be the begining of his new international humanitarian image building. Tens of thousands of poor US prison inmates have been incarcerated here in American prisons for prolonged decades due to not being able to write their own federal appeal legal cases. When average Americans on our local juries are open minded enough to be capable of seperating active gang members from past gang member participation or friends of gang members but not actively participating in gang activity,we then might have the ability in our courtrooms to have the clear vision of being able to decide criminal legal cases fairly. Lumping all these individuals together is just as unwise as mandatory sentencing is in deciding how to punish convicted defendants fairly. Punishment based on fear of gang activity by local juries is not always going to afford real justice more then it might convict innocent citizens made to only look guilty by rogue DA's (Norht Carolina )who know how to manipulate jurors into rendering guilty verdicts in order to attempt to protect our society from those who are really perpetuating violent street crime.

This corrupt DA should have been doled out years of prison time for his misdeeds and our justice system needs to start making sure these sick people in positions of power over us all are made to understand that they themselves are not above the law. What we have here in this Manny Gonzales criminal case is a jury, judge and DA taking care of their communities safety from gangs in a typical vigilante hang him high process. The presiding judge tells both attorneys (defense and prosecution ) prior the trial that this specific case is not gang related and advises the DA to instruct their witnesses not to mention or insinuate gang association information to the jury. At this point in this trial the presiding judge is aware of and protective of the defendants rights to a fair trial, knowing darn well that if a La jury is lead to believe ( rightly or wrongly ) a defendant is affiliated with a gang that a fair trial is almost impossible. What happens when this DA decides to use gang association (over the judges denials ) on this jury is really quite devious. Most Americans are well aware that there are plenty of innocent poorer US citizens in our prison systems nationwide,but very few of us have ever heard about our US Congressional representatives denying the middle class and working poor Americans proper legal counsel for their federal appeals.If One were charged with a federal crime all legal costs are paid for,but when one is charged in the various states and run out of state appeal opportunities and need to appeal to the Federal Courts,it appears that inmates are left to their own best lawyering skills to attempt to write a federal appeal that could sway a US Federal judge to grant a new retrial.

It appears that the US Supreme Court way back in 1984 knew the injustice of our federal appeal retrial review process really only being available for affluent Americans to get benefit from.
The masses of poor and mostly uneducated prison inmates who are being forced to write their own federal appeal legal cases, are being denied new trials by the federal courts in mass all across this country everyday.
Some believe this injustice stems way back in our history to pre Civil War era when the US Southern States were railroading blacks into prolonged prison sentences and knowing all along that the Federal Courts would never grant these poor black prison inmates new trials because they never could properly write their own federal appeal legal cases.
The real horror here is that this form of injustice is even in 2008 assisting in the prolonged false incarceration of over 100,000 innocent mostly uneducated American prison inmates nation-wide.
We all know the federal appeal retrial process was designed for all Americans as a fail safe device that every American should be entitled to utilize, but it is quite obvious that our government has allowed this appeal process to slip into a completely new facade in which it has become an exclusive opportunity for only rich Americans to be able to properly benefit from.
