Court will re-convene Wednesday at 10 am and is expected to include

Today in Court - Tuesday June 19
Lawyers for the SF 8 argued to seal or suppress documents and
statements filed by the prosecutors in opposition to bail reduction.
The defense argued that the government wants to use statements made
under torture and duress as well as criminal histories filled with
factual inaccuracies dating back over 36 years to give the impression
that these Black elders are a threat to public safety or are flight
risks. The government wants to introduce documents that will not only
prejudice bail arguments but continues to criminalize these men to
the media and public. Instead the defense lawyers raised strong
challenges to statements made after people suffered electrocution,
asphyxiation, sensory deprivation and beatings. Lawyers will attempt
to clarify which documents are at issue during a closed session this afternoon.
Attorney Daro Inouye was officially appointed to represent Jalil
Muntaqim stating that he and Jalil joined in the defense motions
regarding prejudicial documents, stating that some of the materials
and old statements violate Jalil's constitutional rights if introduced.

Come to Court Thursday, June 21 at 10am, 850 Bryant Street in SF
SF 8 Court Update – Wednesday, June 20, 2007
Wednesday’s court hearing began with testimony in
support of bail reduction for San Francisco 8
brother, Ray Boudreaux. The main testimony was by
Professor of Social Psychology from UC Santa
Cruz, Craig Haney. He emphasized that elders like
the SF 8 have very little likelihood of being
risks for anti-social activity because they have
developed social connections and strong community
ties. This was in strong contrast to arguments by
the prosecutors who argued that the “desperation
factor induced by this prosecution” is sufficient
to make the men dangerous and flight risks. Craig
Haney consistently refuted these claims by citing
innumerable studies and also rejected the notion
that people who refuse to cooperate with a grand
jury investigating them, like four of the 8
brothers, are showing evidence of criminality.
The head prosecutor, David Druliner, spent over
an hour setting up a hypothetical scenario
basically laying out the contents of the SF8
conspiracy complaint, in an attempt to spin the
Attorney General’s version of events. This
“hypothetical scenario” is highly incendiary and
erroneous. Craig Haney was ultimately asked if
these events would lead him to conclude that the
participants posed an ongoing danger to society.
Haney responded clearly that this would not be
true and is not borne out by any studies in the
fields of criminal and social psychology.
Also testifying were Dr Harold Orr, the Medical
Director at Alameda County Jail in Santa Rita. He
spoke as a personal friend of Ray’s and spoke of
him as a highly responsible member of his
community. Jasmine Jackson, Ray’s granddaughter
also spoke of their close relationship.
The recent film, Legacy of Torture, was submitted
into evidence for Judge Moscone to review. The
judge will focus on the statements by Ray
Boudreaux acknowledging that the brothers knew
that they were government targets, and that their
refusal to cooperate with the Grand Jury and
government agents was based on this knowledge.
Their consistent and voluntary appearances
throughout the grand jury proceedings indicate
their commitment to fight this case and not flee.
Bail arguments will be continued in another 3
weeks, after Judge Moscone returns from vacation.
This means that the brothers will remain in jail
for the duration. It was felt by all of the
brothers and their attorneys that they would not
rush bail reduction motions as the judge had
already indicated that he would not rule
immediately anyway due to the volume of documents filed.
Thursday’s court hearing begins at 10 am and will take up discovery motions.
