Eric McDavid - Update on April 23 Hearing

On Monday, April 23, Eric finally had his hearing on the remaining defense motions.
On Monday, April 23, Eric finally had his hearing on the remaining defense motions. There were 21 motions heard on a variety of issues, including a number on 1st and 4th Amendment violations (to read some of the motions Eric's lawyer filed, visit the updates section of the website at http://www.supporteric.org).

Judge England made it through all 21 motions in less than 2 hours, systematically denying each and every one of them. He seemed to be very familiar with the governments arguments and agree with them.

On February 27, Magistrate Judge Mueller heard Eric's discovery motions. Her order was issued on March 26 - denying all but 2 of the discovery motions. The motion to release Eric's co-defendant's presentencing reports was granted in part, as well as the motion to release proffers and communications between Eric's co-defendants and the government.

While this is all terribly disappointing, we need to regroup and gather our energy for trial! The date is still set for July 2, and we have a lot of work to do before then. Eric's legal team will be hard at work preparing for trial, and we need to make sure they can continue to do their job effectively. Please keep fundraising! On Sunday, April 15, Eric ended his visit with his family early because of
medical problems. He was examined by the jail doctor and it appears he may
have a condition called pericarditis. Pericarditis is a swelling and
irritation of the pericardium, the thin sac-like membrane that surrounds
your heart. This condition often causes chest pain and other signs and

Apparently the jail began treating him with steroids and aspirin and his
condition improved. His lawyer filed a motion to have him taken to the
hospital so that he could undergo further testing and receive quality
medical treatment. On April 16 the US Marshals sent him to the hospital
immediately prior to his hearing on defense motions. For this reason the
hearing has been moved to Monday, April 23, at 10am in front of Judge
England. At the brief hearing where these decisions were made a trial date
was set. Eric's trial is currently set to begin on July 2nd in front of
Judge England. That gives us 2 1/2 months to raise the remaining $8,000
necessary for Eric's defense. We will continue to send out updates as new
information about Eric's health becomes available.
