/Federal Judge Rules Ed Rosenthal Was Vindictively Prosecuted; Trial
Continued/
ASA Chief Counsel, Joe Elford, secured a huge victory for the medical
marijuana movement Wednesday in the case of author and medical marijuana
activist Ed Rosenthal. Federal District Court Judge Charles Breyer ruled
that Rosenthal was vindictively prosecuted, and dismissed charges of tax
evasion and money laundering -- charges that were added after
Rosenthal's conviction in 2006! The remaining marijuana charges against
Rosenthal are virtually identical to those pursued against him in his
previous trial. With an admission in court by the U.S. Attorney that it
would not seek additional punishment beyond the one-day sentence for
Rosenthal's conviction, the prosecution has little reason to proceed
with the case.
"We are gratified that the court has recognized the vindictive nature of
this prosecution and has reigned in the prosecutor," said Joe Elford,
author of the successful vindictive prosecution motion. "The additional
charges brought against Rosenthal were clearly in retaliation for his
criticism of the government. Taxpayer dollars should not be wasted on a
vendetta carried out by a prosecutor against a defendant."
Judge Breyer's ruling is the result of a motion to dismiss based on
vindictive prosecution filed by Americans for Safe Access and other
attorneys with Rosenthal's legal team. The substance of the brief was
that the government was retaliating against Rosenthal for his successful
appeal and his statements to the press that his first trial was unfair.
In his ruling, Judge Breyer asserted that "the government's deeds--and
words--create the perception that it added the new charges to make
Rosenthal look like a common criminal...".
Rosenthal was re-indicted after his 2003 conviction was overturned in
April 2006 by the Ninth Circuit Court of Appeals. After finding out that
medical marijuana evidence had been excluded from the 2003 trial, a
majority of the jurors that convicted Rosenthal recanted their verdict.
Due at least in part to public outcry, Rosenthal was sentenced to one
day in jail. The government was relying on the new charges of tax
evasion and money laundering to justify the second prosecution of
Rosenthal. The court has now confirmed that Rosenthal's continued
prosecution is suspect.
In a hearing today, Judge Breyer continued Rosenthal's trial, which had
been set to start next Monday. Breyer scheduled a status conference for
April 13th at 11:00 a.m. and urged the prosecution to think long and
hard about whether they should proceed with the charges.
/9th Circuit Rejects Raich Appeal/

On Wednesday, the Ninth Circuit Court of Appeals rejected Angel Raich's
appeal, ruling that there is no fundamental constitutional right to use
marijuana for relief of pain and suffering. In a 3-0 ruling, Judge
Harry Pregerson wrote,
"We agree with Raich that medical and conventional wisdom that
recognizes the use of marijuana for medical purposes is gaining
traction in the law as well. But that legal recognition has not yet
reached the point where a conclusion can be drawn that the right to
use medical marijuana is "fundamental" and "implicit in the concept
of ordered liberty."
The court also rejected Raich's contention that the 10th Amendment
protected her right to use medical marijuana.

/Joe Fortt Sentenced to 21 Months; Cannot Leave US for Canada Yet/

Appearing in federal court in a wheelchair on Monday, January 5th,
former Bakersfield dispensary owner Joseph Fortt was sentenced to 21
months in jail. It was intended to be a sentence of time served, but
since Joe has been incarcerated for only 19.5 months, the discrepancy
became a matter of courtroom argument yesterday.
During the hearing, defense attorney Daniel Harralson requested to have
the sentence reduced by six weeks in order for Joe to be immediately
transferred to the custody of immigration authorities and await his
deportation to Canada. The prosecution staunchly opposed the request,
claiming it had already been lenient enough with the defendant. The
judge agreed, reminding the court of the seriousness of violating
federal drug laws.
Harralson also asked for transfer to a facility with better health
conditions than those at Fresno County Jail, so that Joe could more
safely serve out the remainder of his sentence. Joe just recently
underwent a month-long hospital stay to treat a severe lung infection he
developed while incarcerated.
In spite of a moving plea from the visibly ill defendant, Judge Anthony
Ishii ultimately held to the recommended 21 month term and thereby sent
Joe back to Fresno County Jail to wait for his sentence to time out.
