Update on Eddy Lepp's case
For those interested in following the Eddy Lepp case, I have a short
update.
update.
As many of you know, the evidence from Eddy's 2004 bust was thrown out last
month when a federal district judge found that the search warrant was
incomplete. Eddy is still facing charges for the 2005 raid on his property,
although the defense plans to challenge the validity of that search warrant
as well. An evidentiary hearing on this matter was planned, but the court
schedule took a slight detour because of a breakdown in the relationship
between Eddy and his public defender. On Monday, the judge granted Eddy's
request for a change of counsel, and the court will now appoint a board
attorney to his case. (Eddy, ever the comedian, said in deadpan that he was
disappointed to be getting a "bored" attorney, as he had hoped to be
assigned one who was excited about defending him.) The judge also made a
significant alteration to the case that could have a strong influence on the
outcome for Eddy and the co-defendant that has been prosecuted alongside of
him.

Eddy is scheduled to be back in front of Judge Patel for a status conference
on February 5th at 11am, at 450 Golden Gate Avenue in San Francisco, CA.
