The Red Collar Crime of Corporate America. They are white collar crimes when people die and there are usually no criminal charges against the "Corporate Executives", responsible (162). Such crimes are often "Cloaked in a Veil of Secrecy"(1), as documented in an article about Firestone tires and GM gas tanks (1). In these two instances alone (1), over 400 families took the out of court settlement in exchange for sealing the records. Allowing more American's to die, because they did not put a stop to it. They "sealed the records". The movie, "Class Action" (starring Gene Hackman) is an example of Red Collar Crime. A company knew that people would die, but it was cheaper to pay the wrongful death suits than to have a recall. So that was what they did and it was exposed in a court case, that the movie is based on. The movie Erin Brockovich is another examples of "Red Collar Crime". The point being that no criminal charges were filed. Not even for a "Failure in a Duty to Rescue (57), let alone manslaughter. Other cultures simply call such people, "Infidels". Defined as "an individual (or group of people) that fail in their moral obligation to their fellow man". The fact that someone would even argue the legal aspect of "a duty to rescue" (57) just boggles the minds of some cultures. The people in the Middle East do not tolerate such things,and death sentences for it are more the norm,as explained at WHAT IS "RED COLLAR CRIME.
"Sunshine Laws" were passed to prevent such things, but have failed. Even so, the corporations could not do this alone. They are not the only ones to blame. After learning of so many people "sealing the records" how can I say that I would not if presented with the same situation ? But now it is even worse with President Bush having signed the laws that "cap" liability law suits, last year. There is no motive for a corporation to "do the right thing". We have to change the "corporate personhood " so that corporate executives can be held criminally liable for the crimes and murders that they commit with their corporations . Corporate Crime Reporter has a rather good article about this and the
caps on liability suits. Stating that there is little to stop corporate
America from committing these "Red Collar Crimes", unless we
start to get homicide charges brought against them.
The article also involves an interview with a law professor. And besides
all of that, they do give me credit for coining the term "Red Collar
Crime", some years ago. (Started
with my Firestone tire experience. I had made this web page, some time

Besides all of that, I first learned of reckless homicide convictions

Did you not ever wonder why corporate executives are not regularly charges with homicide or manslaughter for the crimes they commit with their corporations? Maybe it is a "failure to communicate" ? Maybe other district attorney's do not know they can do this ? So far as I know, there is not a statute of limitations on homicide. Pombo joined forces with former House Majority Leader Tom DeLay of Texas to oppose an investigation by federal banking regulators into the affairs of Houston millionaire Charles Hurwitz, documents recently obtained by The Times show. The Federal Deposit Insurance Corp. was seeking $300 million from Hurwitz for his role in the collapse of a Texas savings and loan that cost taxpayers $1.6 billion. In key aspects, the Hurwitz case follows the pattern of the Abramoff scandal: members of Congress using their offices to do favors for a politically well-connected individual who, in turn, supplies them with campaign funds. And the actions of the two Californians reflect DeLay's broad strategy of cementing relationships with individuals, business interests and lobbyists whose financial support enabled Republicans to extend their grip on Congress and on government agencies as well. The system DeLay developed and Abramoff took part in went beyond simple quid pro quo; it mobilized whatever GOP resources were available to help those who could help the party. The investigation was ultimately dropped. The effort to help Hurwitz began in 1999 when DeLay wrote a letter to the chairman of the FDIC denouncing the investigation of Hurwitz as a "form of harassment and deceit on the part of government employees." When the FDIC persisted, Doolittle and Pombo — both considered proteges of DeLay — used their power as members of the House Resources Committee to subpoena the agency's confidential records on the case, including details of the evidence FDIC investigators had compiled on Hurwitz. Then, in 2001, the two congressmen inserted many of the sensitive documents into the Congressional Record, making them public and accessible to Hurwitz's lawyers, a move that FDIC officials said damaged the government's ability to pursue the banker. The FDIC's chief spokesman characterized what Doolittle and Pombo did as "a seamy abuse of the legislative process." The corporation that has been opposed by Earth First and brought Julia Butterfly" Hill into public attention for her tree sitting activism against Pacific Lumber. So far, the California Attorney Generals Office has refused to even investigate a homicide complaint that I filed (hrm49) against the Pacific Lumber Co. The logger starting falling trees at them" as he had threatened to. A protester was killed and the Humboldt District Attorney says that they "do not have enough evidence to convict". It has been estimated that Pacific Lumber has made millions of dollars from fraudulently harvested trees. But I do not have an exact or substantiated figures and that estimate is based, so far, on "hear say". Not that I would want Pacific Lumber to file a slander suit against me. There is no way that anyone could say that the Humboldt County District Attorney's Office is not under undo influence or " impartial" not to prosecute the Pacific Lumber CO for the "reckless homicide" of David "Gypsy" Chain. We even suggested allowing the logger that dropped the tree that killed Gypsy (after threatening to do so and video taped) immunity from criminal charges in exchange for testimony against Pacific Lumber. That would cinch the case against Pacific Lumber, but the District Attorney does not want to discuss it (as of yet, no response). See the attached news stories.
