California Gov Vetoes Hemp Bill
Legal Strategy Shifts to North Dakota

Are you, like me, a self-proclaimed Hempster? Is the
movement to bring back industrial hemp farming for you, like
it is for me, about sustainable agriculture, a robust national
economy, a healthy environment, our precious natural
resources, fundamental justice, basic fairness, and the
American way? Like me, are you the kind of advocate who
literally lives in hemp, eating it, wearing it, bathing with it,
writing on it, even driving in it? If so, are you sitting down?
Because, I'm not sure how you're going to take this.

On Saturday, California Governor Arnold Schwarzenegger
decided to be on the wrong side of history. He broke the trend
among nations worldwide and states across the country to let
go of old misconceptions and see industrial hemp for what it is,
a sustainable and productive agricultural crop that deserves to
reclaim its historic place as an engine of the US economy.

The California Industrial Hemp Farming Act of 2005 has been
defeated, and with it the hope that a state could claim its right
under the US Constitution to regulate the farming of a non-drug
crop within its own borders without conflicting with federal law
and triggering federal Drug Enforcement Administration action.

I hope that I can temper your dissappointment by assuring you
that there is a Plan B.

As you have read in the Vote Hemp Report, North Dakota has
been in the process of finalizing rules that implement a 1999
state law allowing the state agriculture commissioner to license
farmers to grow hemp.

While not as sexy as the California bill that would have
asserted the state's right to regulate industrial hemp farming,
North Dakota's plan to license farmers, and get the DEA to
recognize these state-licensed farmers with federal permits to
import, produce, and process industrial hemp commercially, is
an incredible breakthrough.



Vote Hemp will be going all out to make sure North Dakota is
successful. Our rallying cry is "North Dakota Hemp Crop
2007!"

In addition to supporting the efforts of North Dakota-licensed
hemp farmers to acquire DEA permits for commercial hemp
farming, Vote Hemp is going to redouble our legislative efforts.
Not only will we be spearheading the effort to reintroduce the
California Industrial Hemp Farming Act in 2007, we're going to
get industrial hemp bills introduced in states across the country
that have expressed an interest in hemp farming, but have not
yet put laws on the books.
