MMJ Victory in Modesto!

Last Monday the Modesto City Attorney called me to concede that their
attempt to close the only legal dispensary in Modesto, my client,
California Health Care, had failed.


Last Monday the Modesto City Attorney called me to concede that their
attempt to close the only legal dispensary in Modesto, my client,
California Health Care, had failed.

This is a major victory for patients in Modesto, in Stanislaus County,
and in surrounding areas. The City had passed a ban last December that
purported to retroactively close all dispensaries by July 2006.

The City will attempt to amend the ordinance, starting the process this
Tuesday (see the link to today's newspaper article below, which
includes a link to the city council agenda) by referring the matter the
Planning Commission. The Planning Commission previously opposed the ban
and favored regulation.

Now is the time for patients and activists to appear before the Modesto
City Council and the Planning Commission and tell them politely that a
ban would be pointless and counter-productive and that they need to do
their duty and regulate responsibly for safe access and the community
welfare.

This is our best chance to get regulations in Modesto and set the
example for Stanislaus County and surrounding areas.

And even as a worst case scenario, it may take them a year to get back
to the point of threatening to close the dispensary.

Safe, legal access continues in Modesto thanks to all of you in this
movement who work so hard and so well.
