Jury Selection to Begin Monday in MMJ Provider's Case

San Francisco, CA Sept 22, 2006 -- A dozen friends and patients were on hand to support Tom 'the Nurse' Juzbasic as his retrial was scheduled for jury selection on charges of selling to SFPD narc Thomas Keane #772.

Tom appeared first before Judge McBride in Department 22, who was in no mood to hear any further motions in the case, denying attorney Mel Santos' motion for a continuance of two weeks in order to obtain trial transcipts from the first mistrial.  McBride ordered Tom to report to Judge Dennis Mitchell, Dept 602 at 400 McAllister St for trial.

A rally, organized by HempEvolution.org and Axis of Love San Francisco, was held at Civic Center Plaza in support of Tom at Noon before everyone went upstairs to court.

Judge Mitchell ordered that Juzbasic to appear on Monday, Sept. 25th at 10:30 AM and jury selection to begin at 1:30 PM the same day.

However, it remains to be seen will actually begin as Deputy DA Thomas Hechler told the judge that he has a trial to argue next week.  It is suspected that anothe Deputy DA will appear in Hechler's place and dismiss the case, so Hechler can refile charges and retry the case.

Patients and supporters wonder why scarce city resources are being wasted prosecuting Tom for providing a public service why other dangerous criminals are being are being freed for more serious offenses.

Tom remains upbeat about his trial and would like to sincerly thank all those showed up to support him.
