FALSE ARRESTS, FALSE CHARGES, FALSE POLICE REPORTS, PROSECUTORIAL MISCONDUCT

Alaska is a target for a Police State. It is far removed from the Lower 48 and the stories here are historical. The opportunity for misconduct is great. The reward is the Permanent Fund Money and property of victims to support a Government that needs to pay for the Governor's Jet and trips. It takes teamwork and it's here and running like a well oiled machine.

On June 16, 2005, I was arrested and charged for D.U.I On the breathalyzer I blew under .08 and was not guilty. The arresting officer made a false Police Report. I have not been allowed my Miranda rights. I am not allowed to bring witnesses. I am being intimidated into making a guilty plea or hear threats that if I do not go along...I am digging a very deep hole. I have a disability and the state attorney and hired attorney use it against me. It is Post Traumatic Stress Disorder for going to the recscue of two children who were the victims of attemted murder by their own Dad. I am now seeking Justice. The court wants my Permanent Fund for life, my vehicle, my sanity. I have documents to add later as the A.C.L.U has advised me to start a law suit immediately. The A.C.L.U has the whole entire story. I am working hard to keep Juneau, Alaska, from becoming a full blown Police State.

did you pass the standard field sobriety test? The DRE? the .08 was on the datamaster or the PBT? Can't tell from your story.

walking with a bunch of loudmouthed friends one night, I smartmouthed a cop who ended up detaining me for no reason for over an hour in his squad car and looking for a reason to fuck me up

I pulled my handcuffed hands from my behind my back under my legs to my lap, from where they were getting pinched between me and the back seat of his car to a more comfortable position. he was holding me for way too long with no charges just chatting with his cop buddies who all dropped by and had nothing better to do. for that little bit of handcuffed comfort I afforded myself, I was yanked from the car and had my head slammed against the trunk of his car. then I was "placed" back into the car with the cuffs at my back again. not nice.

I was pulled back out of the car later and given an extensive field sobriety test (about everything but say the alphabet backwards skipping vowels). I passed. then the breathalizer. passed.

you know what? regardless of no legitimate offenses, I was written tickets for cursing in public, out past curfew, and drunk in public. when I showed in court and denied all of the charges, bringing up the passing of ALL sobriety tests, the judge sided with the cop who said I was drunk and I was fined for all three charges

I was just 17 at the time, but I learned a valuable lesson. with the coppers, it doesn't matter who is right or who is wrong, they can do whatever they want. now, sorry to say, I say fucked up things like "sir" sometimes to cops when they seem about to attack me for looking weird or whatever, and I have never had similar problems like I constantly had before that unfortunate run-in. of course, I am white and that gives me a certain amount of privilege, but weak ego cops can't deal with the truth without powertrips and that can be dangerous.

now, that lesson has not applied in my adult activist experiences, only in my personal getting-pulled-over type of encounters. activist-wise, if often pays to be firm and direct with police and let them know that cannot rile or otherwise intimidate you and your demonstrating cohorts.
