Governor Douglas has forwarded to me your correspondence of March 20th regarding your issue..."

Ms. Ericson's issue is that doctors in Vermont
and doctors in New Hampshire
who are authorized to provide service
to Medicaid and Medicare patients
who live in Vermont
are forcing patients
under duress
to submit to urine drug testing for illegal drugs,
and threatening the patients
that they will discontinue providing
necessary medical prescriptions
if the patients do not submit
to unnecessary drug tests.
Ms. Ericson pointed out a case of a person
over age 50 who had
never been charged with a drug crime
being forced under duress
to submit to unnecessary
illegal drug urine testing
which is demeaning and insulting
and humiliating to the patient
who is entirely innocent.

Mr. Steven M. Gold writes,
"Review of your specific allegations
by the Medicaid Fraud and Residential Abuse Unit
of the Vermont Attorney General's
did not reveal a biling pattern
of fraudulent or excessive laboratory claims.
Furthermore, there is reason to believe
that the provider's practice is in accordance
with recommended
procedures and practices
by the medical and pain
management industry.
A physician may use his or her
clinical judgment to decide
if a medical test is necessary for his or her patients.
A physician may make this decision for a variety of reasons."

Cris Ericson asks the voters and taxpayers,

(1) what private right of action does a medical doctor have to charge a patient with a crime?

(2) what private right of action does the
"medical and pain management industry"
have to recommend procedures and practices to doctors
to charge patients with crimes?

FORCING A PATIENT UNDER DURESS
TO SUBMIT TO A DRUG URINE TEST
IS CHARGING A PATIENT WITH A CRIME!!!

PLEASE STOP THIS ABUSE IN THE STATE OF VERMONT!!!

Patients over age 50
who have never been charged
with an illegal drug crime
in their entire life
should not be humiliated
and insulted and demeaned
and forced under duress
of the threat
that the doctor will discontinue
necessary medical prescriptions
if the
patient doesn't submit
to a drug urine test for illegal drugs.

Please help stop this abuse in Vermont!
