Student Debt, Agressive Collectors

Collection Agencies are getting aggressive and ruining opportunities, health and viability for many. Who are they? How do they get their government contracts?
Remember when you signed up for the student loans (which your parents didn't need to do ...by the way ... ) just to go to college? They told that the interest would be reasonable ... that you had rights ... that student loan agents were flexible and that you could work out acheivable payment plans with them ... even if you fell on hard luck.

Well, times have changed and now the government has turned to more agressive tactics and private debt collection services are making big money off many impoverished working-class graduates all across this country. They don't care if you go homeless and lose touch with prospective employers ... they are hell bent on collecting as much as they can as soon as they can. They demand to tap directly into bank accounts ... they seize tax refunds ... and they garnish wages. When you respond to their threatening letters they try to get big payments out of you just so they can get you into some type of repayment program. They often encourage the impoverished worker (who has been having trouble making their payments) to take out other high-interest loans. This is irresponsible and the collection agents don't seem to really represent the U.S. government and they don't have the long term health and viability of the graduates in mind. They are acting like agressive debt collection sharks ... they are threatening and they often get impoverished workers to send in balloon payments that they cannot afford or to agree to let them take large payments out of their bank accounts each month. Ofen times, this imperils the worker. They are forced to move, they lose their job, and go back into default. So, the government, by not acting more responsibly in the collection of these debts is actually collecting less in the long run and a handfull of private collection vampires are getting rich off the poor.

Question is ... is anyone doing anything about this? Is their any good website that informs people of their rights. Is there any good organizing going on about this?

At a minimum, I suggest that people start doing investigative work into these agressive private collectors. Where is their actual street address? What are their real names? How much of a bonus do they get when they push someone into forking over money they cannot afford? What is their incentive structure like? There could be a well publicized website designed to out the really bad ones and swap horror stories ... and, to suggest ways of dealing with this.

I have been lied to several times by collectors and, they have dipped right in and taken huge (sometimes all) of my earnings. They have hassled my employers to the point where I have lost jobs. And, they have done all of this while I was calling them and offering to pay them monthly payments. I have pain thousands into my student loans, only to see the balance shoot back up due to huge collection fees attached after I fell into hard times. Two companies that have been particularly haneous, duplicitous and deceitful were DC Credit Services (who were sued big time in recent years and so shouldn't even still be collecting under a government contract) ... and Pioneer Credit Recovery. Both of these companies should lose their government contracts and be the subject of intense investigations for their misconduct.

So, I'd love to know of more information and organizing about this. Anyone know where to look first.

I also though that someone should point out that Sallie Mae is perhaps
the real big kid on the block of making huge profits off the backs of recent
college grads who are having a hard time.

After the laws were changed so that interests rates could increase and so that
student loans could be purchased by predatory collectors for pennies on the dollar - the CEO of Sallie Mae, Alber Lord turned into a millionare and started buying all kinds of frivolous things and real estate. He even purchased some land to make a golf course just for himself - all off the backs of the poor. So, this student loan thing has gotten way out of hand.

DCS Inc. is headquartered in Canoga Park ... but, they also have a nice office in Livermore California.

They seem to be a subsidiary of (or a partner with) the Performant Financial Corporation. Performant has lobbied Congress and has gotten a lot of work collecting for the dept. of education ... the I.R.S. ... and so on. They may also acquire the rights to agressively collect from less-fortunate students and grads by acquiring their upaid debts for pennies on the dollar and then, hyping up collection activity.

So, maybe if you were looking for a person to go after, it would be Performant's Senior V.P. - Hal Leach. He is the government but-kisser who has gotten them all the good, govt. collection work. They are making a mint off of the backs of impoverished grads all across the country. ... So, If anyone has any information (addresses, phone numbers, photos) on Hal Leach, kindly respond to this thread. Below is a quote from the webpage. It says that he has been with DCS for 20 years - so, he may be retired and living in a mansion in South Lake Tahoe. But, he may still be active and living somewhere like Danville. Anway, here is what the website says ...

This is my response to our friend "economic liberato".
Guess what happened to me last week.

I was visiting my former landlady/friends house and she informs me that "so-and-so", my high-school friend, called her asking how I was doing, if I'm still in school, she lost touch with me but she knows my mother in (another country) too (and mentions her name), how can she get hold of me, does she know my phone number or address, or can she get my mother's phone number, etc.

My friend believing this lady's story UNWITTINGLY divulged information that I'm not in school now but working, and I have kids now (response on the other end was "oh! really?). But she gave no further information. I told my friend that there's no friend from my school named "so-and-so", that none of my friends would know my mother by that name (legal name) my so-called "friend" mentioned, and that she shouldn't have told her anything about my work or family because my former spouse may be stalking me. And, I've never given people her number ever as my official contact number (although I use her mailing address)! CREEPY, eh?

Anyway, that lady did leave her full name and phone number, so I decided to call her that night (of course, from unlisted number). The message machine goes "Hi, you've reached the OFFICES of so-and-so". My first instinct was this is from a lawyer's office. Am I being sued? But why ask about my mom?? I search the Bar Association, no listing under her name! I called her again this morning, and a lady answered the phone so I asked her for their mailing address. She goes, "who are you?" I don't tell but ask for her mailing address again. She refused saying she wanted to know WHO I WAS first. I just told her I don't know you, but you apparently called me and left me your number. Who do you work for. She said DCS, Inc.!

Whether this woman was from the same student loan collection DCS, Inc., or not, I think such approach is outright Invasion of Privacy and Unfair Business Practices. If they have extensive history of unfair business practices, maybe I can sue them?
