We left San Francisco in the predawn hours with two vanloads of patients to drive up to Auburn for Steve Kubby's hearing at the Placer County Jail. We were all very concerned about Steve, as he couldn't even get a Tylenol for his pain and only after a massive call-in campaign to Placer County officials did a sympathetic deputy sheriff give him an extra blanket and pillow.
He was receiving Marinol from the prison nurse, but he needs more then THC, the principle active ingredient in Marinol. He was separated from the rest of the inmate population, because his vomiting disturbed the other inmates.
Placer County is the most conservative county in California and District Attorney Brad Fennochio has spent a great deal of tax dollars on persecuting medical cannabis patients. We expected a hostile environment, and knew that news of Steve's incarceration was the talk of Auburn.
As we were setting up, we talked to an attorney from the Public Defender's office. She was exasperated and said she was fed up with the Placer County legal system and that she'd be leaving soon to work in Nevada County.
Bill McPike, Steve's attorney arrived and went to the DA's office. He said Steve was hanging on and that our presence here was encouraging to him and gave him strength, although Steve had lost fifteen to twenty pounds.
The entire Sacramento news media had converged and we decided to start the press conference. I gave them an update on Steve's condition and answered their questions about Steve's legal status and tried to clarify a few details about our position, which is: get Steve his medicine, put him in the infirmary or release him to house arrest.
The courtroom was small, holding only fifty people. Only a few folks were able to make it in, but the room was packed. The bailiff led the other people in custody into the court. Steve was led in by himself. He was in shackles, but waved to the crowd and smiled. He looked in good spirits, but was slightly disheveled and thin. You could see that he was in obvious pain, but he seemed game to fight on.
The hearing was an afterthought, Steve pled not guilty to violating the terms of his probation, and he was scheduled to appear on Friday, February 3rd, 2006 at 8:30 AM.
The Assistant District Attorney Cattran, made a few statements outside, which amounted to a lot of double talk. If Steve dies while in custody, Cattran will be the person responsible.
We are going to continue organizing around Steve's case and plan to go to Auburn Friday.

I am glad to see activists in SF standing up for Steve and showing there love. With a mushroom stem, a piece of cactus and a healing plant at the core of this case, it shows that this is not a War on Drugs, but rather a war on plants, mushrooms and cacti! Indeed, a War on nature and humanity's natural right to the plants of the Earth. It's time for our Brothers and Sisters in California to band together in front of the placer County Court House and fight for the Life of an activist tha thas fought so hard for all of them. We do not need another dead activist like Peter McWilliams, we need to make a stand, and in so doing a fight for one life, becomes a fight for all!

LIES AND STONEWALLING FROM PROSECUTION IN KUBBY CASE
I didn't think it would happen. For years Steve Kubby has been a Canadian refugee, wrestling with the courts for his right to his life-saving medicine. Every once in a while, things would heat up, and they would threaten to deport him. The Canadian asylum system had served him well enough to keep him out of the US, and technicalities always had allowed him to remain in Canada where he is a registered medical marijuana patient.
Until now.
I will admit to not understanding all of the fine details of the Steve Kubby case. But what I do know disturbs me.
On Tuesday he was arraigned in Placer County Court. He will have his next appearance on Friday, January 3rd, at 8:30am, at 2775 Richardson Drive, in Auburn, California.
The address on B street given out earlier turned out not to be where Steve was. The Richardson Drive address is where the jail and court are housed.
Clark Sullivan of Hemp Evolution http://www.hempevolution.org did an outstanding job of organizing the press conference, and fielding the majority of the questions that were asked before court began. His speech was eloquent, poised, authoritative, and relaxed. The rally was joined by a number of different activist groups, including Compassionate Coalition, the Libertarian Party, California Marijuana Party, and the newly formed Axis of Love.
Many prominent medicinal cannabis advocates were in the crowd. The roster included former NORML head/MarijuanaNews publisher Dick Cowan, http://www.marijuananews.com , Starchild from the Libertarian Party, Tony Bowles from the California Marijuana Party, reps from Axis of Love and American Alliance for Medical Cannabis, and independent reporters Pat McCartney, Ann Harrison (Bay Guardian, http://www.ontherecord.org ), Matin Lee http://www.aciddreams.com , and Dick Cowan.
It took a very long time for the large crowd to get into the courtroom, as there is no xray machine, and each person had to remove all metal before passing through the metal detector. The entire courtroom was full. The prisoners came out in their bright orange jumpsuits. Steve came out, sans haircut, looking genuinely humbled by the overwhelming outpouring of support. Somebody from the crowd waved at him, and he waved back, without any repercussions.
Steve was not permitted to speak at his arraignment. His attorney, Bill McPike addressed the judge. He is apparently preparing to file a motion to allow Steve to consume cannabis while in jail. There also appears to be a motion to have Steve moved to house arrest in Marin, but I am unclear on the details of that motion.
I have never met Steve Kubby. I was not prepared to be as moved as I was when he walked in in shackles. He looked startlingly thin compared to any photo I have ever seen of him, and he has only been in jail for 6 days!
There have been no indications that his medical treatment while in jail has improved. There is no evidence that his blood pressure has been checked since he was admitted. There is also no evidence that his requests for Tylenol have been granted.
Chris Cattran from the Placer County District Attorney's office addressed the reporters after court let out. His demeanor was arrogant, and ignorant. He said (I paraphrase) "Steve Kubby allegedly had cancer at one time, I have no idea if he still does." and, When asked about the motion for Steve to use pot in jail, he laughed and replied, "I haven't even thought about what our position on that is." I asked, "He look like he's lost a lot of weight. Would you consider letting him out early because he is dying?" Cattran ignored my question. Starchild repeatedly asked, "if Steve dies in jail, where does the moral responsibility lie?" as he was snapping shots of Cattran. Starchild's questions also received no reply. When Pat McCartney asked a question about the felony status, Cattran walked away, to the boos of the audience.
Cattran was stopped by another reporter, who followed up on McCartney's question, getting a more polite response. I asked Cattran if he had read the waiver that Steve signed, absolving Placer County of any responsibility if Steve dies while in custody. Cattran not only ignored my question, but refused to turn his head to look at me, and I was standing a mere few inches away from him. But when Ann Harrison rephrased my question, he replied that he was not aware of the document.
Pat McCartney good naturedly continued his questioning, despite the prior snub from Cattran. I applaud Pat for his forgiveness.
I was steamed.
I have attended many court appearances for a number of different medical marijuana defendants. But I have never been so shocked as I was Tuesday by the callousness of Steve's prosecutors. I am very personally concerned for Steve's health, and life. I prey that he will be able to survive this frightening, infuriating and life threatening ordeal.

should be addressed so as to
help
all jail inmates
who
are incarcerated. Please try to see Steve Kubby's issues

If you have evidence that Deputy DA Christopher Cattran
said, "I have no idea if he still does" in regards to
Steve Kubby's cancer, then isn't that a clear primae facie
violation of California Penal Code Section 673:
It shall be unlawful in the jails or county institution to
INFLICT ANY LACK OF CARE WHATEVER WHICH WOULD INJURE OR IMPAIR THE HEALTH OF THE PRISONER.
To state that he has no idea if Steve still has cancer
proves (1) that Christopher Cattran KNEW that he
did have cancer (2) KNOWS that Steve is still alive
and might still have cancer and (3) therefore isn't it
a LACK OF CARE to not determine factually if he still
has cancer because
CA Penal Code Section 6102 requires Steve Kubby
to be moved to the Medical Facility (Section 6101)
because he is suffering from a chronic disease or condition.
Isn't it true that there is no cure for cancer, that it only goes
into remission?
Isn't Deputy DA Christopher Cattran guilty of CA Penal Code misdemeanor section 673 for LACK OF CARE of a prisoner?
I can guarantee you that when I am elected to the U.S. Senate I will make a Senate Committee to investigate the
number of deaths of inmates incarcerated in California.
People die in jail all the time. Wake up.
This has been going on for years.

People die of disease all the time incarcerated in California and they are not released because they are close to death,
they are held in solitary confinement, often without medical
treatment, because the jail doctor says, "you'll never get any better so why should we give you any medicine", and they die in horrible pain in solitary confinement.
This happens all the time.
Wake up.
I lived in Los Angeles county for over 20 years and many
people personally told me about astounding abuse and
deaths.
One pregnant woman told me how she was taken for
an "elevator ride" by the guards in county jail in Los Angeles and they kicked her and beat her until her unborn child died,
she was pregnant, and then the judge reduced her sentence by six months because the guards beat her and killed her
unborn child. They did not release her, they kept her in jail
in solitary confinement.
The more they abuse you, the more they keep you in solitary confinement to keep you from telling others.
I will get elected to the U.S. Senate and I will open a committe to expose the abuse in California.
It is a police state.
Many people are tortured in to pleading guilty to
plea bargains of crimes they did not committ.
TORTURED.
You cannot imagine the suffering I have seen of children
in Los Angeles when the police break in to their apartments
looking for someone on probation and destroy the apartment
leaving the children terrified and crying.
Children would come crying to me, children in my
neighborhood.
And they had no relation to the person the police
were looking for and did not find in their apartment.
The police make residents of Los Angeles plead guilty
in a plea bargain when they are innocent, they torture
them into pleading guilty, then they put them on
probation, then they believe that gives them a license
to enter where ever they think they are, to break in
to any home on the pretense that they are looking
for someone on probation, because they believe if
you are on probation then they can hunt you down
anytime they want to observe you.
