GGNRA Forced to Dismiss Off-Leash Tickets in Presidio
In light of Federal Judge Alsup's recent appellate decision, and the ever present threat of litigation from Ocean Beach Dog Owners Group, the United States Attorney has decided to dismiss all citations recently given to off-leash dog-walkers in the West Pacific Avenue and Mountan Lake areas of the Presidio.
This is an information bulletin for all dog walkers who enjoy off-leash recreation in the West Pacific Avenue and Mountain Lake areas of the Presidio:
Beginning in November 2005, the GGNRA and its subsidiary organization, the Presidio Trust, have embarked upon an illegal campaign to cite dog walkers for off-leash violations in the West Pacific Avenue and Mountain Lake areas of the Presidio. This is in direct violation of Federal Judge Alsup's appellate affirmation of June 2005 (U.S. v. Barley, et al) which effectively reinstated the 1979 Pet Policy in the GGNRA. These areas in the Presidio were officially made a part of the 1979 Pet Policy in 1996 by GGNRA Superintendent Brian O’Neill.
Superintendent O'Neill claims that the GGNRA had nothing to do with the recent ticketing and that it was being conducted solely under the auspices of the Presidio Trust. When questioned about the illegal ticketing, Presidio Trust attorney Karen Cook claimed that she had never heard of the 1996 amendment to the 1979 Pet Policy. Nevertheless, she contended that the Presidio Trust implemented its own on-leash regulation in November of 1996.
Since November, 2005 the most strident of the Park Police have been ticketing and harassing people with threats of arrest and injunctions in the West Pacific and Mountain Lake areas. The tickets were recently challenged by Ocean Beach Dog Owner’s Group lead attorney, Stephen S. Sayad at a January hearing. Subsequent to that hearing, the U.S. Attorney's office has decided that the ticketing cannot withstand judicial scrutiny. Tickets issued have been dismissed. Once again, the areas specified in the 1979 Pet Policy as well as the areas added in the 1996 amendment to the Pet Policy have been returned to their off-leash status.
The only questions remaining are:
1. Why has the Presidio been removed from the GGNRA Negotiated Rulemaking process for a pet management policy?
2. Was GGNRA Superintendent O’Neill, despite his denials, spearheading the ticketing at West Pacific Avenue and Mountain Lake?
3. Why does the GGNRA continue to act as though they are above the law?

Presidio Trust and NPS use illegal means to justify their dubious ways.

It is a shame that the Presidio Trust and the National Park Service (NPS) has failed the constituents of San Francisco and the extended Bay Area when it comes to the Dog Owners and unjustified Leash Law.
The authorities that be have NO CLUE as to the history of the Presidio of San Francisco. The Presidio of San Francisco was better off under the Army - Sixth Army and Presidio of San Francisco. Dogs and Dog Owners were treated with respect.
The Army accomodated dogs and their owners and were fair to those that had suggestions.
Under the Presidio Trust we have seen " thugs " from Colorado and those cronies that have made their nest at the Presidio more to make money - earning high salaries and less to serve the public at large.
The recent adjudication by the courts in favor of the dogs and the dog owners speaks volumes and cast that deep shadow on the Presidio Trust and the NPS that has with " intent" broken the law.
The time has come to take Brian O'Neill and Craig Middleton before the highest Court of the Land and expose them for adversely impacting thousands of innocent law abiding citizens.
Forcing the United States Police and the Park Rangers to carry out orders without justification and backed by law, rules and regulations that have not been discussed in the open with due process.
No Park should be run in a dictatorial manner and here we have so called crooks harming thousands by citing innocent dog owners and putting them in harms way.
The NPS is in the business of Preservation and Protection but also of service and caring.
The time has come to investigate the Presidio Trust and the NPS. How come these organizations have been wasting millions in courts defending laws, rules, and regulations that are enforced without due process and applied in a dubious manner to massage the egos of those that are very corrupt.
Congress must stop giving the appropriations to the Presidio Trust and the NPS. Again and again they have
used tax payers money for litigation more to serve some selfish purposes.
