Immigrant Rights Activist to go before Judge 8:30 am Thursday

Jailed 5 days without a hearing, young
immigrant rights activist set to go before
judge Thursday morning, his attorney says

SACRAMENTO – A young immigrants rights activist – who has spent nearly a
week in jail without an opportunity for a hearing, a right usually accorded
prisoners within 48 hours of arrest – will finally go before a judge
Thursday morning at about 8:30 a.m. (Dept. 63, Main Jail, 615 I St.)

Earlier this week the District Attorney's office made – and was granted –
an unusual request to delay a bail hearing for Joshua Ramirez, who was
arrested at a protest against vigilante border "Minutemen" last Saturday at
the State Capitol.

Ramirez, 19, of Santa Cruz, is now being charged with three felony counts,
including battery on a Sacramento city police officer, a California Highway
Patrol officer and resisting arrest.

"We are hopeful this young man will be released Thursday," said Jeff
Kravitz, a Sacramento civil rights attorney and law school professor who is
representing Ramirez.

Observers and witnesses of the demonstration of about 600 protesters – many
from San Francisco and the Central Valley – said those arrested were
physically abused by police, including one person arrested for just
stepping off the crowded sidewalk into the gutter.

Demonstrators were protesting the rally by the "Minuteman Project", a
vigilante citizen group using weapons to harass and even "arrest"
immigrants along the Mexican border.
The project, although it involves illegal activity, has received the
endorsement of the governor.

"We're very concerned this activist is being singled out for over-the-top
charges, high bail and this motion to postpone his release largely because
he is Latino and opposed to the same vigilante project the governor
supports," said Cres Vellucci, spokesperson for the Mexican American
Political Association, the oldest Latino political organization in the state.

Does anyone have a copy of the police report?

THIS ARTICLE IS IN THE TRADITION OF POLITICAL AGITATION JOURNALS and therefore largely devoid of facts and objectivity. LETS TAKE SOME OF THE POINTS.

FACT: I saw approximately 300 people with cameras among the 600 people demonstrating. Where are the photos and the video of the alledge police abuse? There were numerous representatives from the media taking video and photos. Where is the evidence of abuse? With so many observers as you claim saw abuse, there has to be plenty of documentation. The fact that no one has filed charges against the police should indicate that no such abuse took place. If what you claim is true, then file charges against the police.

FACT: It is legal to rally and demonstrate, but it is illegal to do so without filing a permit. The Minuteman, being a law abidding organization, filed for a permit. The hecklers SHOULD HAVE FILED FOR A PERMIT, but did not. Therefore, the hecklers did not have the legal right to step on the street and instead as the law is writen, they were allowed to demonstrate ONLY on the sidewalk (without a permit). So, Yeah, if you step off the sidewalk and onto the street without a previously applied permit it is a violation (whether Minuteman or heckler doing it makes no difference).

FACT: Thousands of Minuteman have served in a number of border states in the Northern and Southern borders. The border is a very dangerous area due to criminal human and drug traffickers defending millions of dollars in inventory. The Minuteman carry weapons for their self defense and only on those states where it is legal to do so. The Minuteman observe and report to the authorities, nothing more. Any other activity would be illegal. Illegal detainer for example is a Felony. In spite of thousands of Minuteman serving side by side with media representatives; observers from adversary pro-illegal alien organizations; and law enforcement, there has NOT BEING A SINGLE INCIDENT OF VIOLENCE OR ILLEGAL ACTIVITY since the beginning of the Minuteman in April of 2005.

During the same period of time numeours pro-illegal alien hecklers have been arrested for violent acts including the Sacramento heckler charge with a Felony.

If you know of a SINGLE CASE of illegal activity on the part of a Minuteman, then NAME IT or stop the lies.

So lets be clear about this. In order for something to be "illegal" you have to break a law (for example by crossing the border illegally), so if you want to peg the word "illegal" to the Minuteman, you have to state a Court Case, right? Well, you are welcome to it, just find ONE.

FACT: You can not say the governor endorses illegal activity when you are not able to name a single illegal activity committed (while you ignore the illegal activity of pro-illegal alien heckler arrests and convictions). You understand that for something to be illegal one must break a law and be found guilty of it in a court of law, right?

I hope that your organization's misleading information has not egged this young man and others to commit legal offenses, even felonies, that will forever be on their records. When they grow up they will regret having a criminal record thanks to people like the ones who write for this organization, who should know better than enciting others to break the law.

Please protest, but do so legally and without violence.
