On June 5, 2005, Brian Spears was falsely indicted on attempted murder charges in SF Tenderloin District. Brian is in custody at the SF Hell Hole of Injustice at 850 Bryant Street, arraigned on August 30 and awaiting trial, now scheduled for January 2006. Brian, if convicted could possibly face a life sentence. This case is the epitome of the sweeping judicial justice system racialized policing plaguing San Francisco. If you care to visit Brian, you will meet a wonderful, vibrant young Brother, not a killer ! Snapshots from the store surveillance videotape of the assault on the liquor store clerk blatantly demonstrate that Brian''s resemblance with the suspect strictly amounts to shaved heads and a beard...

Shirley Gallathe showed me pictures of her son Brian along with pictures of the
suspect in the armed robbery that took place at a liquor store in the
SF Tenderloin District. No resemblance, except for shaved heads and
facial hair. "We all look alike"...

Idriss Stelley Foundation is taking on the fight to Free Brian Spears
with his courageous family and Brian's Public Defender Mr. Déjà vu.

"Dear Mr. Vu, Dear Jeff,
ISF met with Mrs. Galathe last Saturday. She showed me pictures of her
son, your client Brian Joseph Spears, arrested on 6-3-05 in the
Tenderloin District for attempted murder, pending arraignment 8-30-05.
After going to Bay copy to blow up pictures of Mr. Spears and of the
suspect (snapshots from the store video where the crime was
committed), it became quite obvious to me that Mr. Spears and the
suspect are clearly two different individuals, based on the following
observations:
* Different stature. Mr. Pearce is evidently much taller. The suspect
is very thin, his neck is narrow, and he seems to float in his
clothing... Mr. Spears has a thick built, neck and much longer arms
than the suspect.
* Different facial and cranial morphology. Suspect has a receding
chin, while Brian's chin is much more pronounced. Suspect's cheeks and
temples are pronouncingly hollow, while Mr. Spear's face is round and
without indentations. Suspect's cranial structure is equally quite
different: Protruding, bony brow's arch, narrow skull, while Mr.
Spears' face is of even structure, and larger skull.
The only common denominator between Mr. Spears and the suspect are
shaved heads and facial hair, which can lead to a positive
identification by the uneducated (or racist?) eye.
We have prepared 2 visual documents, pairing Mr. Sears and the
suspect, face and 3/4 profile, blown up to identical dimension on each
document, to clearly demonstrate the above findings.
Mrs. Galathe wrote us tonight regarding your visit to your client.
According to Mr. Spears, you would have expressed to him that his case
is serious, could potentially carry a lengthy sentence, that you would
put up a fight, although you were unsure of the outcome, but felt
looking at the suspect pictures that it was not Mr. Spears.
Various options may be set in motion after the arraignment:
* Official complaint w/ the OCC for wrongful arrest, on the
grounds of racial profiling
* Testimony during public comments at the Police Commission hearing
following the arraignment, with supporting visual documentation which
will be made public on GOV TV screen for the Commission and the
general community's consideration
In the eventuality of a later negative outcome for Mr. Spears, ISF
has set up a Justice4Brian website and will launch a petition on the Net for his release. Hopefully through your diligence and commitment, these measures will
not become necessary".

"Mr. Vu, we trust your diligence and skill tomorrow to fully exonerate this young man, who possibly faces a life sentence due to mistaken identity and racial profiling, in spite of his blatant innocence. Sadly, this case is the epitome of racial profiling in our city... and we will resort to a massive action citywide with other CBO's and Racial justice organizations if Mr. Spears' case is not dismissed.
Dear Jeff, we respectfully encourage you to scrutinize this particular case and support our Justice4BrianSpears action. Your relentless work to free Gough and Tennysson has been a formidable stepping stone for racial justice and fighting judicial corruption in San Francisco, you have rightfully earned the trust and respect of our Poor community of Color and we are counting on you !"

Brian Spears has been incarcerated four and a half months for a crime he did not commit, along with so many of our Brothers and Sisters... He keeps the faith and relies on the love of his family and the solidarity of his community, hoping to be released in 2006 !

Idriss Stelley Foundation, along with Patrisha Tulloch from POWER also visits Sister Gina Hinton, shot 8 times a few months ago in SF Crocker Amazon by a San Mateo PD officer out of his jurisdiction. Sweet, frightened Sister Gina, who miraculously survived the horrifying assault is in custody at the SF Medical Jail on 7th St, receiving substandard medical treatment.
