The cases are not heard in open court, but before international trade tribunals that rule in secret. The program details a system of private justice that is enabling companies to obtain covertly what they would be unlikely to achieve publicity in America’s legislatures or courts.” CAFTA (the Central America Trade Agreement), which also contains this obscure provision, passed the Senate on June 30th and will most likely be voted on in the house this week.
