The Martinez family, is holding a vigil for Samuel Martinez and invites the community

to be part of honoring the memory of Sammy and to join the fight for justice.
The Martinez Family would like to invite you to join our friends and family in
remembering "Sam" on the 60th day anniversary of his death. We will be holding a
candle lite vigil followed by a march in his memory.

Commission. The Commission is in recess for the month of July and will NOT HOLD A

Victim of Homicide
December 22, 1970 – May 26, 2005
On May 26, 2005, Samuel Martinez Jr., a 34-year-old
father of 3 children was shot and killed by a San Jose
police officer IN YOUR COMMUNITY. Police responded to
a disturbance call that ended in (an unarmed) person
being shot and killed. The police claim that Sam
grabbed the officer’s baton, LETS SEE THE EVIDENCE.
San Jose police are armed with batons, pepper spray,
tasers AND a gun, GUNFIRE on an UNARMED person is
UNACCEPTABLE!!!

WHAT HAPPENS NEXT?
The Santa Clara County District Attorney’s office is
conducting a Grand Jury Investigation in this case
where the shooting officer will have to justify his
actions. The Grand Jury will then determine if
criminal murder charges will be filed against this
cop. Cases go the Grand Jury when the circumstances
warrant an investigation at this level.

WHY THIS FAMLIY NEEDS YOUR SUPPORT?
Traditionally, the District Attorney’s Office has held
“closed” grand jury investigations in officer-involved
shootings. This means that all evidence (produced by
the San Jose Police themselves) is presented by the DA
to a Grand Jury and decision is reached behind closed
doors. If this Grand Jury Hearing is closed, this
family will NEVER get to see the evidence, hear
witnesses or attend the hearing. This very
undemocratic process is supposed to “protect the
families and witnesses”. In this specific case, the
witnesses ARE FAMILY MEMBERS and want this hearing
OPEN.

WHAT CAN YOU DO?
You can make a phone call to the District Attorney and
have a voice in holding members of law enforcement
accountable to answer to the public in circumstances
like this. A life has been taken and we need the
citizens of Santa Clara County to support in demanding
that the grand jury investigation be “OPEN” so that
the evidence and testimonies of this investigation be
public. If the average citizen commits or are even
accused of a crime, our criminal records are PUBLIC.
We want the police, the District Attorney and the
Grand Jury to answer to the public also.
