cancer sufferer

The Federal Court of Canada yesterday dismissed the
judicial review application of American refugee
claimant Steve Kubby.

Mr. Kubby and his family came to Vancouver in 2001 and
claimed refugee status on the grounds that he required
medicinal marijuana to treat his adrenal cancer.

Madame Justice Sandra Jean Simpson said in her ruling
that Mr. Kubby's fear of imprisonment for using
marijuana in the United States does not provide a
sufficient basis for refugee status in Canada. William

JUDGE AGREES TO REOPEN KUBBY CASE!

AUBURN, CALIF. (June 27, 2005) -- Medical marijuana
advocate Steve Kubby and his defense team will finally
get their day in court to argue that the arresting
officer and deputy DA lied to judges in order to
fraudulently obtain a search warrant and conviction
against Mr. Kubby.

"Our attorney, Bill McPike has presented the court
with compelling evidence of serious errors and has
shown that there is no basis upon which to call my
husband a fugitive or to deny a hearing regarding the
fraud, and other serious crimes that we believe were
committed by the deputy DA and arresting officer,"
said Michele Kubby

"Apparently Judge Cogrove failed to follow the orders
of the Appeals Court and never sentenced Steve as
instructed by the Appeals Court. In addition, it
appears that the DA's appeal to raise Steve's
misdemeanor to a felony is prohibited by law, when
probation is involved and, in any event, it was filed
late," she added.

Mr. McPike has filed a petition for writ of error
coram nobis, a motion to vacate judgment and to have
the convictions against Mr. Kubby thrown out because
of fraud. Judge John L. Cosgrove has ordered a hearing
to be held on Monday July 25th, 2005 at 11:00 am in
Dept. 10 located at 11546 B Avenue, Auburn,
California.
