Lockyer issued a legal opinion on Thursday, June 23 regarding medical marijuana.


Slipping under many of our radar screens, California Attorney General Bill
Lockyer issued a legal opinion on Thursday, June 23 regarding medical marijuana.
For those hoping to find clarity from the AG on the role of local law
enforcement in upholding state law, the opinion falls somewhat short. However,
the opinion does reinforce aspects of SB 420, and restricts local governments
from impeding state law by way of local ordinances.

ASA will be issuing something over the next few days that connects the opinion
to unlawful local ordinances, like the one adopted in Fresno banning
dispensaries. The opinion is expected to help with ASA's legal challenge of
Fresno's ordinance.
