Judge James Unable to Rule on Lepp Case
After reading paperwork submitted by Lepp, including affidavits written by residents and friends of Eddy's Medicinal Gardens, Judge James was unable to rule on the case. James passed the case on to Senior Magistrate Judge Spero who will see Lepp on Wednesday morning at 9:30 am.
Judge James Unable to Rule on Lepp Case

San Francisco, CA Feb 28, 2005 -- Eddy Lepp was seen before Magistrate Judge James this morning at the San Francisco Federal Courthouse. After reading paperwork submitted by Lepp, including affidavits written by residents and friends of Eddy's Medicinal Gardens, Judge James was unable to rule on the case. James passed the case on to Senior Magistrate Judge Spero who will see Lepp on Wednesday morning at 9:30 am.
Eddy Lepp's ailing wife, Linda Senti, stated, "It was favorable; after Judge James read our paperwork she was not willing to do what the DA was asking, which is hold Eddy without bail. The judge kept on stating that there was no flight risk based on his past behavior. She asked the DA what harm Eddy was causing the public and the DA could only come up with that he would continue to garden, or be a continuing offender." Lepp will remain in custody as he awaits his next detention hearing on Wednesday.
