Tree-Sitter Lawsuits Against Maxxam/Pacific Lumber Multiply

More lawsuits for Maxxam/Pacific Lumber and the mercenaries they hire to forcibly remove tree-sitters.
Eureka, CA - Two more tree-sitters who had been forcibly removed from threatened ancient redwoods in Northern California have filed lawsuits against Maxxam Corporation, Pacific Lumber, and the men hired to seize them high above the ground. Amy Gershman and Jamie Kohler joined fellow tree-sitters Jeny Card, Lindsey Holm, Kristi Sanchez, Scott Petersen and Anna Farnam in filing counter suits January 14, 2005 related to the string of tree-sit evictions that occurred in the forested hills above the tiny hamlet of Freshwater, California in the spring of 2003.

The seven tree-sitters, along with more than twenty other local residents and protestors were slapped with a lawsuit by PL that charged trespass and conspiracy. A SLAPP suit is a Strategic Lawsuit Against Public Participation. The activists' counter suits include allegations of assault, battery, negligence, infliction of emotional distress, false imprisonment, and violation of their civil rights.

Unlike most of the other redwood giants formerly occupied by activists to protect them, the trees Gershman and Kohler sat in are still standing. Kohler was the third tree-sitter to be evicted from the ancient redwood known as “Jerry,” from which Card (better known as marathon tree-sitter “Remedy”) and Sanchez were also removed. Gershman, another long term tree-sitter whose feet didn’t touch the ground for seven months, was removed from a giant redwood dubbed “Everlasting Life.” The two trees are still occupied by tree-sitters on tiny tree-top platforms. Maxxam/PL still intends to have the trees cut down.

The SLAPP suit is on hold following a move by attorneys for the PL-hired extractors that disqualified Judge W. Bruce Watson. Humboldt County Superior Court Judge Dale Reinholtsen will rule soon on whether the disqualification was legal, and determine whether he or Judge Watson will take on the case. ##

After witnessing the photo of an unnamed treesitter being lowered, it is a concern that a back condition (sciatica) was worsened by the improper techniques used by climber Eric Schatz..

The lower spine is naturally curved (inwards towards the stomach) and shouldn't be forcefully bent outwards beyond a certain degree or disks can become misaligned or ruptured and nerves can become pinched and irritated causing great pain..

After spending time with this treesitter and witnessing the intense pain i researched sciatica and the curvature of the spine. Only after someone showed me the lowering position in the picture did i believe that the condition was worsened by Eric's lowering technique that placed added pressure on the lower spine, curving it the opposite direction (outwards from the torso) for a considerable amount of time, enough to increase pressure on the disks and possible rupturing of the disk..

When i mentioned this to the treesitter they stated they didn't want to pursue this because it seemed futile in court, nobody would believe that the lowering caused this. Either way i needed to mention this in public forum because i strongly believe the lowering worsened the injury and this could also happen to somebody else..

As long as activists allow themselves to be assaulted and kicked around and don't follow through with official complaints or legal action, the bastards will continue to beat people up. The more PL-hired thugs and cops get away with this brutality, the worse it will be for the next activist who winds up in thier grip. If you get hurt by these guys, go to a hospital, document your injuries, and file a complaint! Don't just complain. Your action doesn't end when you get your ass kicked!!

I think that some of these tree-sitters have gone too far. There are lumber companies that are just trying to do their job. As long as they are not chopping down huge rain forests, I think that they can chop away. I understand that there are some places where it would not be the best for people to cut down trees, but I think people should not get involved if the lumber companies have permits from the government.
