Background:
In October 2003, the Environmental Protection Agency (EPA) sued Chevron for operations at all five of its US refineries, and on the same day filed a Consent Decree settling those claims. A Consent Decree is a formal agreement, signed by a court. It often describes how, when, and what actions each party will take to settle a claim. The Bay Area Air District also signed onto the Consent Decree even though CBE had notified the District of numerous Clean Air Act violations at Chevron’s Richmond refinery. The Court has not yet signed and finalized the Chevron Consent Decree.

The Consent Decree would settle all of the New Source Review (NSR) violations at Chevron’s five US oil refineries. NSR is a Clean Air Act program that requires refineries to install control technologies when they modify major existing sources.

The Consent Decree would let Chevron off the hook without requiring it to install pollution controls or pay significant penalties for past violations. The Consent Decree would also excuse Chevron from past flaring violations and expand permissible flaring from true emergencies to also include flaring resulting from startup and shutdown.
