Israeli settler 'gets away' with murder

A Jewish settler who killed a Palestinian driver has been freed from police custody and placed under temporary house arrest, Israeli state-run radio has reported.
His release, ordered by the Kfar Sava court on Tuesday, sheds light on the stunning leniency adopted by the Israeli justice system toward Jews involved in serious crimes against non-Jews.

The court, presided by a religious Jew, reportedly rejected a police request to extend the remand of Yehosua Elitzur, from the West Bank settlement of Itamar, until the end of the legal proceedings.

On Monday, Elitzur killed a Palestinian driver, claiming the victim tried to run him off the road.

Eyewitness accounts

Palestinian eyewitnesses testified that Elitzur killed Salah Jebara, a father of eight children, in cold blood and for no reason other than wanting to kill a Palestinian.

"The settler parked his car on the right side…and stood in the middle of the road. When Salah Jibara arrived and slowed down thinking that the settler needed help, the settler aimed his M-16 at him, killing him on the spot," said Muhammed Shatiyya.

"Then the settler began praising God for killing him."

When a Palestinian passer-by asked why he shot him, the setttler said ..."It doesn't matter, he is only a Palestinian," according to the Jerusalem-based Palestinian Human Rights Monitoring Group which has investigated the incident.

Murder

According to another Palestinian eyewitness Ahmad Shatiyya

"The settler simply was waiting for any Palestinian motorist to come so that he could kill him…even if Jebara had not stopped, the settler would have killed him claiming that he had tried to run him over…"

"The man was out to kill an Arab…it is as simple as that."

Shatiyya and other Palestinians in the area tried in vain to save Jebara's life.

"He lost consciousness and we tried to resuscitate him. We shouted to the settler to call an ambulance, but he said 'praise to God…he is dead'…and left"

Ever since the start of the Intifada four years ago, Jewish settlers, affiliated with the National-Zionist movement known as Gush Emunim, have murdered dozens of Palestinians, including children.

Edicts

Earlier in September, several influential Orthodox rabbis and Talmudic sages in Israel issued religious edicts allowing Jews to kill Palestinian civilians and non-combatants even if they posed no threat to Jews.

The rabbis apparently relied on a Talmudic injunction stipulating that in war time, Jews are enjoined to kill enemy civilians.

The settlers often concoct pretexts for the purpose of justifying or at least extenuating the severity of their acts.

Normally, Israeli courts give them the benefit of the doubt and reduce the severity of the charges against them from murder to manslaughter in which case the killers spend a few months or a few weeks in jail before they are freed.

Palestinians convicted of killing Jews, even by mistake, are usually convicted for murder and imprisoned for life. Moreover, their family homes are demolished and their belongings are destroyed by Israeli bulldozers.

According to Ahmed Shatiya, a Salem resident, the car was on its way to the Jordan Valley when "just before reaching the main road, Sa'al slowed down and began driving up an incline adjacent to the road. He started to turn right to get onto the road when we all noticed a tall, dark-skinned settler with a beard standing in the middle of the road in front of a red Ford Fiesta.

"Sa'al thought the settler needed help and he slowed down; he then opened the window and spoke to him in Hebrew. Suddenly the settler aimed an M-16 at him. The settler fired off a few rounds at Sa'al, hitting him in his left arm and the left side of his chest.

"He lost consciousness and we tried to help him, and we shouted to the settler to come and help and call an ambulance, but he said, `Please God, he dies,' and left.

"Another settler who arrived on the scene also refused to help. Eventually, we spotted a Palestinian taxi, and we took Sa'al to hospital in Nablus, but he died on the way."

Shatiya added that the incident had not been preceded by any altercation between the settler and Jabara, whose body was transferred for an autopsy to the Abu Kabir Forensic Medicine Institute.

Were all the witnesses Palestinians?

That Israeli is under legal procedure, as it seems from the article.

What do the PA do with the Palestinians who commit terrorist attacks against Israelis?

Why does the article call this person a "Jew" instead of an Israeli? Is religion relevant for the matter? If so, who for?

It seems that those Palestinian witnesses knew the intentions of Elitzur. They knew he has gone out because he felt like killing a "Palestinian" (Why don't you say "Muslim").

The article states "the stunning leniency adopted by the Israeli system toward Jews involved in serious crimes against non-Jews".
Those Jews and not- Jews, do they have no nacionality? I imagine that if they are citizens of Israel, they are Israelis.

So Jews kill people of other religions and the law is different in this cases (!!!). As far as I know, Israel is a democratic country, which doesn't happen with any other country in the area.
For instance, the Palestinians are living under a police regime stablished by Arafat.

What about Israeli children intentionally killed by "Palestinian"terrorists? What does the PA does to them? They are paid by Arafat and made heroes, who the Palestinian children should imitate. Why do the "Palestinians" use their children as ammunition and human shields? Does it demonstrate that the "Palestinians" care about children?

One good point: at least the article admits that Palestinians intentionally kill Israelis ("Jews"): "Palestinians convicted by killing Jews, even by mistake,..."

And he forgets to point out that Elitzur isn't convicted yet.

The article in Al Jazeera is taking sides and believing what the Palestinian witnesses say more than what the Israeli witnesses say. It also uses the word Jew in the title instead of Israeli but since there are Arab Israelis calling settlers Jewish rather than Israeli in and of itself doesnt seem biased.

Whats interesting about the knee jerk response of the pro-Israel looneys to anything like this is how they dont bother reading what happened and just jump to the conclusion that the evil Arab deserved to be murdered because ... well he was Arab and Arabs must be bad people. I doubt any peopel actually think that openly but its whats behind the thought that counts.

I can't imagine Al Jazeera ever using phrases like " Score one for the good guys." and acting so gleefully over an assasination (no matter who was assasinated)

Al Jazeera is one of the less biased news organizations out there (and thats not saying much). The US media is reduced to talking about "good guys" and "bad guys" and celebrating bombs in Fallujah and Sadr city even though the US backed Iraqi government has confirmed that such bombings have killed far more civilians than have the resistance. The Israeli media can be ok at time (Haaretz is less biased when it comes to Israeli policy than the major US newspapers) but then you see stuff like:

and even though its opinion you relize how bad things really are. Its apparently now mainstream in Israel to use religious arguments to denounce people who blow the whistle on attrocities they personally witnessed. Saying that blowing the whistle on war crimes in Viet Nam (or Iraq or Palestine) is a violation of "one of the most important religious laws, inculcated within nearly every Jewish child from the youngest age" is to slander all those who practice Judaism. But its right there in the Jerusalem Post. Its strange how much talk of anti-Semitism one hears these days used as a blunt weapon against those fighting for peace when the hawkish right-wing finds so little problem in trying to equate a religion with support for war and repression (and keeping silent about war crimes!!).

Al Jazeera is probably the least anti-Israel popular news source in the Middle East; its bias is in what it covers more than how it covers it. Taking a step back one would probably conclude that Al Jazeera is doing a lot to decrease antiSemitism by covering the Israel-Palestinian conflict in a much less religious tone than one hears from other regional press agencies. The Jerusalem Post, on the other hand, spreads lies about Judaism and spreads a myth that to be Jewish one must be a biogoted nationalist who cares little for human rights except in cases where its a useful tool for scolding others. That opinion column in the Jerusalem Post and the comments on this site show how antiSemitism is spread; certain unscrupulous right-wingers equate anti-Semitism with opposition to Israel and then go all out celebrating assasinations and making excuses for the worst Israeli attrocities (in this case the murderer's own account doesnt give any real explanation for the killing).

Yes, it seems clear that the article is taking sides.
I didn't say that Arab deserved death,which I don't know. I only said that it is very strange that the article let us know only the declarations of one side.
If what the Jewish witnesses' explanations are illogical, they should give them so things would be completely clear.

A "remand hearing" is like our "bail hearing". He hasn't been tried yet, just sort of out on bail to "house arrest". Around here "manslaughter" is often bailable.

Let's wait for the trial? Then of you are interested you can find out what happens. Yes, we have reports that several Palestinian witnesses agree "murder" (not bailable in Israel just as not baliable here) but you haven't seen that testimony and presumably the judge making the decision has. For example, three witnesses can be worse than one if although they all describe a "murder scenario" the description of each is incompatible with that of the others.

Rachel Corrie, Tom Hurndall and James Miller were all non-Jewish activists killed in cold blood by the Israeli army. Only the Israeli solder who was non-Jewish, who was responsible for killing Tom Hurndall was put on trial. The Jewish Israeli soldiers who killed Rachel Corrie and James Miller got off scot free.

Zionist Jews think there is a different set of standards that should be applied to Jews vs. non-Jews, and Israel vs. other countries. And now they've got the US government doing their dirty work as well.

Hate to burst your bubble, sunny, but Rachel Corrie was killed in an accident and you sadly have been duped. If anyone is to blame for her death, it should be Corrie and her fellow activists on this scene. Anyway, your theory about Zionist standards clunks.
