Defense Rests on Monday-Case Will Go To Jury By Tuesday Afternoon

San Francisco, Calif.-The defense in the Pepper Spray by Q-Tip civil
rights trial rested after calling only four witnesses this morning.
Closing arguments and jury instructions were scheduled for Tuesday
morning at 9:30 am. The defense is the Humboldt County Sheriffs
Dept. and the Eureka Police, who were sued by activists for using
excessive force when they swabbed their eyes with pepper spray using
Q-tips.

The case, being re-tried after an initial trial seven years ago, has
been drawing a packed courtroom as it is argued before Judge Susan
Illston, in Courtroom 10, 19th floor of the SF Federal Building.

Plaintiffs and their attorneys will be available at a sidewalk press
conference during the noon hour Tuesday at the Turk St. entrance to
the federal building, located at 450 Golden Gate Ave., San Francisco.

The plaintiffs are the "Pepper Spray 8" -eight activists who
participated in civil disobedience sit-in actions eight years ago in
the Headwaters Forest campaign: Spring Lundberg, Terri Slanetz, Mike
McCurdy, Sam Neuwirth, Maya Portugal, Lisa Sanderson-Fox, Jennifer
Banka Schneider, and Noel Tendick.
Their attorneys-the same legal team that won the historic Judi Bari
vs FBI case in 2002- includes Dennis Cunningham, Bob Bloom, Tony
Serra and Bill Simpich.
