Large concrete teeth sliced through the asphalt. Dirt filled my shoes, dust infested my nostrils. And I was only half-way across Third Street at Palou. On this bright Tuesday morning in September I wavered between the sort of safety of the crumbling curb and the near death of the middle of the non-street in ground zero of the largest, most devastating gentrification, oh excuse me, Development projects to hit a poor African descedent community since the descimation of the Fillmo.

So how do you destroy an entire community without a bomb, a firefight or missile?

" They are building this project right up the middle of this mostly Black community (BVHP) and they aren't kicking down any of the money or the contracts to the black residents of this very community." After I walked through the mess that is Third street circa 2004. I ran into longtime Bayview resident, Kyle, who has lived and worked (when he can find work) in San Francisco for the last 20 years.

"It’s the same ol story, how do you get rid of people?… sell off their land and their contracts to outsiders until one day they become the outsiders in their own land" Kyle ended by looking in the direction of the other big "gentrification" (read:displacement) project in BVHP which is the demolition of several hundred projects " on the hill" by the Redevelopment agency and the rebuilding of market rate condos in their place, which this PNN reporter considers a frightening example of 21st colinization

Kyle told me that on many occasions he has inquired into job opportunities in the li(t)e rail project from MUNI, the City, EDD, etc, only to be given the runaround in more ways than one

I came to BVHP this morning to meet with Kyle in preparation of a Transportation hearing held later that morning at SF City Hall to approve the funding (with sales tax and release of prop k funds) of The Metro East Maintenance Facility which was chaired by SF Board Supervisors, Chris Daly Bevan Dufty and Sophie Maxwell.

The issue of who will get this contract and who will be hired has the ire of several San Francisco City Council members, including Matt Gonzalez, Chris Daly and even District 10's sometimes ambivalent-to-act, Sophie Maxwell because of the bizarre lack of compliance by MUNI with the hiring quotas of 50% resident, 25.6% minority, 6.9% women and the fact that the multi-million dollar "Lite Rail" project that runs right all the way up 3rd street right through the Black community has so far not been given to a local African-American contractor.

" I have a stack of memos, that are only just that, memos from meeting after meeting with officials, and none of those translate into jobs." At the meeting, I spoke to Gus Amador teacher in one of the Community based organizations doing training for the very jobs that would be needed if MUNI were to follow the hiring quotas and open the bidding to African American contractors rooted in the community. Gus concluded with a sigh "and I am training low-income residents of this community to become union carpenters and the bottom line is these San Franciscans deserve to get jobs in San Francisco."

This meeting was held at the SF Transportation Authority one week after a 300 community member strong meeting was held before the Human Rights Commission. The fact that the Human Rights Commission was so well attended and this meeting (the one that really mattered,) much less so, was no accident, as the CBO's who on one hand will benefit if these hiring quotas are followed because their participants will be hired upon graduation, are also receiving money from the very folks who are leading the charge to gentrification/descimation of BVHP i.e., the Mayors office of Community Development, et al, These same CBO's decided that it was imperative that they hold classes today at the same time as the Transportation hearing.

" I just want to make sure we look at both sides of the coin," A man who represented himself as a consultant to non-profit agencies that provide employment and training spoke to me outside the hearing room in hushed tones, "yes there is always room for improvement in contracting opportunities, and there is always room for improvement in employment and training opportunities, but I do want to say that there are a number of CBO's that have been very successful in training and placement in projects such as the MUNI lite rail project," Now this well-spoken African Descendent gentleman completely confused me with paragraphs that sounded a lot like they came right out of a grant proposal or MOCD Request For Proposal(RFP) so I had to ask again, "are you saying that MUNI is employing the BVHP community or not?"

"Well, what I am saying is that MUNI has been creating some employment for the community and leveraging other funds to create other training and placement situations happen….." At this point a whole rush of youth who had just spoken before the panel rushed out of the door in a wave of protest, only to meet the eager gaze of Apolliona's skilled camera, which caused the perfect distraction for my consultant friend, well-timed because I didn't know how much more double talk my brain could hold.

Some noteworthy comments from the Board members present included one by Chris, " Unless you satisfy the people in the community, I am not voting for this" (funding) and even an unusually scathing comment to MUNI from Sophie, " Aren't you jus doing the same thing again"

As well, several powerful folk from the community did come up and speak, one of which was a young African Descendent woman, Erica Mccrury, proud enough of her hoped for future with MUNI, that she even donned the requisite orange mesh jacket over her gray sweatshirt for a PNN photo, "I am an out of work veteran of Desert Storm, and I just want to make sure that when I graduate ( from my pre-apprentice-ship program, I get a chance to work on the lite rail project rather than them bringing folks in from the outside (to work on the project) "

MUNI "hiring quotas" are illegal. They violate 209. To get a job, a person needs some qualifications. Being "minority" is not a job qualification. Being able to read helps. Basic math helps. Speaking standard English helps. "Demanding" does not help. Nor does it work.

MUNI receives Fereral Transportation Money, which sets Federal Hiring and Contracting Goals which MUNI is not meeting. Sorry to dissapoint your racist stance. Read the law and EDUCATE YOUR SORRY ASS. We know that you would like to beleive that everone is uneducated, sorry there are many educated people in BVHP.

The U.S. Department of Transportation's DBE (disadvantaged business enterprise) program provides a vehicle for increasing the participation by MBEs in state and local procurement. DOT DBE regulations require state and local transportation agencies that receive DOT financial assistance, to establish goals for the participation of DBEs. Each DOT-assisted State and local transportation agency is required to establish annual DBE goals, and review the scopes of anticipated large prime contracts throughout the year and establish contract-specific DBE subcontracting goals. Three major DOT operating administrations are involved in the DBE program. They are the Federal Highway Administration, the Federal Aviation Administration and the Federal Transit Administration.

In addition to establishing goals, state and local recipients also certify the eligibility of DBE firms to participate in DOT-assisted projects. Some Minority groups are presumed to be socially and economically disadvantaged for the purposes of participation in this program. In 1987 Congress added women to the groups presumed to be disadvantaged. The main objectives of the DBE Program are:

* To ensure that small disadvantaged business enterprises ( DBE) can compete fairly for federally funded transportation-related projects.
* To ensure that only eligible firms participate as DBEs.
* To assist DBE firms in competing outside the DBE Program.

There has, since 1983, a statutory provision requiring DOT to ensure that at least 10% of the funds authorized for the highway and transit financial assistance programs be expended with DBEs. DOT has established a single DBE goal, encompassing both firms owned by women and Minority group members.

To be certified as a DBE, a firm must be a small business owned and controlled by socially and economically disadvantaged individuals. Certifiers make the determinations based upon on-site visits, personal interviews, reviews of licenses, stock ownership, equipment, bonding capacity, work completed, resume of principal owners and financial capacity.

Background

The Department of Transportation (DOT) has had in effect for more than 20 years a policy of helping small businesses owned and controlled by socially and economically disadvantaged individuals, including minorities and women, in participating in contracting opportunities created by DOT financial assistance programs. The Department, through its Operating Administrations, distributes in excess of $20 billion annually to help finance thousands of projects across the country. Approximately 85% of the assistance dollars is for construction. The major portion of the construction funds is allocated to State highway and transportation agencies for highway construction. The balance is provided to local public transit and airport authorities for mass transit and airport facilities.

In 1983, Congress enacted the first disadvantaged business enterprise (DBE) statutory provision. This provision required the Department to ensure that at least 10% of the funds authorized for the highway and transit financial assistance programs be expended with DBEs. In 1987, Congress re-authorized and amended the statutory DBE program. In the transportation legislation of that year, Congress, among other changes, added women to the groups presumed to be disadvantaged. Since 1987 DOT has established a single DBE goal, encompassing both firms owned by women and minority group members.

Primarily three major DOT Operating Administrations are involved in the DBE program. They are the Federal Highway Administration, the Federal Aviation Administration and the Federal Transit Administration. The DOT DBE program is carried out by state and local transportation agencies under the rules and guidelines in the Code of Federal Regulations (Title 49, Part 26).

How the Program Works

Among other things, DOT DBE regulations require recipients of DOT Federal financial assistance, namely, state and local transportation agencies, to establish goals for the participation of disadvantaged entrepreneurs and certify the eligibility of DBE firms to participate in their DOT-assisted contracts.

Each DOT-assisted State and local transportation agency is required to establish narrowly-tailored DBE goals. Then these DOT-assisted agencies evaluate their DOT-assisted contracts throughout the year and establish contract specific DBE subcontracting goals where these goals are needed to ensure nondiscrimination in federally-assisted procurements. The level of DBE subcontracting goals may vary from their approved DBE goal however, at the end of the year the amount of contract/subcontract awards to DBEs should be consistent with the overall goal.

In order for small disadvantaged firms, including those owned by minorities and women, to participate in the DOT-assisted contracts of State and local transportation agencies they must apply for and receive certification as a DBE. To be certified as a DBE, a firm must be a small business owned and controlled by socially and economically disadvantaged individuals. Recipients get information about firms through on-site visits, personal interviews, reviews of licenses, stock ownership, equipment, bonding capacity, work completed, resume of principal owners, financial capacity, and type of work preferred. More information on certification can be obtained from the recipients' DBE Certification Officers listed in this Section. DOT and SBA are currently working on an agreement to facilitate participation by DBEs in SBA programs and vice-versa.

State Departments of Highways and Transportation (SDH&T) receive supportive services funds from the Federal Highway Administration to help increase DBE participation in Federal-aid highway contracts. The SDH&T may decide to use the funds inhouse to provide the supportive services or hire consultants. Supportive services whether done by the State agency or consultants help DBE's to compete in winning contracts. The services include research and development, training and on site-technical assistance, business management assistance, estimating assistance, and assistance in obtaining necessary financing and bonding.

San Francisco Housing & Muni the Jewel of San Francisco Suppression of Residents

How the Haves try to make sure that the Have Nots have nothing. Their goal is nothing from nothing leaves nothing. (That's where the Housing residents are left - with nothing. Or homeless.)

Let's look at SF Housing planning to declare bankruptcy instead of paying court settlements for families burned up in fires and sexual harassment. Already being on HUD'S TARC Troubled Agency Recovery Center, meaning that multiple millions of dollars to help residents didn't get to them because of gross mismanagement by San Francisco Housing. Many of those dollars could have helped improve the living conditions and provide programs leading to self-sufficiency.

It's a pattern of irresponsibility. Intentional incompetence by the crooked Executive Director of the agency including Ronnie Davis, and the current head of their Commission, Julie Lee - both Willie Brown appointees.

The intentional destruction of residential management, and tenant associations that could help residents to move forward. The boarding up of several hundred units; at one time up to six hundred empty units leaving many needy residents out in the cold or homeless. The Section 8 scandal the selling of vouchers depriving the truly needy. The lack of hiring of community residents to help maintain their own living areas. (sounds like Muni ignore the residents) The lack of training programs for residents. The sexual harassment of tenants. Properties maintained in substandard conditions. Many of these residents are living in known toxic impacted areas, environmentally comprised, causing ill-health to the children, the true innocents.

The ripping off of residents where many should have been getting Hetchy Hetchy Power instead getting the more expensive PG&E power taking a bigger bite out of their monthly budget and if they don't pay their PG&E they will be evicted. Didn't PG&E help pay for Brown's inauguration? Seems like they can use public money for energy efficiency to help Julie Lee's son Andrew when he ran for Supervisor (that comes straight out of Public Goods Charges on our PG&E bills).

Then there’s HOPE Vl. Look at Valencia Gardens it is now an empty lot without Hope, residents pushed out for points unknown. Just a step in the gentrification process in San Francisco. Add Muni, add Redevelopment. The New York Times writes “Black people are leaving San Francisco faster than any other city in the nation.”

Then there is the manipulation of voters who live in SF Public Housing. (See 49er Mall stadium etc.) This fits with the appointment of Julie Lee a real estate agent with unscrupulous morals. Maybe she wants to be first in line to redevelop the land where Housing sits. Lee is known for her fund-raising for San Francisco politicians including money-laundering donations to Shelley, Secretary of State (who deals with elections and non-profits). She screwed her own non-profit and sent some of the money back to Shelley that he appropriated to build her community center that never got built. The City gave her non-profit hundreds of thousands to help poor immigrant Sunset residents but they were hardly ever open. She has a true caring for the poor residents, a slumlord just recently evicting an elderly blind lady. (Another Housing Commissioner also evicted a long time elderly tenant just to be able to run for Supervisor. Oh by the way he lost.) These are the type of persons we have in charge of low income and poor residents who are the most vulnerable.

Shame on you Board of Supervisors for allowing this happen to your San Francisco Residents. Chris Daly attempted to correct this earlier. Maybe you want to join the Mayor and play Basketball with the Residents of Public Housing, while the SF Housing Agency declares Bankruptcy. And you wonder why there is violence and drugs? Try leading by showing Leadership & Responsibility
